Changes in Employment Status. (1) In the event of a qualifying employee’s death, eligibility will be continued for a spouse, registered same-sex domestic partner and/or children regardless of their registration status at that time. (2) With ten (10) years of service, in the event of a qualifying employee’s retirement or total disability (under OPERS, STRS or Social Security), eligibility will be continued for a spouse, registered same-sex domestic partner and/or children regardless of their registration status at that time. (3) If an appointment is continued at less than full-time, or if a leave of absence without pay is granted, eligibility is continued for two (2) full semesters beyond the date of the change in status. If an appointment is terminated as a result of a reduction of the workforce, benefits are extended for a period of two (2) full semesters for those who have been attending Cleveland State University during the two (2) academic terms immediately preceding the layoff. In the event of any other termination of active service with the University, the Fee Authorization Program eligibility ceases.

Changes in Employment Status. During the first fiscal year after the Effective Date, prior to making any employment change (including but not limited to termination, reassignment, or promotion) with respect to any Transitioned Employee, MTC will provide the ABAG Executive Board with 30 days prior written notice of the intended change before any action is taken. No Transitioned Employee may be terminated, reassigned, or promoted during such period without prior written notice to the ABAG Executive Board and the affected LCP, if applicable.

An employee who is laid off and subsequently recalled within the recall period shall, upon recall, be immediately eligible for benefits under this Article and is not required to wait for the two (2) years after recall to be eligible, provided he or she has otherwise satisfied the eligibility requirements at the time of layoff. A laid off employee who did not satisfy the eligibility requirements for benefits at the time of the layoff shall, upon recall, retain time accrued toward eligibility prior to the layoff and shall satisfy the remainder of the eligibility period prior to receiving benefits under this Article.

Relevant documentation will be required from the Student, including proof of unemployment benefits or claims, a letter of termination, a revised pay stub or advice, or letters from a doctor affirming the Student is Disabled. Funder will presume that Student has not experienced a change in employment status unless Student provides such documentation.

Changes in Employment Status. Because this Agreement is an investment by Education Equity in Student, Student agrees to use her or his best efforts to remain gainfully employed (as more fully explained above). Certain employment status situations are addressed below:

Changes in Employment Status. Any changes in employment status, including voluntary or involuntary job loss, the commencement of a new job, initialization or cessation of government unemployment benefits to the Student, a change in Disability status, or the Student’s entry into protection must be reported to Education Equity as soon as the Student becomes aware of the change. If the Student does not notify the Servicer within fourteen (14) days of an change in employment status, the Student will be liable for Future Income Remittances during the time between when he or she became Unemployed or Disabled and notification to the Servicer, based on his or her Personal Income level prior to the adverse event. Relevant documentation will be required from the Student in each of the above scenarios, including proof of unemployment benefits or claims, or letters from a doctor affirming the Student is Disabled. The Student’s obligations are not dischargeable under bankruptcy laws unless not discharging the Student’s obligations would cause undue hardship to the Student or the Student’s dependents.
