Exempt Position. The Employee is designated as an FLSA Executive Exempt employee and, subject to the City Manager’s approval, is permitted to design a flexible work schedule as may be warranted to accomplish the continuing objectives of the City, subject to the restriction on hours of work set forth in Section 2.4 of this Agreement. The position of City Clerk/Assistant to the City Manager is also exempt from the provisions of the Washington State Minimum Wage Act.
Exempt Position. This is an exempt position under applicable state and federal laws. Employee may perform her duties under this Agreement either at the executive offices of the Company in Los Angeles California, or if requested, she may perform her duties under this Agreement one day per week from her home in Los Angeles, California.
Exempt Position. The position of General Manager is an exempt position for purposes of the Fair Labor Standards Act of 1938 (29 U.S.C. § 201 et seq.). The general business hours for District employees are Monday through Friday, 7:45 a.m. to 4:30 p.m. This full-time employment will typically average forty (40) hours of work per week. Employee's typical working hours will be during regular business hours, plus evening hours as needed to attend Board meetings
Exempt Position. The Superintendent understands that while "regular" business hours for the central office are from 7:30 a.m. - 4:00 p.m., the position of Superintendent is one of considerable responsibility and requires that The Superintendent work beyond regular central office hours. The Superintendent understands that this is an "exempt" position for purposes of the federal Fair Labor Standards Act and is therefore, not eligible for compensation for "overtime."
Exempt Position. Assignment to, or the awarding of, a position by the Chief of Police outside of seniority. Factors: Wages, hours of employment, fringe benefits and working conditions.
Exempt Position. The performance of duties comparable to the SDS position under this Agreement is exempt from Fair Labor Standards Act (“FSLA”) overtime pay requirements. This temporary employment generally will not exceed 40 hours per week. The Successor Agency will assign Retired Annuitant Employee specific hours to work.
Exempt Position. This is an exempt position under applicable state and federal laws.
Exempt Position. Upon execution of the Release of Liability Agreement, a copy of which is Attachment two (2) of this Agreement, the Chief may appoint from within the bargaining unit, at his sole discretion one (1) position below the rank of Chief. The person so appointed shall serve at the pleasure of the Chief of Police and may be demoted to his previously held rank without cause. No Officer shall be coerced, threatened or otherwise intimidated in an effort to cause him/her to accept the position. The City shall authorize additional staffing positions to avoid such “bumping”; however the City may reduce the extra position later by attrition to the previous au- thorized number of positions.
Exempt Position. Executive’s position is classified as exempt, which means, in part, that Executive’s work for the Company is not subject to the laws related to tracking of daily hours of work, minimum wage, overtime or meal and rest periods (and therefore, Executive will not be eligible for overtime).
