Casual Drivers. Any new casual driver will be hired as a Jewel Employee.
Casual Drivers. (i) Regular drivers who perform an A.M. and P.M. run regularly during the school year.
(ii) Spare drivers who are waiting for an A.M. and P.M. school run to become open. Spare drivers shall accumulate seniority and shall accept an open run when one becomes available, provided it does not create deadhead mileage or there is another spare driver available in the geographical area. Spare drivers shall be permitted to perform public charters, provided the driver signed the charter sign up lists and will be assigned the charter on the basis of seniority in rotation. Spare drivers shall be offered in seniority order, to fill school runs that are temporarily vacant or vacant due to the absence of an employee. This includes school charters from the school served, provided the employee has the seniority. Spare drivers shall be offered work in the case of an emergency, in which case seniority will not apply.
(iii) Casual drivers who are not waiting for an A.M. and P.M. school run to become open. Casual drivers shall not accumulate seniority. Casual drivers will not normally work on a paid holiday, P.A. day, except in the case of non-availability of other drivers or in the case of an emergency. A casual driver shall cover an open route until such time as a part time or spare driver is available. A casual driver will not normally perform a name request charter, however this may be waived in the case of the charter customer not being prepared to provide the business to the Company if the name request is not honoured. Casual drivers shall be assigned any driving duties for charters in the instance of the non availability of spare drivers, emergencies or when other conditions exist does not allow the Company to offer work in seniority order and meet the time or other requirements of the specific work situation.
Casual Drivers. Clauses 33.1 to 33.3 apply to drivers who are a casual employee.
Casual Drivers. A Casual Driver will be defined as a driver who, whenever possible, will be by seniority on a basis, as required, after making themselves available for work but, will not be used when regular or part-time drivers are available and want the work. Dispatchers or Safety Supervisors will only be used in the case of an emergency,
Casual Drivers. A casual driver may be terminated at any time without notice. Permanent drivers: A permanent driver may be terminated upon being given one weeks’ notice or payment in lieu thereof.
Casual Drivers. (a) A casual driver will be defined as a driver who, whenever possible, will be called out on a per-trip basis, as required, after making themselves available for work.
(b) These drivers will not be required to be members of the Union, however will pay Union dues established by the Union.
(c) casual drivers will not be used when regular or spare drivers are available to do the required trips.
Casual Drivers. Casual drivers, meaning drivers who have no guaranteed hours of duty and are used on an as required basis, will be paid at the composite hourly rate. For all hours worked, to a maximum of thirty eight (38) in a week, a casual loading of 25% in lieu of recreation and personal leave accrual will apply. The minimum engagement of a casual employee on any day will not be less than four hours. All hour worked in excess of thirty eight (38) in a week will be paid single time overtime at the composite hourly rate. Conversion of casual employment (for other than irregular casuals) A casual employee, other than an irregular casual employee as defined in Clause 32.5.11 of this Schedule, who has been engaged by ACTION for a sequence of periods of employment under this Agreement during a period of twelve months shall thereafter have the right to elect to have his or her contract of employment converted to permanent employment if the employment is to continue beyond the conversion process. An employer of such an employee shall give the employee notice in writing of the provisions of this clause (i.e. Clause 32.5) within four weeks of the employee having attained such period of twelve months. The employee retains his or her right of election under this clause even if the employer fails to comply with Sub-clause 32.5.2 of this Schedule. A casual employee who does not, within four weeks of receiving written notice, elect to convert his or her contract of employment to a full-time employment or a part-time employment will be deemed to have elected against any such conversion. Any casual employee who has a right to elect to have his or her contract of employment converted to permanent employment, upon receiving a notice of the provisions of this clause or after the expiry of the time for giving such notice, may give four weeks writing in notice to the employer that he or she seeks to elect to convert his or her contract of employment to permanent employment, and within four weeks of receiving such notice the employer shall either consent or refuse the election but shall not unreasonably so refuse. Any dispute about a refusal of an election to convert a contract of employment shall be dealt with as far as is practicable with expedition through the dispute settlement procedure. Casual Drivers. A casual driver will be classed as a driver who is not available for either a regular A.M. and P.M. school run, based on a regular school year. A separate seniority list for casual drivers will be maintained and accumulated seniority will apply to that list only. The company will first allocate work to regular drivers, keeping in mind the least financial impact to the company prior to using casuals. A Casual wishing to become a regular driver will go to the bottom of the regular driver’s seniority list.
Casual Drivers. An employee transferred or promoted to a position outside the bargaining unit shall retain and continue to accumulate his/her seniority for a period of three (3) months from the first day of transfer. Such employees shall have the right to return to a position in the bargaining unit consistent with his seniority within the three (3) month period providing there is a vacancy. It is clearly understood that such employee shall have no bumping rights. An employee returning to the bargaining unit under this provision must within five (5) working days of his decision to return, notify the Company and the Union in writing of his intent to return. An employee remaining outside the bargaining unit longer than three (3) months shall relinquish all accumulated seniority and shall be removed from the seniority list. This clause does not apply if the person is dismissed for cause during this period.
Casual Drivers paid hours
(a) Where circumstances outside of Greyhound’s control prevent a casual Driver from commencing or returning from a scheduled service, stand down provisions under clause 23.2 of this Agreement will apply.
(b) Where a casual Driver is unable to return from a scheduled service, which has been cancelled, payment will be made equivalent to what the Driver would be provided if they had an entitlement under clause 23.3.
(c) For the avoidance of doubt this does not include any entitlement to accrue Annual leave.
