Dispatch Rules. On-Call Supervisors (excluding Retired On-Calls) will be offered seasonal and temporary year around openings by their supervisory seniority. Should the most senior On- Call Supervisor refuse the assignment, the position will be offered to the next most senior, and so forth until the list is exhausted. After the list is exhausted, the opening will then be assigned to the most senior On-Call Supervisor. Should the most senior On-Call Supervisor again refuse the assignment, he/she shall lose all seniority as a supervisor and will be dropped from the supervisor’s list.
Dispatch Rules. Drivers who have been laid over in foreign terminals shall be dispatched in accordance with the following rules:
1) drivers who are available for duty will be given preference on return dispatches to their home terminals;
2) when two (2) or more drivers from the same home terminal are available for duty, they will be dispatched in accordance with their highway seniority;
3) when two (2) or more drivers from different home terminals are in a foreign terminal and available for duty, they will be dispatched in accordance with their highway seniority. Section Drivers Not Laid Over For drivers who have not been laid over and are available for dispatch, Section (e), paragraphs (2) and (3) will apply. Section Priority to Terminal Drivers Where there are bid runs out of a terminal, foreign terminal drivers may be held until bid run drivers have been dispatched, provided there are loads available. Section No Layovers Sundays General Holidays No driver will be held over away from his home terminal on a General Holiday or on a Sunday unless by mutual consent.

Employees and brokers who have been laid over out of town shall be dispatched so that when two (2) or more employees and brokers from the same home are available for duty, they will be dispatched in accordance with their seniority. No broker shall be held over away from home on a General Holiday or on a Sunday, unless by mutual consent.
Dispatch Rules. All Owner Operators shall be dispatched according to agreed upon local dispatch rules, which will be posted. Failure of the Company and Unionto agree on such dispatch rules, such rules shall then be referred to the grievance procedure.

Section Rules and Regulations For Highway Operations Having regard for the differing operational conditions that may exist from one area to another, the Company and the Union or Unions may institute Rules and Regulations that are mutually agreed upon. Such Rules and Regulations must be reduced to writing and signed by the parties. In the event of any dispute concerning such Rules and Regulations, either party to this Agreement reserves the right to rely on the terms of this Agreement which shall govern. Section No casual employees will be dispatched on highway operations unless the Company has exhausted all other employees, highway, city, dock and maintenance in this order, who are qualified and available.
a) No casual employee will be used to replace a regular dock employee at any Company Casual drivers may only be dispatched on highway operations during the period between A.M. Friday to A.M. Sunday. Casual drivers used to supplement the highway operations will not enjoy preference over regular employees on highway operations for any dispatch except a dispatch to their point of origin. A casual driver will not enjoy preference for such return dispatches over a regular employee from the same point of origin. Where practical on Friday nights, loads which can be reasonably held will not be dispatched, but will be held for regular employees available up to A.M. All such differences must be noted and agreed to by both company and union and posted. All dispatches will be offered by seniority at the start of each week which may be Sunday or Monday. Where it is possible, Sunday night dispatches should be made to the owner-operator on Saturday. All for the balance of the week will be offered on a first out basis. All loads dispatched on a Saturday shall be offered by seniority providing the owner-operator is available. For the balance of the week, all loads will be dispatched in accordance with the daily seniority (first in, first out) and in accordance with the priority of the load. Dispatches will not be held or hidden for the purpose of denying the senior men their seniority. When an owner-operator does not finish on a Friday in his home terminal, the company cannot force dispatch him on a load unless this load returns him to his home terminal or unless the load covers a minimum distance of miles, failing which, the operator may go home on his own and at his expense and report himself available for dispatch in Sunday night at his home terminal. c) On Friday and Saturday, any owner-operator and the individual in Canada who wishes to return to his home terminal, the company shall have the right to dispatch him ahead of the owner-operator or an individual who are available but are at their home terminal. These owner-operators or these individuals will be dispatched in accordance with the availability of loads to their home terminal, and in accordance with their
d) Owner-operators and individuals will be considered available only if they meet the following requirements:
1) If they have delivered their load or have been relieved from delivering their load by the dispatcher.
2) If they have not advised their dispatcher that they were booking off duty for rest period.
3) If they have not advised their dispatcher that they were booking off duty for maintenance.
4) If they have advised their dispatcher of the day and time they are available.
e) No information on loads available will be communicated to an owner-operator or an individual until he is available and has confirmed the day and time of his availability. When an owner-operator or an individual makes himself available and has been assigned a load, he will not have the right to refuse it or to change his availability.
f) The company reserves the right to reposition any US owner-operator when required to move a US load provided that the owner-operator or the individual will pick up his re-load for the US within the normal time frame.
Dispatch Rules. Dispatch Rules will not supersede the Collective Bargaining Agreement.
