EQUAL EMPLOYMENT OPPORTUNITY AND NON-DISCRIMINATION. Section 1 It is the policy of the University not to discriminate on the basis of race, color, national or ethnic origin, age, religion, disability, sex, sexual orientation, gender identity and/or expression, genetic information, military or veteran status (special disabled veterans, disabled veterans and Vietnam-era veterans), or any other characteristic protected under applicable federal, state or local law. It is also a violation of University policy to retaliate against any individual for filing a complaint of discrimination or for cooperating in an investigation of alleged discrimination (protected activity). EQUAL EMPLOYMENT OPPORTUNITY AND NON-DISCRIMINATION. Subcontractor shall comply with the Civil Rights Act of 1964, as amended, which prohibits employment discrimination on the basis of race, color, religion, sex or national origin and the DC Human Rights Act of 1977, as amended, which prohibits discrimination in any manner against any employee or applicant for employment on the basis of 21 protected traits for individuals that live, visit or work in the District of Columbia. Subcontractor agrees to: (a) permit access to its books, records and accounts pertaining to its employment practices to VEIC, DOEE, the District of Columbia’s Chief Procurement Office or designee, and/or the District of Columbia’s Director of Human Rights or designee, for purposes of investigation to ascertain compliance with this Section and (b) post and keep posted in a conspicuous location where business or activity is customarily conducted or negotiated, a notice whose language and form has been prepared by the DC Office of Human Rights, setting forth excerpts from or summaries of, the pertinent provisions of the DC Human Rights Act and information pertinent to the filing of a complaint.

EQUAL EMPLOYMENT OPPORTUNITY AND NON-DISCRIMINATION. During the performance of this Participation Agreement, PCG agrees as follows: A. PCG will not discriminate against any employee or applicant for employment because of race, color, religious creed, gender, marital status, age, sexual orientation, national origin, veteran status, disabling condition, or any other protected status. Such equal-opportunity and non- discriminatory actions shall include, but not be limited to, the following: recruitment, hiring, training, promotion, compensation, benefits, transfers, layoffs, return from layoffs, and company-sponsored training, education, and social/recreational programs. PCG agrees to post in conspicuous places, available to employees and applicants for employment, notices setting forth the provisions of this non-discrimination clause. B. PCG will, in all solicitations, or advertisements for employees placed by or on behalf of PCG, state that all qualified applicants will receive consideration for employment without regard to race, color, religious creed, gender, marital status, age, sexual orientation, national origin, veteran status, disabling condition, or any other protected status.

The Parties support the University’s commitment to an integrated, diverse and inclusive workforce, and will cooperate in the implementation of the University’s Affirmative Action Policy. 23.3. The Union acknowledges that, like other University employees, faculty covered by this Agreement are subject to University policies prohibiting discrimination and harassment, as referenced in this Article. 23.4. The University shall not discriminate against any faculty on the basis of Union membership status or Union activity. 23.5. Faculty members who believe they have been subjected to unlawful discrimination, harassment or retaliation, are encouraged to report their concerns using the complaint procedure described in the University’s Affirmative Action and Equal Opportunity Policy. Alleged violations of that policy may be challenged through the policy’s Discrimination Complaint Procedure, or through provisions of applicable law, but will not be subject to the Grievance Procedure in Article 16.
