The changes are effective for the staffing process for the 2014/15 school year and subsequent school years. If commencing for the 2015/16 school year, all dates will be moved forward one year.
Posting and Filling. The parties agree that it is desirable to minimize the occurrences of students in the same class being taught by a succession of teachers in the same school year. The parties agree that the circumstances which give rise to such occurrences can arise for reasons beyond the control of either a local union or school district. Local unions and school boards will make every reasonable effort to minimize these occurrences. Where a problem arises in the application of a posting and filling provision a local union and school board may agree to a solution which is inconsistent with the provision. In such cases, the solution is without prejudice and does not constitute a waiver of rights by either party, a local union, or a school district. For greater clarity, the obligation set out in this section is an obligation to make every reasonable effort. Despite paragraphs (1) and this section does not take away from nor add to the rights of any employee, nor does it require a local union or a school district to amend or waive a provision of the agreement.
