Component Warranty. (a) Guardian represents and warrants that, (i) for the duration of the Warranty Period, each Component sold will perform in accordance with the application Specifications so long as such Component is installed and used in accordance with the applicable documentation and (ii) the design, manufacture, advertising, marketing and sale of the Components is in compliance with all applicable laws.
Component Warranty. (a) Seller warrants that each of the Components delivered to Buyer will meet all applicable specifications and will be free from defects in materials and workmanship at the time of sale. Seller's sole obligation under this Warranty is the repair or replacement, at its election, of any Component which is found, upon Seller's inspection not to meet such warranty. Such product will be repaired or replaced without charge provided that, (1) prior written approval is required before returning any product, and (2) any product return sent to Seller without prior written approval will be returned to the sender, freight collect.
Component Warranty. 5.1. SUPPLIER shall be solely responsible and liable for the Components quality and guarantee of the Components and shall be liable to SODECIA for any failure, defect, inadequacy, non-conformity or lack of quality of any Component regardless of whether the SUPPLIER intends to claim from its supplier any right it may have against the latter.
Component Warranty. (a) Dendreon warrants to Kirin, for a period of twelve (12) months from delivery for Separation Devices and Reagent, a period of nine (9) months from delivery for recombinant antigen PA 2024 and a period of six (6) months from delivery for Dendreon Antigen other than recombinant antigen PA 2024, that the Separation Devices, Reagent and Dendreon Antigen, as applicable, supplied by Dendreon to Kirin shall: (i) be manufactured in accordance with current Good Manufacturing Practices (for medical devices and drugs as promulgated and amended by the FDA); and (ii) conform with applicable Dendreon specifications at the time of delivery by Dendreon. The preceding warranty specifically excludes, and Dendreon shall not be liable for, any action or omission by Kirin or any other entity, specifically including any failure to store or transport Dendreon Components (after Dendreon's delivery pursuant to Section 2.4(a)) in accordance with applicable specifications, which results in the damage or destruction of Dendreon Components after Dendreon has delivered the Dendreon Components to Kirin pursuant to Section 2.4. Kirin's sole remedy for breach of the foregoing warranty as to a particular Dendreon Component shall be repair, replacement or refund of the purchase price paid by Kirin, at Dendreon's sole option.
Component Warranty. Atheros warrants that the Components will substantially conform to the features specified in its then-current datasheet, as it may be amended by Atheros from time to time, for a period of ninety (90) days from the date of shipment. Atheros warrants that all Components sold by Atheros to Buyer under the terms of this Agreement will be free from defects in workmanship and materials under normal use and service for one (1) year from the date of shipment by Atheros. If a Component does not operate as warranted during the applicable warranty period, and provided that Buyer notifies Atheros promptly within the warranty period and complies with the Atheros RMA Procedures, Atheros shall, in its sole discretion (a) deliver to Buyer an equivalent Component to replace such defective Component at its expense or (b) if replacement is not feasible, refund or issue a credit to Buyer (at Atheros’ sole discretion) in the amount of the purchase price paid for the defective Component. Replacement Components are warranted for ninety (90) days or the balance of the original warranty period, whichever is longer.
Component Warranty. Contractor warrants that each and all of the WTGs, including each and all parts of the Associated Equipment, foundation design and any other part of the deliveries, services or other obligations of the Contractor under the Agreement are fit for purpose and shall be subject to a general warranty for a period of five (5) years from the date of the Taking-Over Certificate. Contractor shall remedy - at the Contractor’s own risks and expenses – any de- fects in the WTGs, including each and all parts of the Associated Equipment, foundation design (including foundation defects resulting from the defective de- sign) and any other part of the deliveries, services or other obligations of the Con- tractor under the Agreement without undue delay after notification of such defect to the Contractor, provided such notification has been made before expiry of the warranty period. Unless otherwise stated in the Agreement, Contractor must perform the remedy- ing of defects at the Site. Contractor may, however, remove defective parts from the Site provided that Contractor replaces the relevant part at the same time. The Contractor shall be liable for defects in parts of the WTG’s which have been repaired or replaced under the above warranty for a period of two (2) years under the terms and conditions which apply to the original delivery, or until the end of the warranty period applicable for the rest of the WTG’s, whichever is the longer. If the Contractor fails to fulfil his obligations to remedy defects within a reasona- ble time, the Employer may by written notice require the Contractor to do so within a final time limit. If the Contractor fails to fulfil his obligations within that time limit, the Employer may choose to a) have the necessary remedial work car- ried out and/or have new parts manufactured at the Contractor’s risk and expense, provided that the Employer acts in a reasonable manner, or b) demand a reduction of the Contract Price. If the defect must be considered substantial, the Employer may instead choose to terminate the Agreement by written notice to the Contractor. The Employer shall also be entitled to such termination where the defect remains substantial after such measures have been taken as referred to in a).

Component Warranty. Lessor, or its designated agents, shall repair or replace the Equipment with identical or similar Equipment if the Equipment fails to operate in accordance with the manufacturer’s specifications and operation instructions. Lessor shall be responsible for de-installing and returning all non-conforming Equipment at its expense and risk of loss to the manufacturer. The limited warranty above does not apply where the Equipment has been subjected to abuse, misuse, neglect, negligence, accident, improper testing, improper installation, improper storage, improper handling, abnormal physical stress, abnormal environmental conditions, or use contrary to any instructions issued by Lessor, or used with any Third-Party Product, hardware, software, or product that has not been previously approved in writing by Lessor. Lessor will not sell or transfer any warranty obligations under this Lease to a third-party.
Component Warranty. This Warranty covers visible chips, scratches and dents for sixty (60) days from the installation date of the Product by the original purchaser. Cosmetic components include stainless steel and painted doors, handles, and surfaces. E xceptions. The replacement of a part or Product under this Warranty does not extend the Warranty period. None of these Warranty periods continues if the Product is removed from the location where it was originally installed. Warranty service in areas beyond a 30 mile radius from an authorized BlueStar® retailer or service provider may require certain costs to the consumer. W hat Problems Does this Warranty Not Cover? This Warranty does not cover, and specifically excludes:  Damage caused by shipping.  Normal adjustments after installation and setup.  Normal wear, care, and maintenance of the Product as described in the Use and Care Guide.  Replacement water filters.  Damage or repairs caused by alterations or modifications, abuse, misuse, neglect, or improper installation, mounting, handling, operation, maintenance or storage.  Accidental or intentional damage.  Damage or repairs caused by unauthorized service or repairs, including unauthorized adjustments or calibrations performed on the Product.  Damage or repairs as a result of natural disasters, fires, floods, earthquakes, winds, lightning, corrosive atmosphere, loss of electrical power to the Product for any reason, or other conditions beyond Xxxxxx-Xxxxxxx’x control.  Damage or repairs caused by alteration for outdoor use.  Damage or repairs caused by the use of harsh chemicals or cleaning products improperly applied.
Component Warranty. Contractor warrants that for any software or deliverable (“Component”) provided under the contract, the applicable warranty period shall be the period from written acceptance of the Component until final acceptance of the solution.
