Appointment to Administrative Positions. Whenever an administrative vacancy occurs or a new administrative position is created which is not included within this bargaining unit, the Superintendent will advise the Association members of this vacancy or new position. Association members may request consideration for appointment to the vacancy or new position. No procedures or restrictions contained in this Agreement shall limit the Board's right to appoint persons to these vacancies or new administrative positions. The Board and Association agree that all positions covered by this agreement shall be staffed by the most competent and qualified persons who can be procured. The Board and Association further agree that the Superintendent shall have the right to hire an administrator from outside the bargaining unit rather than transfer a bargaining unit member to any vacancy regardless of whether any bargaining unit member requested a transfer. Finally, the Board and Association agree that the provisions below apply only to those vacancies covered in this Agreement. Unless a position is filled on a temporary basis as referenced below or on subcontracting basis as referenced in Article 13, whenever any administrative vacancy occurs within the positions in this bargaining unit, the Board will e-mail a related posting to all administrative staff members and will include a general statement of all the duties and qualifications. Interested administrators will file a written request for transfer within five (5) working days following distribution of this e-mail. The only exception to this posting requirement, other than those referenced above regarding a position filled on a temporary or subcontracting basis, is that by mutual written agreement the Board and Association may waive the posting requirement pertaining to a specific vacancy. In the posting and filling of all administrative vacancies except the Community High School Principalship, the Board and Association agree that a minimum of a Master's Degree will be required and that whenever available the North Central requirements for the vacant position will be met. A Master’s Degree is preferred but not required for the Community High School Principalship though salary for said position will remain at Step 0 without step increase for anyone not having a Master’s Degree. Whenever a permanent position in the unit is open, the College will post the opening internally for at least five (5) working days prior to externally posting the position. 2. The composition of the selection committee for non-elected administrators at a director level and above shall include a minimum of one member of the Association’s bargaining unit. 3. Final selections and recommendations to the Board for appointments to administrative positions rest with the President.
Appointment to Administrative Positions. 1. Each spring, not later than April 1, the Superintendent, through a communication from the Superintendent's office, will solicit any indication of preference for assignment that current administrators may care to submit for the year ahead. Such preference for assignment may express interest in lateral movement, promotion or demotion. It may indicate a general or particular interest. It may reflect a desire for a change of location, a change of work for either personal or professional reasons, or a career aspiration pattern. It is understood that any administrator by the administrator's initiative may indicate, in writing, such a preference for a change of assignment at any time. 2. When an administrative position becomes newly created or a once filled position becomes available, the Superintendent may exercise the following options regarding the filling of the vacancy: Voluntary or Involuntary transfers - Voluntary or Involuntary demotions - Voluntary promotions. When a transfer of an administrator is at the request of the Superintendent, such administrator shall meet with the Superintendent to discuss the reasons for the transfer which shall include each criteria as program changes, performance, qualifications, experience and length of service. Involuntary demotions (the lowering of the rate of pay at any time) of non- certified administrators shall follow the procedures set forth in the evaluation process for Unsatisfactory Job Performance. The process only in this section is grievable. 3. A notice of vacancy will be publicized in the district by posting such notice in each school unit of the district and each central administrative office. 4. Any MFSA bargaining unit member may apply in writing for vacancies for which the administrator is qualified and certified. A minimum of five (5) school (work) days shall be allowed for applications to be received from any MFSA application. During the summer months when school is not in session, notice of vacancy will be mailed by the Personnel Department to the office of the President of the MFSA or to the address provided by the President. 5. An Interview Committee partially composed of MFSA representatives will review all such applicants and make recommendations to the Superintendent regarding appointment. 6. Temporary appointments may be made by the Superintendent on emergency or interim basis.   • Appointment and Removal of Directors The Directors shall be appointed and may be removed as follows: 4.2.1 The governing body of each Party shall appoint and designate in writing one regular Director who shall be authorized to act for and on behalf of the Party on matters within the powers of the Authority. The governing body of each Party also shall appoint and designate in writing one alternate Director who may vote on matters when the regular Director is absent from a Board meeting. The person appointed and designated as the Director or the alternate Director shall be a member of the governing body of the Party. 4.2.2 The Operating Rules and Regulations, to be developed and approved by the Board in accordance with Section 2.5.11, shall specify the reasons for and process associated with the removal of an individual Director for cause. Notwithstanding the foregoing, no Party shall be deprived of its right to seat a Director on the Board and any such Party for which its Director and/or alternate Director has been removed may appoint a replacement.
