All flying clubs desiring to base their aircraft and operate on the Airport must comply with the applicable provisions of the Rules, Regulations, and these Minimum Standards. However, they shall be exempt from regular fixed base operator requirements upon satisfactory fulfillment of the conditions contained herein.

Flying Clubs. At execution of this Agreement, the Lessee, at its’ own cost, shall have procured and will maintain for the duration of this Lease, insurance as specified in the Minimum Standards, Minimum Scope and Limits of Insurance The Lessee shall furnish the County with certificates of insurance and endorsements required by this Agreement. The County reserves the right to require complete, certified copies of all required insurance policies at any time. -Each insurance policy shall be written on an "occurrence" form unless otherwise approved by the County. -By requiring such minimum insurance coverage, the County shall not be deemed or construed to have assessed the risks that may be applicable to the Lessee under this Lease. The Lessee shall assess its own risks and, if it deems appropriate and/or prudent, maintain greater limits and/or broader coverage. -Nothing contained within these insurance requirements shall be deemed to limit the scope, application and/or limits of the coverage afforded, which coverage will apply to each insured to the full extent provided by the terms and conditions of the policy(s). Nothing contained within this provision shall affect and/or alter the application of any other provision contained within this Lease.
Flying Clubs. A. All flying clubs desiring to base their aircraft and operate on the Airport must comply with the applicable provisions of these Rules and Regulations. However, they shall be exempt from regular Commercial Activity requirements upon satisfactory fulfillment of the conditions contained herein. B. Each club must be a not-for-profit corporation. Each member must be a bona fide member and stockholder in the corporation. The club may not derive greater revenue from the use of its aircraft than the amount necessary for the actual use operation, maintenance, and replacement of its aircraft. The club will file and keep current with the Airport Manager a complete list of the club’s membership and investment share held by each member. At any time that the Airport Manager has reason to believe a club aircraft is being operated and that it falls under the “commercial” classification, he shall notify the club and if they fail to remedy these conditions, they shall be reclassified and must comply with the requirements of any other Commercial Activity. C. The club’s aircraft will not be used by other than bona find members for rental and by no one for commercial operations. Student instruction can be given in club aircraft to club members provided such instruction is given by a lessee based on the Airport who provides flight training or by a certificated instructor who is a member of the flying club which owns the aircraft to be used for instruction and who shall abide with all Federal Aviation Regulations concerning compensation of aircraft club flight instructors and mechanics. D. In the event that the club fails to comply with these conditions, the Airport manager will notify the club in writing of such violations. If the club fails to correct the violations within fifteen (15) days thereafter, the Airport Manager may recommend to the WHITESIDE COUNTY AIRPORT BOARD any action deemed advisable, including cancellation of lease. E. The flying club must furnish satisfactory evidence of insurance indicating Single Limit Aircraft and Comprehensive Airport or Premises Liability Coverage of not less than $100.000/300,000/100,000 for bodily injury and property damage.

