Formal Options. A. Employees will be laid off in accordance with Section 31.3, Basis for Layoff. Formal options, if any, are based on seniority, as defined in Article 30, Seniority, among the group of employees with the required skills and abilities for the position as defined in Section 31.8 of this Article. The Agency will determine if the employee possesses the required skills and abilities for the position, using all available information including written skills and abilities submitted by the employee. Employees being laid off will be provided an option to a comparable position in descending order within the layoff unit, as defined in Appendix A and illustrated in the layoff flow chart. For the purposes of this article, project and permanent positions will be considered comparable. Once an option as described in 1 through 3 below is available and offered, no further formal option will be provided.
1. A funded vacant position for which the employee has the skills and abilities, within their current job classification. If there are multiple funded vacancies within the layoff unit, the employee(s) will be afforded a choice according to seniority and the required skills and abilities.
2. A funded filled position held by the least senior employee for which the employee has the skills and abilities, within their current job classification.
3. A funded vacant or filled position held by the least senior employee for which the employee has the skills and abilities, at the same or lower salary range as their current permanent position, within a job classification in which the employee has held permanent status or, at the employee’s written request, to a lower classification within their current job classification series even if the employee has not held permanent status in the lower job classification. Options will be provided in descending order of salary range and one (1) progressively lower level at a time. Vacant positions will be offered prior to filled positions. Part-time employees only have formal options to part-time positions. Full-time employees only have formal options to full-time positions unless the agency receives a written request from the employee within seven (7) calendar days of the date of the at-risk notice that the employee would accept a part-time position as a formal layoff option.
Formal Options. A. Employees with permanent status will be laid off in accordance with seniority, as defined in Article 34, Seniority, and the skills and abilities of the employee. Employees being laid off shall be provided the following options to comparable positions in descending order within the layoff unit:
1. A funded vacant position for which the employee has the skills and abilities, within their current job classification.
2. A funded filled position held by the least senior employee for which the employee has the skills and abilities, within their current job classification.
3. A funded vacant or filled position held by the least senior employee for which the employee has the skills and abilities, at the same or lower salary range as their current permanent position, within a job classification in which the employee has held permanent status, or to a lower classification within their current job classification series for which the employee has the skills and abilities, even if the employee has not held permanent status in the lower job classification. Options will be provided in descending order of salary range and one progressively lower level at a time. Vacant positions will be offered prior to filled positions. Part-time employees only have options to part-time positions. Full-time employees only have options to full-time positions.
B. Employees who are laid off may request to have their name placed on the layoff lists for the job classifications in which they have held permanent status.
C. For employees who have transitioned into the IT Professional Structure on July 1, 2019, layoff options within the layoff unit will be determined as follows:
1. a. A funded vacant position within another job family and level at the same salary range for which the employee has the skills and abilities.
Formal Options.
A. Nurses will be laid off in accordance with seniority, as defined in Article 35, Seniority, and the specialized skills and abilities of the nurse. Nurses being laid off shall be provided the following options to comparable positions in descending order within the layoff unit:
1. A funded vacant position for which the nurse has the specialized skills and abilities, within his or her current job classification.
2. A funded filled position held by the least senior nurse for which the nurse has the specialized skills and abilities, within his or her current job classification.
3. A funded vacant or filled position held by the least senior nurse for which the nurse has the specialized skills and abilities, at the same or lower salary range as the current permanent position, within a job classification in which the nurse has held permanent status.
B. For multi-employee layoffs, more than one (1) nurse may be offered the same funded, vacant or filled position. In this case, the most senior nurse with the skills and abilities who accepts the position will be appointed. Appointments will be made in descending order of seniority of nurses with the skills and abilities of the position(s).
C. Options will be provided in descending order of salary range and one progressively lower level at a time. Vacant positions will be offered prior to filled positions.
Formal Options.
A. Employees will be laid off in accordance with seniority, as defined in Article 35, Seniority, among the group of employees with the required skills and abilities. Skills and abilities for layoff purposes are documented qualifications that have been identified at least three (3) months prior to the layoff and require a reasonable period to acquire, as determined by the Employer. The Employer may require updated information from the employee regarding their current skills and abilities. Employees being laid off will be provided the following options to comparable positions in descending order within the layoff unit:
1. A funded vacant position for which the employee has the skills and abilities, within their current job classification.
2. A funded filled position held by the least senior employee for which the employee has the skills and abilities, within their current job classification.
3. A funded vacant or filled position held by the least senior employee for which the employee has the skills and abilities, at the same or lower salary range as their current permanent position, within a job classification in which the employee has held permanent status.
B. Options will be provided in descending order of salary range and one (1) progressively lower level at a time. Vacant positions will be offered prior to filled positions.
C. If a job classification in which an employee has previously held status has been abolished or revised, a crosswalk to the classification series will be used to identify any layoff option(s). The employee must have the skills and abilities of any identified position.
D. For employees who have transitioned into the IT Professional Structure on July 1, 2019, layoff options within the layoff unit will be determined as follows:
1. a. A funded vacant position within their current permanent job family and level for which the employee has the skills and abilities.
Formal Options.
A. Employees being laid off will be provided the following options to comparable positions within the layoff unit, in descending order, as follows:
1. A funded position, within their current job classification.
2. A funded filled position held by the least senior employee, within their current job classification.
3. A funded vacant or filled position held by the least senior employee, at the same or lower salary range as their current job classification. Options will be provided in descending order of salary range and one (1) progressively lower level at a time. Vacant positions will be offered prior to filled positions.
B. For multi-employee layoffs, more than one (1) employee may be offered the same funded, vacant or filled position. In this case, the most senior employee will be appointed. Appointments will be made in descending order of seniority.
Formal Options.
A. Employees will be laid off in accordance with seniority, as defined in Article 13, Seniority, among the group of employees with the required knowledge, skills or abilities, as defined in Section 11.7, above. Employees being laid off will be provided the following options to positions within the layoff unit, in descending order, as follows:
1. A funded vacant position for which the employee has the knowledge, skills or abilities, within their current range.
2. A funded filled position held by the least senior employee for which the employee has the knowledge, skills or abilities, within their current range.
3. A funded vacant or filled position held by the least senior employee for which the employee has the knowledge, skills or abilities, at the same or lower salary range as their current range. Options will be provided in descending order of salary range and one (1) progressively lower level at a time. Vacant positions will be offered prior to filled positions. Part-time employees only have formal options to the same percentage of part-time positions or greater. Full-time employees only have formal options to full-time positions. Funded filled supervisory positions will not be offered as formal options.
B. For multi-employee layoffs, more than one (1) employee may be offered the same funded, vacant or filled position. In this case, the most senior employee with the knowledge, skills or abilities who accepts the position will be appointed. Appointments will be made in descending order of seniority of employees with the knowledge skills or abilities of the position(s).

A funded vacant or filled position held by the least senior employee for which the employee has the skills and abilities, at the same or lower salary range as his/her current permanent position, within a job classification in which the employee has held permanent status. Options will be provided in descending order of salary range and one (1) progressively lower level at a time. Vacant positions will be offered prior to filled positions.
