Award of Position. Any teacher may apply for such vacancy. In filling teaching vacancies, the Board shall award the position to the most seniored teacher who is certified and qualified for the position. Those teachers who have been awarded a posted vacancy at the middle school level (at the 7th & 8th grade level in 1998 and thereafter) will be required to serve a one year probationary period. During this period, those teachers will be evaluated on the basis of a non-disciplinary Individual Development Plan (IDP) constructed between the teacher and principal. If the teacher is not successful in the new position, as determined by the IDP, the teacher will be transferred to the next available position similar to the position previously held before the transfer was affected or to another mutually agreed upon position.
Award of Position. The assignments indicated above will only be awarded to employees who are MCOLES certified. The award of the position to employees who have applied shall be based upon demonstrated capacity and quality of performance. A systematic consideration of the employee's qualifications, capacity and quality of previous work performance shall be given to the applicants. Length of service shall be the determining factor when other factors are equal. Employees selected shall be on temporary tenure in that position for six (6) months during which time he/she may be disqualified by the Sheriff or himself/herself and return to his/her former classification and/or assignment.

Where circumstances warrant, the Court reserves the right to refuse to promote employees based on the above evaluation. If two (2) or more employees possessing equivalent qualifications apply for the vacant position, the employee having the greater seniority shall be appointed.
