Grievance Requirements. Grievance claims involving retroactive compensation shall be limited to no more than thirty (30) workdays prior to the written submission of the grievance to the Employer; however, such retroactivity shall be extended to a period equal to any statutory limitation that may be applicable.
Section 16.3.1 In arriving at any disposition or settlement, neither party shall have the authority to alter this Agreement.
Section 16.3.2 The Employer shall not discriminate against any individual employee or the Council for taking action under this article.
Section 16.3.3 Discussion in the handling of grievances, formally or informally, shall take place whenever possible on school time.
Section 16.3.4 This grievance procedure shall not apply to any grievance arising prior to its adoption by the parties.
Section 16.3.5 The time limits provided in this article shall be strictly observed unless extended by written agreement of the parties. Failure of the grievant to proceed with the grievance within the times hereinbefore provided shall result in the dismissal of the grievance. Failure of the Employer to take the required action within the times provided shall entitle the grievance to proceed to the next step of the grievance procedure.
Grievance Requirements. Section 14.4.1 Grievance claims involving retroactive compensation will be limited to no more than forty-five (45) days prior to the written submission of the grievance to the District.
Grievance Requirements. Written grievances as required herein shall contain the following:
1. It shall be signed by the grievant(s). The Association may be the grievant.
2. It shall be specific.
3. It shall contain a synopsis of the facts giving rise to the alleged violation.
4. It shall cite the section or subsections of this contract (or the written policy) alleged to have been violated.
5. It shall contain the date of the alleged violation.
6. It shall specify the relief requested.
7. Utilize the form and format set forth in Appendix D. Any written grievance not substantially in accordance with the above requirements may be rejected as improper. Such a rejection shall not extend the limitations hereinafter set forth.
Grievance Requirements. Grievances will be processed in accordance with the procedure specified here.
Grievance Requirements. The Union shall have reasonable opportunity to be present at all grievance meetings. If an employee or the Union fails to submit written grievances to the next grievance step within the time so specified, it will be assumed that the grievant has dropped the grievance or accepted the resolution of the grievance at that level.
Grievance Requirements. All written grievances shall state the article and specific section of the Agreement alleged to have been violated, the date of the violation and the relief requested. Only individual grievances will be allowed, no group grievances will be permitted, except contract interpretation grievances alleging the same article and section of the Agreement to have been violated where the relevant facts are the same.
Grievance Requirements. The reference to "party" or "parties" within the Grievance Procedure shall mean the Employer and the Union, either singularly or jointly, as is appropriate. The Union shall have reasonable opportunity to be present at all grievance meetings. If an employee or the Union fails to submit grievances to the next grievance step within the time so specified, it will be assumed that the grievant has dropped the grievance or accepted the resolution of the grievance at that level.
Grievance Requirements. Each grievance must state the specific provisions of the agreement alleged to have been violated and the facts upon which the grievant relies to establish the alleged violation. Grievances may not be modified after submission at Step 1 without the mutual agreement of the parties. The time limits and procedures for grievance processing must be strictly followed. Unless otherwise specifically stated, all days referred to in this grievance procedure are business days, not school days. Business day is defined to mean any time the District office is open for business. Failure of the grievant or the Association to meet any time limit shall bar further processing of the grievance. Failure of the Board or the Administration to act in a timely manner shall permit the grievant to proceed to the next step. Any grievance not appealed after denial by the Administration shall bar later filing of the same grievance. Documents relating to the filing or processing of a grievance will not be placed in the employee’s(s’) personnel file.
Grievance Requirements. The Parties agree that all grievances when first presented in writing must set forth the following:
A. The issue or occurrence giving rise to the grievance;
B. Whether a meeting is requested;
C. The provision(s) of law, regulation, or this Agreement which allegedly has been misinterpreted, misapplied or violated;
D. All relevant evidence and information; and
E. The relief sought, which must be personal to the grievant.
Grievance Requirements. The following requirements apply to the proper implementation of the provisions of this Article. They are provided in order to clarify and preserve the requirements and the interests of the employees, the Federation, and the College.