A flying club qualifies as an individual under the FAA grant assurances. As such, a flying club has the right to fuel and maintain the aircraft of its members. All flying clubs desiring to base their aircraft and operate on FBMA must comply with the applicable provisions of these standards and requirements. However, they shall be exempt from regular commercial aeronautical operator requirements upon satisfactory fulfillment of the following: 1. Shall lease existing property or lease sufficient land area, as approved by the City, to provide all buildings, aircraft parking, paved ramp area, and parking to accommodate activities and operations proposed. Parking requirements will be in accordance with City code. 2. Such facility shall meet FBMA Architectural and Building Design Standards, NFPA requirements, Florida Building Codes, and all applicable City Building Ordinances including properly sized aircraft apron. Apron shall have tie-down capability for all non-hangared aircraft capable of being tied down. 3. A flying club shall be a non-profit or not-for-profit entity (corporation, association, or partnership) organized for the express purpose of providing its members with one or more aircraft for their personal use and enjoyment only. The lease or ownership of the aircraft(s) must be vested in the name of the flying club, or owned on a pro rata basis by all of its members. The property rights of the members of the flying club shall be equal and no part of the net earnings of the flying club will inure to the benefit of any member in any form, such as salaries, bonuses, etc. The flying club may not derive greater revenue from the use of its aircraft than the amount necessary for the operations, maintenance, and replacement of its aircraft, facilities, and overhead, if any. 4. Flying clubs may not offer or conduct charter and/or air taxi services, or rental of aircraft operations. They may not conduct aircraft flight instruction except for regular members owning the aircraft, and only members of the flying club may operate the aircraft. Inst...
Flying Clubs. Flying club aircraft must be owned and operated on a nonprofit basis or as a nonprofit Colorado corporation, and each club member must be a bona fide owner of a part of the aircraft or a share in the corporation. The club may not derive greater revenue from the use of aircraft than the amount necessary for the operation, maintenance and replacement of the aircraft and will file and keep up‐to‐date with the Airport Manager a list of the membership. If the Airport Manager has reason to believe a club is being operated so that it falls under the "commercial" classification, he or she shall so notify the club. If the club fails to remedy the condition, the Airport Manager shall reclassify the aircraft. Thereafter, the club shall be classified as a commercial operation. The Airport Manager shall have authority to deny the use of a club classification to any group failing to meet the requirements outlined herein.
Flying Clubs. Tenant may not operate a flying club on the Leased Property without the prior written consent of MAC Staff. In the event that Tenant desires to operate a flying club from the Leased Property, Tenant must: (i) Obtain MAC’s prior written consent to operate a flying club and comply with all conditions of such consent and with all applicable rules, regulations and ordinances of MAC, including Ordinance 107; and (ii) Obtain the appropriate license(s) to operate a flying club from all applicable governing authorities, comply with all requirements of such governing authorities, and provide evidence of compliance to MAC upon MAC’s request. 3.3 Appropriate Use Excepting the uses described in this Section 3 [Use of Leased Property], Tenant shall not use or permit the Leased Property to be used in any manner that would void Tenant’s or MAC’s insurance or increase the insurance risk. Tenant shall at all times comply with all legal requirements imposed by the insurers for MAC and Tenant; provided, however, that any such requirements imposed by MAC’s insurer must (i) be consistent with the terms of this Lease, (ii) not prohibit or materially adversely affect Xxxxxx’s uses of the Leased Property as authorized by this Section 3 [Use of Leased Property], and (iii) be uniformly imposed and enforced against all similarly situated tenants of the Airport.

  • MORTGAGE LOAN ORIGINATOR EDUCATION 1. Prior to the submission of a new application for any new mortgage loan originator license or, as applicable, the filing of a petition for the reinstatement of an MLO Activity Endorsement in any Participating State as provided for in Section II, Paragraph 2 of this Order, the Respondent will be required to complete the following mortgage loan originator education requirements: a. Twenty hours of NMLS approved PE, which shall consist of 14 hours of federal law curriculum, three hours of ethics curriculum, and three hours of non-traditional mortgage lending curriculum. None of these 20 hours of PE may be state-specific curriculum; and b. Eight hours of CE, which shall consist of four hours of federal law curriculum, two hours of ethics curriculum, and two hours of non-traditional mortgage lending curriculum. None of these eight hours of CE may be state-specific curriculum. 2. Respondent may not take any of the PE or CE provided for in Paragraph 1 of this Section in an online self-study format (“OSS”). 3. For a period three years from the Effective Date of this Order, Respondent shall be required to complete any additional required PE and/or CE in a format other than OSS.

