Fuel Plan. A five-year Fuel Plan for each Generation Facility shall be submitted to Owner by September 15 of each year. Owner shall approve or disapprove each Fuel Plan within thirty days after submittal. Each Fuel Plan shall describe in reasonable detail plans for procurement and utilization of fuel for the Generation Facility and information on disposal of waste products. A Fuel Plan may cover one or more Generation Facilities.
Fuel Plan. Delivery to Administrative Agent on behalf of the Banks of a plan with respect to fuel setting forth Borrower's good faith assessment of such Initial Project's projected fuel consumption needs and fuel supply and transportation strategy, which plan shall not in any way be construed to modify or limit Borrower's rights and obligations set forth herein, substantially in the form of Exhibit G-10 and otherwise satisfactory in form and substance to the Technical Committee and the Fuel Consultant.
Fuel Plan. The Seller may revise the Fuel Plan at any time with the Buyer’s prior consent, such consent not to be unreasonably withheld, delayed or conditioned. The Seller shall give prompt and due consideration to any revisions to the Fuel Plan that the Buyer may reasonably request.
Fuel Plan. (a) [Reserved].
(b) For each full calendar year during the Term, the Department shall provide Seller a schedule indicating the expected level of Dispatch (Maximum Load, Full Load, Part Load, Minimum Load, or zero) of the Facility during the weekday peak and off-peak, Saturday peak and off-peak and Sunday/Holiday peak and off-peak periods of each month during the calendar year by August 1 prior to the commencement of the following calendar year (“Annual Dispatch Schedule”). By September 1, Seller shall provide to the Department a proposed Fuel Plan for the following calendar year based upon the Annual Dispatch Schedule. In lieu of providing an Annual Dispatch Schedule, the Department may, by written notice to Seller, by August 1 of any calendar year that the Department wishes to act in the role of Fuel Manager for the upcoming calendar year.
(c) The Department shall notify Seller in writing within fifteen (15) Days of the Department’s receipt of a proposed Fuel Plan whether the Department approves of such proposed Fuel Plan. In the event that the Department does not accept a proposed Fuel Plan, Seller may amend such proposed Fuel Plan within seven (7) Days of the Department’s notice of disapproval. If the Department does not accept Seller’s amendments to a proposed Fuel Plan, the Department shall provide Fuel to the Facility for the period covered by the applicable proposed Fuel Plan; in such event, the provisions of Section 6.02, Section 6.03 and Section 6.04 shall not apply and Seller shall be obligated to deliver Net Electrical Output called for in a Dispatch Notice only to the extent that the Department delivers the Fuel necessary to generate such Net Electrical Output. In the event that the Department has rejected a proposed Fuel Plan, has opted to procure Fuel for the Facility but fails to deliver the necessary Fuel to meet the level of Net Electrical Output called for in a Dispatch Notice, Seller shall be excused from performance with respect to that portion of Net Electrical Output called for in such Dispatch Notice for which the Department has failed to deliver Fuel, provided, however, Seller shall be completely excused from performance under such Dispatch Notice if the Department fails to deliver sufficient Fuel to the Facility to operate at least at Minimum Load. Fuel Plan. Delivery to Administrative Agent of a plan prepared by an Affiliate of NRG Energy with respect to fuel, which plan shall (a) set forth Borrower's good faith assessment of the fuel requirements, costs and sources for the relevant Subject Project and (b) be substantially in the form of Exhibit G-11 hereto and otherwise satisfactory in form and substance to the Technical Committee and the Fuel Consultant.
Fuel Plan. By the date set forth in Appendix A, GPC shall prepare and submit to the other Participants for their approval a fuel supply plan covering at least a five-year period for the Units (the "Fuel Plan"). Each Fuel Plan shall describe in reasonable detail each action or contemplated action and payment and the estimated dates thereof relating to the acquisition, transportation, delivery and storage of fossil fuel for the Units, the entitlement (or estimates thereof) of each Participant to the energy generated by each of the Units for each calendar year of the Fuel Plan pursuant to Sections 3(b) hereof, a cash flow analysis of forecasted expenditures and credits for each Participant for each major cost component of the Fuel Plan by year for the period covered by the Fuel Plan, and cash flow by months (or such other period as agreed to by the Participants) for the first three years of each such period. GPC may amend the Fuel Plan from time to time as it deems appropriate and shall deliver to the other Participants such amended Fuel Plan. GPC shall attempt to acquire, transport, deliver and store fuel for the Units in accordance with the Fuel Plan to the extent reasonably practicable; provided, however, that GPC makes no representation, warranty or promise of any kind as to the accuracy of any estimate or forecast or other information contained in any Fuel Plan or that any attempt to acquire, transport, deliver and store fuel for the Units in accordance with the Fuel Plan will be successful, and in no event shall GPC have any liability to any of the other Participants in these regards. Notwithstanding the foregoing provisions of this Section 1(h)(iv) with respect to the information to be provided by GPC and applicable times and dates, the matters set forth in Appendix A attached hereto relating to Fuel Plans, as the same may be revised from time to time by agreement among all of the Participants and GPC as agent for the Participants, shall govern and control any such conflicting or contrary provisions of this Section 1(h)(iv)."
Fuel Plan. The Partnership shall deliver to the Trustee, the Collateral Agent and the Rating Agencies no later than 6 months prior to the earlier of (i) the expiration of the VEPCO Initial Term (if the term of such Power Purchase Agreement is not extended) or the VEPCO Extended Term (if the term of such Power Purchase Agreement is extended), and (ii) the expiration of the Aquila Initial Term (if the term of such Power Purchase Agreement is not extended) or the Aquila Extended Term (if the term of such Power Purchase Agreement is extended), a fuel plan reasonably acceptable to the Independent Engineer and the Market Consultant.
Fuel Plan. Delivery to the Lead Arrangers of plans with respect to fuel for each Initial Project setting forth Borrower's good faith assessment of each of the Initial Projects' projected fuel consumption needs and fuel supply and transportation strategy, which plans shall not in any way be construed to modify or limit Borrower's rights and obligations set forth herein, substantially in the form of Appendices G-9A through G-9D.
Fuel Plan. Receipt of the Fuel Plan, in form and substance reasonably satisfactory to the Arrangers.
Fuel Plan. A ten (10) year Fuel Plan for Plant Hatch, the Existing Units and the Additional Units shall be submitted to the Nuclear Managing Board by September 15 of each year. Each Fuel Plan shall describe in reasonable detail each action or contemplated action and payment and the dates thereof, core usage and design burn up, estimated fueling dates and the energy expected to be generated by each unit for each fuel period of the Fuel Plan, a cash flow analysis of forecasted expenditures and credits for each Participant for each major component of the fuel cycle by years, and cash flow by months for the first five (5) years. Each Fuel Plan will provide the ten (10) year forecasted nuclear fuel burn rate in dollars per megawatt-hour ($/MWh) electric, not including spent fuel disposal or other such fees, for each unit. Each Fuel Plan will also provide the following information with respect to the spent fuel at Each Plant: the existing spent fuel storage capacity; the current spent fuel inventory; the projected date when the spent fuel storage capacity will be fully utilized; the projected dates when shipments of spent fuel for disposal will commence; and the projected date when additional spent fuel storage capacity may have to be provided.
