ALABAMA DEPARTMENT OF CONSERVATION AND NATURAL RESOURCES. In Alabama, the gopher tortoise is federally listed under the Endangered Species Act (ESA) in the western portion of its range (Mobile, Washington and Choctaw counties) and currently a candidate species for listing in the eastern portion, which includes twenty-three southern Alabama counties. The State of Alabama permanently protects and manages approximately 26,000 acres of tortoise habitat on public lands including Xxxxxxx X. Xxxxxx-Xxxxxxx, Xxxxxxx, Xxxxxx State Forest (only the DWFF owned lands are being reported; AFC reports on the acres they own that are in the Geneva State Forest Wildlife Management Area), and Perdido River Wildlife Management Areas (WMAs), Uchee Creek, Xxxx X. Xxxxxxxx and Upper State Special Opportunity Areas, and Elhew Research Station (Xxxxx tract). The Alabama Department of Conservation and Natural Resources, Division of Wildlife and Freshwater Fisheries (DWFF) and the State Lands Division (SLD) continue to work together to restore and maintain gopher tortoise habitat on DWFF, Forever Wild Land Trust, and SLD lands. Land management conducted by DWFF staff included 6030 acres of prescribed burning (combined dormant and growing season xxxxx), 575 acres of thinned pine plantation, 821 acres of clearcut, mechanically treated 400 acres, site prepped 1178 acres, reforested 1118 acres to longleaf pine, reforested 2730 acres to loblolly pine, and removed 104 acres of invasive plant species. Additionally, over 131 feral hogs, 26 coyotes, and 7 raccoons were removed from DWFF lands. Land management conducted by the SLD, Elhew Research Station personnel included 14 acres of dormant season xxxxx and conducted other habitat management activities on 173 acres. DWFF continues work towards determining a more accurate gopher tortoise population estimate and distribution in Alabama. Gopher tortoise surveys on public lands using Line Transect Distance Sampling (LTDS) methodology were completed in Oct 2017. (AL Gopher Tortoise Surveys on Public Lands SWG Final Report, 2017). Since non-industrial private landowners own most of the gopher tortoise habitat in Alabama, significant efforts were made to gain access to private lands to conduct gopher tortoise surveys. However, access to private lands has been difficult mostly due to the misperceptions of information needed and data protection concerns. ALABAMA DEPARTMENT OF CONSERVATION AND NATURAL RESOURCES. The gopher tortoise is a species of highest conservation concern in Alabama. Currently, the tortoise is federally listed as threatened in three Alabama counties (Mobile Washington and Choctaw counties) and state protected (Alabama Regulation 220-2-.92) for those counties in the candidate range. The Division of Wildlife and Freshwater Fisheries (DWFF) continues to actively promote range wide conservation of the gopher tortoise, xxxxxx associates and commensals and gopher tortoise habitat while also conducting habitat protection efforts on wildlife management areas (WMAs) and special opportunity areas (SOAs) within the tortoise’s range. Public lands owned by the DWFF include Xxxxxxx WMA (Xxxxxxx and Xxxxxxx counties), Geneva WMA (Geneva County), and Xxxx X. Xxxxxxxx and Upper State SOAs (Clarke County). Ninety-five percent of the gopher tortoise habitat in Alabama is in private ownership. Therefore, commitment and assistance from private landowners is necessary for successful conservation of the gopher tortoise and the species habitat in Alabama. The following are examples of ongoing and planned management actions and activities focused on conserving the gopher tortoise in Alabama: • The Alabama Tortoise Alliance (ALTA) was created in December 2017. The purpose of ALTA is to bring stakeholders (state and federal agencies, tribes, private nonindustrial landowners, industrial landowners, NGOs) together to 1. Promote conservation practices that improve gopher tortoise habitat and conserve the species and 2. Collect the data needed by the US Fish & Wildlife Service (USFWS) to demonstrate that ESA listing is unwarranted. DWFF will continue to facilitate and organize meetings as warranted by Alabama stakeholders; • Pursue a state regulation to protect the intentional destruction of a gopher tortoise xxxxxx exempting agricultural and silvicultural activities as other states do; • Partner with Alabama Department of Transportation (ALDOT) to develop a standard protocol for relocating any gopher tortoise that may be impacted by ALDOT Projects; • Enhance and restore gopher tortoise populations in degraded habitats on suitable public conservation lands by improving gopher tortoise habitat and augmenting populations with waif tortoises acceptable for release or targeted relocation efforts when appropriate and opportunities are available; • Use distance sampling to estimate gopher tortoise populations on all publicly-owned lands identified as having suitable tortoise habi...
ALABAMA DEPARTMENT OF CONSERVATION AND NATURAL RESOURCES. The State of Alabama permanently protects or manages approximately 19,000 acres of tortoise habitat on public lands to include Xxxxxxx, Xxxxxx, Perdido, and Upper Delta Wildlife Management Areas (WMAs), Xxxx X. Xxxxxxxx and Upper Place Wildlife Sanctuaries, and Elhew Research Station. The Alabama Department of Conservation and Natural Resources, Division of Wildlife and Freshwater Fisheries (DWFF) and the State Lands Division (SLD) continue to work together to restore and maintain gopher tortoise habitat on both DWFF, Forever Wild Land Trust, and SLD lands. Land management conducted by agency staff included prescribed burning, removal of invasive plant species, hardwood removal, clearcutting, timber stand improvements, longleaf pine restoration, planting native warm season grasses, and feral hog and coyote removals. A DWFF secured State Wildlife Grant continues to fund survey work on public lands. Survey work and population estimates using line transect distance sampling continued on public lands. Survey results are included in this report for this reporting period. Education and outreach projects that were completed included an AL Best Management Practices brochure, solar industry BMP handout (in partnership with all states in gopher tortoise range), gopher tortoise display to be used at landowner meetings and workshops, and several workshops and events promoting gopher tortoise conservation in AL.