  • Mortgage Loans As of the Closing Date, in consideration of the Issuer's delivery of the Notes and the Ownership Certificate to the Depositor or its designee, and concurrently with the execution and delivery of this Agreement, the Depositor does hereby transfer, assign, set over, deposit with and otherwise convey to the Issuer, without recourse, subject to Section 3.01, in trust, all the right, title and interest of the Depositor in and to the Mortgage Loans. Such conveyance includes, without limitation, the right to all payments of principal and interest received on or with respect to the Mortgage Loans on and after the Cut-off Date (other than payments of principal and interest due on or before such date), and all such payments due after such date but received prior to such date and intended by the related Mortgagors to be applied after such date together with all of the Depositor's right, title and interest in any REO Property and the proceeds thereof, the Depositor's rights under any Insurance Policies related to the Mortgage Loans, the Depositor's security interest in any collateral pledged to secure the Mortgage Loans, including the Mortgaged Properties and any proceeds of the foregoing, to have and to hold, in trust; and the Indenture Trustee declares that, subject to the review provided for in Section 2.02, it has received and shall hold the Trust Estate, as Indenture Trustee, in trust, for the benefit and use of the Noteholders and for the purposes and subject to the terms and conditions set forth in this Agreement, and, concurrently with such receipt, the Issuer has issued and delivered the Notes and the Ownership Certificate to or upon the order of the Depositor, in exchange for the Mortgage Loans and the other property of the Trust Estate. Concurrently with the execution and delivery of this Agreement, the Depositor does hereby assign to the Issuer all of its rights and interest under the Mortgage Loan Purchase Agreement but without delegation of any of its obligations thereunder.   • Servicing Certificate Not later than each Determination Date, the Master Servicer shall deliver (a) to the Indenture Trustee, the data necessary to prepare the items below and the statement for Noteholders required to be prepared pursuant to Section 4.04 and (b) to the Indenture Trustee, the Owner Trustee, the Sponsor, the Depositor, the Paying Agent, the Credit Enhancer, and each Rating Agency a Servicing Certificate (in written form or the form of computer readable media or such other form as may be agreed to by the Indenture Trustee and the Master Servicer), together with an Officer's Certificate to the effect that the Servicing Certificate is correct in all material respects, stating the related Collection Period, Payment Date, the series number of the Notes, the date of this Agreement, and: (i) the aggregate amount of collections received on the Mortgage Loans by the Determination Date for the related Collection Period; (ii) the aggregate amount of (a) Interest Collections and (b) Principal Collections for the related Collection Period; (iii) the Investor Floating Allocation Percentage and the Investor Fixed Allocation Percentage for the related Collection Period; (iv) the Investor Interest Collections and Investor Principal Collections for the related Collection Period; (v) the Interest Collections that are not Investor Interest Collections and Transferor Principal Collections for the related Collection Period; (vi) the Note Interest and the applicable Note Rate for the Notes for the related Interest Period; (vii) the amount of the Note Interest that is not payable to the Noteholders because of insufficient Investor Interest Collections; (xxxv) the aggregate of all Liquidation Loss Amounts on the Mortgage Loans since the Cut-off Date and whether a Cumulative Loss Test Violation has occurred since the prior Determination Date; (xxxvi) the Rolling Six Month Delinquency Rate, the Spread Rate, the Excess Spread Percentage, and the Rolling Three Month Excess Spread Percentage for the Payment Date; and (xxxvii) in the Servicing Certificates for the first and second Payment Dates, the number and Cut-off Date Asset Balance of Mortgage Loans for which the Mortgage Loan File was not delivered to the Indenture Trustee within 30 days of the Closing Date. The Indenture Trustee and the Owner Trustee shall conclusively rely upon the information contained in a Servicing Certificate for purposes of making distributions pursuant to Section 8.03 of the Indenture or distributions on the Transferor Certificates, shall have no duty to inquire into this information and shall have no liability in so relying. The format and content of the Servicing Certificate may be modified by the mutual agreement of the Master Servicer, the Indenture Trustee and the Credit Enhancer. The Master Servicer shall give notice of any changes to the Rating Agencies.

  • Custodial Services The charges and expenses of the custodian appointed by the Trust for custodial services;

  • Lost Shareholder Due Diligence Searches and Servicing The Trust hereby acknowledges that USBFS has an arrangement with an outside vendor to conduct lost shareholder searches required by Rule 17Ad-17 under the Securities Exchange Act of 1934, as amended. Costs associated with such searches will be passed through to the Trust as an out-of-pocket expense in accordance with the fee schedule set forth in Exhibit C hereto. If a shareholder remains lost and the shareholder’s account unresolved after completion of the mandatory Rule 17Ad-17 search, the Trust hereby authorizes vendor to enter, at its discretion, into fee sharing arrangements with the lost shareholder (or such lost shareholder’s representative or executor) to conduct a more in-depth search in order to locate the lost shareholder before the shareholder’s assets escheat to the applicable state. The Trust hereby acknowledges that USBFS is not a party to these arrangements and does not receive any revenue sharing or other fees relating to these arrangements. Furthermore, the Trust hereby acknowledges that vendor may receive up to 35% of the lost shareholder’s assets as compensation for its efforts in locating the lost shareholder.

  • Special Services Should the Trust have occasion to request the Adviser to perform services not herein contemplated or to request the Adviser to arrange for the services of others, the Adviser will act for the Trust on behalf of the Fund upon request to the best of its ability, with compensation for the Adviser's services to be agreed upon with respect to each such occasion as it arises.

  • STUDENT TUITION RECOVERY FUND “The State of California established the Student Tuition Recovery Fund (STRF) to relieve or mitigate economic loss suffered by a student in an educational program at a qualifying institution, who is or was a California resident while enrolled, or was enrolled in a residency program, if the student enrolled in the institution, prepaid tuition, and suffered an economic loss. Unless relieved of the obligation to do so, you must pay the state-imposed assessment for the STRF, or it must be paid on your behalf, if you are a student in an educational program, who is a California resident, or are enrolled in a residency program, and prepay all or part of your tuition. You are not eligible for protection from the STRF, and you are not required to pay the STRF assessment, if you are not a California resident, or are not enrolled in a residency program.”
