Archival Recording. (i) The Employer intends to record the Performer’s performance for archival purposes in accordance with Clause 41 of the Agreement and seeks the Performer’s consent to so record a performance.
(ii) The Employer does not (at this time) intend to record the Performer’s performance for archival purposes (in accordance with Clause 41 of the Agreement). NB: Either 9.1(i) or 9(ii) must be deleted.
Archival Recording. For archival purposes of the Theatre, or other official library theatrical archive, the Theatre shall have the right to make a film, videotape, or other visual record of the final dress rehearsal or of performances. Such record shall be labeled “for archival use only.” The Theatre shall notify in advance, in writing, the Director and/or Choreographer and SDC prior to any such filming or taping.
Archival Recording. A video or audio tape of a production may be made for archival purposes under the following conditions: The musicians and the Association shall be notified, by written notice, of the recording not later than twenty-four (24) hours prior to the recording. The recording must not be edited, copied or distributed in any manner. The recording is to be used exclusively for archival, reference and study purposes. The recording shall remain under the control of the Producer and will not be sold, leased, licensed or lent out for any purpose. The recording may not be replayed in public or broadcast in any manner. The tape shall be labeled "For Archival and Study Purposes Only". Should the recording ever be utilized by any party for any purpose not explicitly set forth herein the Producer agrees to enter into and fulfill all conditions required by the appropriate agreement of the AFM and/or TMA, including, but not limited to the payment of the prevailing fees and allied benefits as required therein.

The Artist must receive at least forty-eight (48) hours notice of an audio visual recording and there shall be no additional rehearsals to facilitate the taping which shall be made from a public performance. Current Affairs A maximum of two (2) minutes of performance or rehearsal may be recorded for presentation on a news, artistic affairs or current affairs program without payment to the Artist. Live-to-Tape Audio Recordings and Broadcasts A live-to-tape recording is defined as a finished audio recording derived from up to three (3) public performances, recorded by the Canadian Broadcasting Corporation for broadcast on its radio networks. Broadcast may be on a live or delayed basis in Canada and on a delayed basis outside Canada over the English and French radio stations including isolated locations in Canada and over the facilities of the Canadian Forces abroad and at sea. Such finished recordings shall not involve the Artist in any additional work and shall not take place on more than three (3) days unless additional payments are made. The shall notify Equity at least thirty (30) days in advance of any such recording and provide Equity with the details thereof. A Performer shall be signed to the applicable Radio Agreement contract for any such recording and broadcast by the and copies of same shall be filed with Equity. A Performer whose engagement contract provides for both public performance and any such recording and broadcast by the where the rate for the recording and broadcast is not less than the applicable minimum fee in accordance with the Radio Agreement, shall not be required to be engaged under an contract. The following minimum rates in accordance with the Radio Agreement shall apply to the engagement of a Stage Director, Choreographer, Production Stage Manager, Stage Manager and Assistant Stage Manager for a recording: Production Stage Manager Soloist Stage Manager Soloist Assistant Stage Manager Chorus Stage Director Chorus Choreographer Chorus If the production has no Chorus, the Chorus rate will be understood as the rate for groups of twenty (20) or more. Equity dues and benefits shall not apply on these fees. Additionally, the shall ensure that the Artist shall have the opportunity to negotiate a royalty prior to such recordings being made. Except as provided for in (A) and above, the Artist shall not be required to participate in a recording or broadcast without the Artist's written consent.

In any case, the provisions of this Clause shall not be interpreted to limit any further of broadcast rights via transmission as provided for in the applicable agreement. Archival Recording. VSO may authorize pre-approved archival recordings of performances which shall be kept in the custody of the VSO. Each archival recording from the date of this agreement forward shall be catalogued according to content and personnel.
19.3.1 VSO may release pre-approved archival recording to radio stations for broadcast under the following conditions:
a. The broadcast shall take place on a local public broadcasting station
b. The broadcasting station may air said recording three (3) times within its broadcast area. Requests for additional broadcasts of a performance shall not be unreasonably denied.
19.3.2 No copies of archival materials may be produced with the exception of copies made in
Archival Recording. The Engager may make study films and/or videotapes during regular Rehearsal hours without any additional payment to the Artist under the following conditions:
(A) All time spent in such filming or videotaping shall be considered Rehearsal time or Performance time.
(B) Recordings of all productions from Rehearsal to Performance state may be made for archive purposes. Archive recordings will be used by the Artists and the Engager strictly for study purposes, and will remain the property of the Engager at all times.
(C) The Engager and the Artists shall take every possible precaution to guard against any misuse of archive recordings.
(D) An archival recording may not be broadcast in whole or in part, except as provided for below (spot commercial)
Archival Recording. The Artist’s performance cannot be recorded under this Agreement, in any way, except that the NAC may record, for the exclusive use of its archives, or as provided for in Clause 21:02, an audio or audio- visual recording of the Artist’s work. If the NAC wishes to record the Artist’s performance for any other reason, a separate agreement shall be entered into between the NAC and Equity, governed where applicable by national agreements.
