Duties of the Customer. The Customer guarantees that neither the domain applied for nor the contents to be placed on a corresponding website violate any third-party rights (e.g., trademark, name-use rights and copyrights), statutory bans of an European Union member state or generally-accepted moral precepts; in particular the Customer will not place any pornographic content, offers for gambling or contents that support or glorify terrorism or Nazism on the website reachable under the domain name. The Customer shall post an imprint (Acknowledgement Notice) on the website which meets the requirements of the European Commission’s Directive 98/34/EC, OJ L 204 of 21.6.1998, p. 37, in the version of the Directive 98/48/EC, OJ L 217 of 5.8.1998, p. 18. The Customer will inform the Trustee immediately and in writing by mail or fax and email on all events relevant to the registration of the domain name, in particular any change of the Beneficiary or initiation of legal proceedings or if the customer is threatened with legal action or if legal action is taken against the Customer. If the customer changes the registrant of the domain name may not facilitate the service of the Trustee. In that case the Trustee Agreement ends automatically without any further announcement to the customer. The Trustee Agreement shall not have the right to assign the rights and obligations rising from this contract to a third party without written consent of the Trustee. The Customer agrees to reply in detail to all inquiries of the Trustee with respect to the domain registration by mail or fax and email immediately, at the latest within 24 hours. This time period will be further limited if a third party (claimant, court, etc.) effectively sets a shorter time limit. The Customer is responsible for keeping his contact data up-to-date with the registrar at all times and authorizes the registrar to make contact data available to the Trustee. If the Customer cannot be contacted via the contact information provided by him or if he does not reply to an inquiry of the Trustee within the time limit granted to him, the Trustee will be entitled to take all necessary decisions, in particular to delete the domain name or stopping it from resolving because of actual or alleged violations of the law or to place the domain under the administration of the registry. Duties of the Customer. In order to comply with the GDPR, the CUSTOMER shall in particular ensure the lawfulness of the transmission of data of the CUSTOMER and / or its AFFILIATED COMPANIES to ATOSS as the case may be, the lawfulness of the processing of personal data in the context of the use of the ATOSS PRODUCTS as well as the protection of the rights of the data subjects whose data are processed in the context of the use of the ATOSS PRODUCTS.
Duties of the Customer. The Customer shall during the continuance of the Contract:- 7.1. ensure that the Equipment is only operated in accordance with the instructions for its use and by an appropriately trained person; 7.2. indemnify BZR against all fines, penalties and liabilities imposed on BZR or arising in respect of any non-compliance or contravention of law or regulation applying to the operation and use of the Equipment (including, without limitation, all laws and regulations relating to food hygiene) by the Customer or any employee, officer or agent of the Customer, together with any costs or expenses relating thereto incurred by BZR; 7.3. not take or allow the Equipment to be taken from the Customer’s premises stated in the Schedule,or move the Equipment from the position from which it is installed by BZR, without receiving The prior written authority of BZR; 7.4. bear the cost of the repair or rectification of any damage to the Equipment resulting from negligence or improper use of the Equipment by the Customer or any employee, officer or agent of it or which is accidentally or willfully damaged by any other person present on the Company’s premises (other than an employee, officer or agent of BZR ); 7.5. not sell, assign, mortgage, let or hire or otherwise dispose of or part possession of the Equipment for any part thereof; 7.6. take all necessary steps as an expense to retain and recover possession and control of the Equipment of which the Customer loses possession or control; 7.7. permit BZR or its authorised representatives at all reasonable times to enter upon the premises where the Equipment may from time to time be kept, to inspect and test the condition of the same; 7.8. in respect of the condition and maintenance of the Equipment, be solely responsible at its own cost for:- 7.8.1. regularly cleaning and maintaining the Equipment in accordance with the instructions given by BZR to the Customer pursuant to clause 5.3; 7.8.2. keeping accurate records of the maintenance and cleaning of the Equipment; 7.8.3. promptly informing BZR of any damage to the Equipment or any malfunction or breakdown in its operation; 7.8.4. promptly informing BZR of the theft or loss of possession of the Equipment. 7.9. not use or operate or permit the Equipment to be used or operated in a manner contrary to any statutory provision or regulation or in any way contrary to law having regard in particular (but without prejudice to the generality of the foregoing) to the regulations effecting ...
Duties of the Customer. 4.1 You shall at all times: 4.1.1 notify us immediately of any fault in the Equipment and/or repair necessary and promptly provide us with any information which we reasonably require to enable us to proceed without interruption with the performance of this Agreement. 4.1.2 Afford our staff and our other authorised personnel full and safe access to the Installation Address and the Equipment to enable us to carry out the Maintenance Services. 4.1.3 Provide us with, and be responsible for, the safety of such adequate free working space and facilities as may be necessary for the performance of the Agreement. 4.1.4 Comply with all statutory requirements (including those relating to health and safety) which apply to the Maintenance Services and institute safe systems of work at the Installation Address. 4.1.5 Promptly inform us about any facts or opinions of which you become aware which are likely to affect our obligations under this Agreement. 4.1.6 Keep the Equipment at the Installation Address. 4.1.7 Except as provided in clause 2.2 not to yourself maintain, service, repair, adjust, tamper, replace, alter or move the Equipment or the extension wiring. 4.1.8 Re-invoice to your network provider any abortive call invoices raised by MBSC when appropriate.
