Incidents. Without prejudice to Article 11 of this attachment, and in accordance with attachment F of the Access Code for Transmission, in case of an incident compromising the safe and efficient operation of the transmission grid and/or the system integrity, urgent measures shall be taken by TSO which can consist inter alia of, without being limited to an interruption and/or reduction of the Transmission Services. The Network Users affected by the interruption and/or reduction and the XXXX shall be informed by the TSO of the event and the estimated duration, according to the reporting obligations described in attachment F of the Access Code for Transmission. The Plan for Incident Management is included in attachment F of the Access Code for Transmission.

Incidents. All improper disclosures of SBU building information must be immediately reported to the CO at <insert address and contact information> . If the contract provides for progress payments, the CO may withhold approval of progress payments until the contractor provides a corrective action plan explaining how the contractor will prevent future improper disclosures of SBU building information. Progress payments may also be withheld for failure to comply with any provision in this clause until the contractor provides a corrective action plan explaining how the contractor will rectify any noncompliance and comply with the clause in the future.
Incidents. 41.1. If Researcher becomes aware of an Incident involving Data by either Researcher or any of Researcher’s Subcontractors, Researcher shall notify USBE within one (1) calendar day and cooperate with USBE regarding recovery, remediation, and the necessity to involve law enforcement, if any.‌ 41.2. Researcher shall produce a written remediation plan that includes information about the cause and extent of the Incident and the actions Researcher will take to remediate the Incident and to reduce the risk of incurring a similar type of Incident in the future. Researcher shall present its analysis and remediation plan to USBE within ten (10) calendar days of notifying USBE of an Incident. USBE reserves the right to adjust this plan, in its sole discretion. If Researcher cannot produce its analysis and plan within the allotted time, USBE, in its sole discretion, may perform such analysis and produce a remediation plan, and Researcher shall reimburse USBE for the reasonable costs thereof. 41.3. In the event of an Incident, Researcher shall provide USBE or its designated represent atives with access seven (7) days a week, twenty-four (24) hours a day, for the purpose of evaluating, mitigating, or resolving the Incident. 41.4. Unless Researcher can establish that Researcher or any of its Subcontractors is not the cause or source of the Incident, Researcher shall be responsible for the cost of notifying each person whose personal information may have been compromised by the Incident. 41.5. Disclosure of Data by Researcher or any Subcontractor for any reason may be cause for legal action by third parties against Researcher, the State, or their respective agents. Researcher shall indemnify, save, and hold harmless the State, its employees, and agents against any and all claims, damages, liability, and court awards including costs, expenses, and attorney fees incurred as a result of any act or omission by Researcher, or its employees, agents, Subcontractors, or assignees pursuant to this Contract. Notwithstanding any other provision of this Contract, Researcher shall be liable to the State for all direct, consequential and incidental damages arising from an Incident caused by Researcher or its Subcontractors. 1. Progress payments may also be withheld for failure to comply with any provision in this paragraph until the contractor provides a corrective action plan explaining how the contractor will rectify any noncompliance and comply with the paragraph in the future.

The Provider must comply with any instructions issued by the Department, the Department of Jobs and Small Business or the Department of Jobs and Small Business’ insurance broker, and any Guidelines, in relation to insurance purchased by the Department of Jobs and Small Business for Participants. The Department may give Notice, on reasonable grounds related to the performance of PaTH Internships and National Work Experience Programme Placements, requiring the Provider to arrange for the removal of a supervisor, whether engaged by the Provider or engaged by an Activity Host Organisation, from work on the Activities. Where the Department gives Notice under clause 561, the Provider must, at its own cost, promptly arrange for the removal of such a supervisor from work on the affected Activities and their replacement with one or more supervisors acceptable to the Department.

Incidents. Any incidents occurring as a result of this agreement should be reported to the signatories of all affected organisations. They will then pass on the information in accordance with incident reporting procedures within their own organisation if appropriate. Organisations will agree to share information in order to help investigate any such incidents.
