Terms of delivery. DELIVERY TIMES: Dates for delivery or making available accepted by vendors must be strictly adhered to. Cases where a delay is justified by a case of force majeure must be reported to us in writing as soon as the event occurs. Important note: the delivery deadline specified in our orders means the date "received at" Tresse Métallique X. Xxxxxxxxx and not shipped date from supplier site. When the specific terms of the order provide for it and in particular in the event of an unwarranted and unjustified delay, late delivery penalties will apply without there being any need for prior notice and without prejudice to the provisions of Article 14. All deliveries shall be made within the normal working hours of our sites (written on our orders), with the exclusion of Saturdays, Sundays and public holidays; - DELIVERY QUANTITIES: The quantities of products to be delivered mentioned in the order must be strictly adhered to. Unless specifically mentioned in the order, our company reserves the right, if excess quantities are delivered, to ship such surplus items back to the vendor at the latter's expense and risk or to accept them free of charge and to return partial deliveries at the vendor's expense and risk. - PLACE OF DELIVERY: Unless specifically stipulated otherwise, orders must be delivered: For deliveries of supplies or equipment sold "carriage and packaging paid", to the places specified in the order. For items made available in the site or factory: supplies and equipment ready for acceptance or duly packed ready for shipping as stipulated in the order. No shipments shall be made carriage forward. Any expenses resulting to from the failure to comply with this clause will be borne by the vendor. Unless specifically stipulated otherwise: Deliveries to the places stipulated in the order shall be made "carriage and packaging paid", all charges being paid by the vendor; For equipment purchased "ex works", the vendor shall take care of packaging and transport on our behalf at the best possible terms. The corresponding costs will be paid by the vendor and invoiced to us at cost. All deliveries must be accompanied by the documents mentioned in the order and a delivery note bearing the vendor's letterhead. The latter must include at least our order no., our item code and the quantity delivered. Terms of delivery. The terms of delivery specified are only provided as an indication unless otherwise agreed in writing. In no way do these bind us, nor may they give rise to any compensation for whatever reason. BASF cannot be held liable in case of impossibility or delay of the fulfilment of its essential contractual sales obligations if this impossibility or delay is the result of compliance with legal or regulatory requirements relating to a purchaser-initiated application of the European Chemicals Regulation REACH. 6. - Transportation Unless otherwise agreed in writing, as from the date of delivery, purchaser will bear any and all risks pertaining to the delivered goods, including transportation of the goods, even if the transportation costs will be at our expense according to a separate agreement in writing. If, contrary to the aforementioned provisions, another industry-accepted clause such as FOB, CIF, CFR, CPT, EXW,..., is agreed for delivery, this will be interpreted according to the Incoterms which will apply as from the date of sale. 6bis. –
Terms of delivery. Deliveries in France are considered DAP France (“Delivery At Place”) pursuant to the last publication of the INCOTERMS of the International Chamber of Commerce, in effect on the date of conclusion of the contract, and VAT-included.

  • CONDITIONS D’ADMISSION L’établissement EHPAD Saint Barthélemy reçoit des personnes âgées dépendantes, atteintes de maladies neuro-dégénératives, de pathologies psychiatriques, ayant un parcours dans l’errance et / ou atteintes de pathologies liées à l’âge. L’admission est prononcée à la suite d’un entretien avec la personne accueillie et le cas échéant son représentant légal par la commission d’admission de l’Etablissement présidée par la Direction après présentation du dossier unique d’admission prévu à l’article D 000-000-0 du code de l’action sociale et des familles. L’établissement a défini avec la personne accueillie, les objectifs d’accompagnement :  Hébergement :  Aide à gestion de la vie courante :  Loisirs :  Droit à l’image et participation à la vie de l’établissement : La personne accueillie : autorise l’établissement à utiliser l’image de son choix ou tout support audiovisuel n’autorise pas  Vie sociale : dans le cadre d’une diffusion liée à la vie de l’établissement.  Objectifs médicaux et paramédicaux : Lors de son admission, la personne accueillie a choisi le Docteur comme médecin traitant, la personne accueillie demande à l’établissement de l’aider à préserver et améliorer son état de santé en mettant à sa disposition le service infirmier continu (24 h. / 24 et 7 j. / 7) et un kinésithérapeute pour sa rééducation.  Soins palliatifs et accompagnement fin de vie :  Autre : Un avenant précisera impérativement dans un délai de 6 mois maximum après admission de la personne dans l’établissement, les objectifs et les prestations adaptées et spécifiques à la personne accueillie (voir Annexe 1).

  • CONDITIONS GENERALES Les termes du présent Article I (« Conditions Générales ») s’appliquent de manière générale à tous les Produits et Services fournis au titre du présent Contrat.