  • CLEAN AIR ACT AND THE FEDERAL WATER POLLUTION CONTROL ACT (a) If the Sub-Recipient, with the funds authorized by this Agreement, enters into a contract that exceeds $150,000, then any such contract must include the following provision: Contractor agrees to comply with all applicable standards, orders or regulations issued pursuant to the Clean Air Act (42 U.S.C. 7401-7671q) and the Federal Water Pollution Control Act as amended (33 U.S.C. 1251-1387), and will report violations to FEMA and the Regional Office of the Environmental Protection Agency (EPA).

  • Cooperation on forestry matters and environmental protection 1. The aims of cooperation on forestry matters and environmental protection will be, but not limited to, as follows: (a) establishing bilateral cooperation relations in the forestry sector; (b) developing a training program and studies for sustainable management of forests; (c) improving the rehabilitation and sustainable management of forest with the aim of increasing carbon sinks and reduce the impact of climate change in the Asia-Pacific region; (d) cooperating on the execution of national projects, aimed at: improving the management of forest plantations for its transformation for industrial purposes and environmental protection; (e) elaborating studies on sustainable use of timber; (f) developing new technologies for the transformation and processing of timber and non-timber species; and (g) improving cooperation in agro-forestry technologies. 2. To achieve the objectives of the Article 149 (Objectives), the Parties may focus, as a means of cooperation and negotiations on concluding a bilateral agreement on forestry cooperation between the two Parties. Such collaboration will be as follows: (a) exchanges on science and technology as well as policies and laws relating the sustainable use of forest resources; (b) cooperation in training programs, internships, exchange of experts and projects advisory; (c) advice and technical assistance to public institutions and organizations of the Parties on sustainable use of forest resources and environmental protection; (d) facilitating forest policy dialogue and technical cooperation under the Network of Sustainable Forest Management and Forest Rehabilitation in Asia- Pacific Region, initiated at the 15th Asia Pacific Economic Cooperation (APEC) Meeting; (e) encouraging joint studies, working visits, exchange of experiences, among others; and (f) others activities mutually agreed.

  • Certification of Compliance with the Energy Policy and Conservation Act When appropriate and to the extent consistent with the law, Vendor certifies that it will comply with the Energy Policy and Conservation Act (42 U.S.C. 6321 et seq; 49 C.F.R. Part 18) and any mandatory standards and policies relating to energy efficiency which are contained in applicable state energy conservation plans issued in compliance with the Act. Does Vendor agree?   • Federal Water Pollution Control Act The contractor agrees to comply with all applicable standards, orders, or regulations issued pursuant to the Federal Water Pollution Control Act, as amended, 33 U.S.C. 1251 et seq.

  • Energy Conservation The Contractor agrees to comply with mandatory standards and policies relating to energy efficiency which are contained in the state energy conservation plan issued in compliance with the Energy Policy and Conservation Act.

  • OF CLEAN AIR ACT AND FEDERAL WATER POLLUTION CONTROL ACT This provision is applicable to all Federal-aid construction contracts and to all related subcontracts. By submission of this bid/proposal or the execution of this contract, or subcontract, as appropriate, the bidder, proposer, Federal-aid construction contractor, or subcontractor, as appropriate, will be deemed to have stipulated as follows: 1. That any person who is or will be utilized in the performance of this contract is not prohibited from receiving an award due to a violation of Section 508 of the Clean Water Act or Section 306 of the Clean Air Act. 2. That the contractor agrees to include or cause to be included the requirements of paragraph (1) of this Section X in every subcontract, and further agrees to take such action as the contracting agency may direct as a means of enforcing such requirements.
