Appeal of Disciplinary Action. If the Union is not satisfied with the response of the Town Board, the Union may submit the matter to arbitration by filing a demand for arbitration with the New York State Public Employment Relations Board in accordance with its rules and regulations. The Association may appeal the taking of disciplinary action against an employee pursuant to the steps of the Grievance Procedure, commencing at the step above the level at which the disciplinary action was taken or imposed. "Disciplinary Action" for the purpose of this section shall be defined as dismissal (except for probationary release or rejection, including promotional probationary rejection), demotion (except for demotion due to layoffs or reduction in force), reduction in compensation, suspension without pay. Not included in the definition of "discipline" under this section shall be oral and written reprimand and evaluation. Employees shall have the right to submit, within thirty (30) days after receipt, a reasonable amount of response and rebuttal material to any written reprimand and/or adverse evaluation, but oral and written reprimands and adverse evaluations shall not be subject to the grievance procedure. Where the Association elects arbitration of discipline, the grievance procedure shall be the sole and exclusive means of appeal.

An employee who has been discharged, demoted, reduced in salary, been made subject to specific employment conditions, or suspended without pay has the right to appeal to the City Manager the disciplinary action by filing a written notice of appeal within ten (10) working days from the date of the notice of discipline. The evidentiary appeal shall be heard by a hearing officer who will serve as the City Manager’s designee.

Appeal of Disciplinary Action. If the employee is not satisfied with the written decision of the Chief Executive Officer in a disciplinary action involving a suspension, demotion, and/or termination, the employee or CEMA may appeal the written decision to an impartial arbitrator, with or without the consent of CEMA. The appeal must be filed within fifteen (15) working days of the date of the Chief Executive Officer's written decision. The arbitration will be conducted in accordance with Section 16.3 below. The appeal of disciplinary action to arbitration will not prohibit the parties from engaging in further discussion and efforts toward resolution in advance of arbitration if mutually desired.

The employee acted against, may within ten (10) workdays after service on him/her or mailing to him/her of the order, appeal through the Office of Administration/HR to the Labor Relations Committee from such order, which appeal shall be in writing. Administration/HR shall check it as to form and timeliness then refer the appeal to the County Administrative Officer for hearing.
