DESIGN BUILD ENTITY’S FEE. The Design-Build Entity's Fee is included in the Contract Price. However, the Design-Build Entity's Fee of fifteen percent (15%) can be applied to the direct cost of the construction in the event of contingency work and approved change orders. Design-Build Entity will not be entitled to Design-Build Entity's Fee for work necessitated by its own substandard workmanship, errors or omissions.

DESIGN BUILD ENTITY’S FEE. Subject to the provisions of this Agreement and of the General Conditions of the Design/Build Guaranteed Maximum Price Agreement (SC-9.1), and in consideration of the performance of this Agreement, the Principal Representative shall pay the Design/Build Entity in current funds as compensation for its services as listed below: The Design/Build Entity’s Fee shall include all job indirect costs, and General Conditions costs as defined in Exhibit A, Design/Build Entity Designated Services and Method of Payment, home office overhead, and profit, included but not limited to the following: Salaries or other compensation of the Design/Build Entity’s employees at the principal office and branch offices; General operating expenses of the Design/Build Entity's principal and branch offices other than the field office; Any part of the Design/Build Entity's capital expenses, including interest on the Design/Build Entity 's capital employed for the Project; Overhead or general expenses of any kind; Salaries of the Design/Build Entity’s employees engaged on the road in expediting the production or transportation of materials and equipment; Cost of all employee benefits and taxes for such items as unemployment compensation and social security, insofar as such cost is based on wages, salaries or other remuneration paid to employees of the Design/Build Entity and included in the fee under paragraphs 6.1.2.a through 6.1.2.e; All transportation, traveling, moving, and hotel expenses of the Design/Build Entity or its officers or employees incurred in discharge of duties connected with the Work; Costs, including transportation and maintenance, of all materials, supplies, equipment, temporary facilities, and hand tools not owned by the workmen, which are employed or consumed in the performance of the Work; Cost of the premium for all insurance which the Design/Build Entity is required to procure by this Agreement or is deemed necessary by the Design/Build Entity; Minor expenses such as facsimile messages, telegrams, long distance telephone call telephone service at the site, express mail, and similar xxxxx cash items in connection with the Work; All other items set forth in Exhibit A, Design/Build Entity Designated Services and Method of Payment that are specifically designated as Pre-Construction Services Fee, Construction Services Fee or General Conditions.   • Notice to Proceed - Site Improvements The Recipient shall not commence, or cause to be commenced, any site improvements or other work on the Land until the Director has issued a Notice to Proceed to the Recipient. Such Notice to Proceed will not be issued until the Director is assured that the Recipient has complied with all requirements for the approval of a grant under Revised Code Sections 164.20 through 164.27 and has completed any land acquisition required by the Project. A Notice to Proceed shall be required for all Project prime contractors or direct procurement initiated by the Recipient following execution of this Agreement.

  • Verizon OSS Facilities Any gateways, interfaces, databases, facilities, equipment, software, or systems, used by Verizon to provide Verizon OSS Services to ICG.

  • System Upgrade Facilities and System Deliverability Upgrades Connecting Transmission Owner shall design, procure, construct, install, and own the System Upgrade Facilities and System Deliverability Upgrades described in Appendix A hereto. The responsibility of the Developer for costs related to System Upgrade Facilities and System Deliverability Upgrades shall be determined in accordance with the provisions of Attachment S to the NYISO OATT.

Such studies, design and construction shall be based on the assumed accuracy and completeness of all technical information received by the Participating TO and the CAISO from the Interconnection Customer associated with interconnecting the Large Generating Facility.

  • ESTIMATED / SPECIFIC QUANTITY CONTRACTS Estimated quantity contracts, also referred to as indefinite delivery / indefinite quantity contracts, are expressly agreed and understood to be made for only the quantities, if any, actually ordered during the Contract term. No guarantee of any quantity is implied or given. With respect to any specific quantity stated in the contract, the Commissioner reserves the right after award to order up to 20% more or less (rounded to the next highest whole number) than the specific quantities called for in the Contract. Notwithstanding the foregoing, the Commissioner may purchase greater or lesser percentages of Contract quantities should the Commissioner and Contractor so agree. Such agreement may include an equitable price adjustment.

  • Contractor’s Equipment Payment for required equipment owned by the Construction Manager or an affiliate of the Construction Manager will be based solely on an hourly rate derived by dividing the current appropriate monthly rate by 176 hours. No payment will be made under any circumstances for repair costs, freight and transportation charges, fuel, lubricants, insurance, any other costs and expenses, or overhead and profit. Payment for such equipment made idle by delays attributable to the Government will be based on one-half the derived hourly rate under this subsection.

  • Title to Project Deliverables Contractor acknowledges that it is commissioned by the Authorized User to perform the services detailed in the Purchase Order. Unless otherwise specified in writing in the Bid or Purchase Order, the Authorized User shall have ownership and license rights as follows:
