B. SUBCONTRACTOR shall comply with the provisions of the Fair Employment and Housing Act (Gov. Code, §§12900 et seq.) and the applicable regulations promulgated thereunder (Cal. Code Regs., tit. 2, §§7285 et seq.). The applicable regulations of the Fair Employment and Housing Commission implementing Government Code §12990 (a-f), set forth in chapter 5 of division 4 of title 2 of the California Code of Regulations are incorporated into this Agreement by reference and made a part hereof as if set forth in full.
C. SUBCONTRACTOR shall also comply with the provisions of Government Code §§11135- 11139.8, and the regulations promulgated thereunder by the Board of Governors of the California Community Colleges (Cal. Code of Regulations, title 5, §§59300 et seq.)

The Company and Union agree not to discriminate against an Employee because of the exercise of the rights granted by Section 7 of the National Labor Relations Act, as amended.

ADVERTISING PROVIDER will use its reasonable best efforts to utilize local consultants, contractors and subcontractors in the construction, maintenance and operation of the Project ADVERTISING PROVIDER shall submit information concerning the ownership and work force composition of ADVERTISING PROVIDER as well as its consultants, subconsultants, contractors, subcontractors and suppliers, in a form as reasonably required by CITY. This information or data shall be used for statistical purposes only. All contractors and consultants are required to provide data regarding the make-up of their subcontractors, subconsultants and agents who will perform CITY contracts, including the race and gender of each employee and his or her job title or function and the methodology used by ADVERTISING PROVIDER to hire and/or contract with the individual or entity in question. The CITY will track ADVERTISING PROVIDER's MBE/WBE utilization to ensure the absence of unlawful discrimination on the basis of race, ethnicity, national origin, gender, religion, sexual orientation, or disability, and make reports quarterly, or as more frequently requested, to CITY. ADVERTISING PROVIDER acknowledges that in the recruitment, hiring, and retention of employees, contractors, or subcontractors, CITY requires nondiscriminatory and equal outreach efforts which include outreach to minorities and women as well as other segments of the City of Anaheim business community. ADVERTISING PROVIDER shall not discriminate in any way against any employee or applicant for employment in connection with the Advertising Structures or the use of the Property or Designated Areas on the basis of race, color, religion, sex, sexual preference, marital status, AIDS or AIDS-related complex, disability, ancestry or national origin, and shall include in its contracts with its contractors, requirements that its contractors and their subcontractors, joint ventures, successors, and assigns shall not so discriminate.
