Lead Municipality. During the Term of this Agreement, the Town of Concord shall act as the lead municipality. The Town of Concord shall perform or provide the following:
a. Issue Requests for Proposals for Consultants to provide housing administrative services described in Exhibit A: Core Housing Services, attached and incorporated herein, for all the Municipalities;
b. Enter into contracts with Consultants to provide said housing administrative services;
c. Manage the Consultant contracts;
d. Receive invoices from the Consultants and make payments in a timely manner for services rendered;
e. Provide office space and related utilities for the Consultants to operate the Regional Housing Services Office;
f. Administer the collection, accounting and use of funds provided by the Municipalities to fund the Consultant contracts;
g. Provide overall program oversight and related administration;
h. Provide conflict resolution in accordance with Section 10 below.
Lead Municipality. During the term of this Agreement, the BCDHE, acting as the “Lead Municipality,” shall oversee the Grant Program and the shared services program provided for herein (the “Shared Services Program”). As the Lead Municipality, the BCDHE shall act for the Collaborative with respect to all grant applications to be submitted and gifts and grants received collectively by the Municipalities. The BCDHE shall act as the Municipalities’ purchasing agent pursuant to X.X. x. 7, §22B, for all contracts duly authorized by the Governance Board, established pursuant to Section 5 of this Agreement, to be entered into collectively by the Municipalities. Final approval of any such contract is subject to approval of the Governance Board and appropriation by each Municipality, to the extent required.
Lead Municipality. During the Term of this Agreement, the Town of Acton shall act as the Lead Municipality. The Town of Acton shall perform or provide the following:
a. Procure, contract and supervise a Grant Administrator to administer the Program;
b. Receive invoices from the Grant Administrator and make payments in a timely manner for services rendered;
c. Provide office space and related utilities for the Grant Administrator to administer the Program;
d. Administer the collection, accounting, and use of funds provided by the Massachusetts Department of Housing and Community Development in its Community Development Block Grant – Coronavirus Funding for a Microenterprise and Public Services Assistance Program to fund the Grant Administrator contracts;
e. Provide overall oversight and related administration of the Program;
f. Provide conflict resolution in accordance with Section 8 below.
Lead Municipality. During the Term of this Agreement, the Town of Arlington, acting as the lead municipality, shall employ the Regional Energy Manager. The Town of Arlington, through its standard personnel practices, shall hire a Regional Energy Manager to provide the energy-related services described in Exhibit A: Energy Manager Job Description, attached and incorporated herein, to the Municipalities.
Lead Municipality. During the Term of this Agreement, the Town of Ipswich, acting as the lead Municipality, shall operate the Regional Animal Control Services Facility. The Town of Ipswich, through its standard personnel practices, shall employ or contract the adequate staff necessary to provide the Animal Control administrative services described in Exhibit A (Animal Control Facilities and Services), attached and incorporated herein, to the remaining Municipalities.
Lead Municipality. During the Term of this Agreement, the Town of Xxxxxx, acting as the Lead Municipality through the Trust, shall oversee the RHC. The Town of Xxxxxx, through its standard procurement practices, through the Trust, shall contract with a suitable RHC to provide the housing administrative services to all the participating Municipalities and Devens as described in Section IV: “Project Overview, Scope of Work, & Deliverables” (p.8-15) of the Request for Proposals for MAGIC Regional Housing Consultant Services (“RFP”) issued publicly on April 20, 2020 , a copy of which is attached to this Agreement as Exhibit A and incorporated herein.
Lead Municipality. During the term of this Agreement, the Town of Brookline acting as the “Lead Municipality,” shall oversee the Grant Program and the Shared Services Program. As the Lead Municipality, the Town of Brookline shall act for the Collaborative with respect to all grant applications to be submitted and gifts and grants received collectively by the Participating Municipalities. The Town of Brookline shall act as the Participating Municipalities’ purchasing agent pursuant to M.G.L. c. 7, §22B, for all contracts duly authorized by the Advisory Board, established pursuant to Section 6 of this Agreement, to be entered into collectively by the Participating Municipalities. Final approval of any such contract is subject to approval of the Advisory Board and appropriation by each Municipality, to the extent required.
Lead Municipality. During the term of this Grant Agreement, the Town of Xxxxxxxx will act as the Lead Municipality overseeing the Grant Program provided for herein. The Town of Xxxxxxxx has been expressly authorized by the Municipalities to execute this Grant Agreement between the Town of Xxxxxxxx and the Commonwealth of Massachusetts concerning the Grant Program, the terms of which are expressly incorporated into the Inter-Municipal Agreement and shall bind the Municipalities, and any programs and services provided pursuant to the Grant Agreement or this Inter- Municipal Agreement. As the Lead Municipality, the Town of Xxxxxxxx shall act for the Collaborative with respect to all future grant applications to be submitted during the term of this Grant Agreement and all gifts and grants received collectively by the Municipalities pursuant to said grant applications during the term of this Grant Agreement. The Town of Xxxxxxxx shall designate a Program Manager under the Grant Agreement and the Inter-Municipal Agreement. Prior to submission, the Program Manager must approve all grants or grant applications submitted by the Collaborative during the term of the Grant Agreement or the term of the Inter-Municipal Agreement. The Town of Xxxxxxxx shall act as the Municipalities’ purchasing agent pursuant to X.X. x. 7, §22B, for all contracts duly authorized by the Program Manager established pursuant to Section 5 of this Agreement, to be entered into collectively by the Municipalities concerning the Grant Program. Final approval of any such contract is subject to the approval of the Program Manager and appropriation by each Municipality, to the extent required.
Lead Municipality. In accordance with the provisions of this Agreement, the Municipalities hereby designate the City of Framingham as the lead municipality (“Lead Municipality”). The Lead Municipality shall provide reasonable physical accommodations for staff and operations and shall perform all duties and provide all services consistent with those afforded any other department under its jurisdiction. In addition, the Lead Municipality is responsible for: District Staff Personnel Functions Payroll Health and Other Benefits Staff onboarding Required staff trainings Performance evaluations Insurance for operations Financial Management Maintain records of service performed, costs incurred, and reimbursements Issue and collect annual assessments Perform annual audits Issue periodic financial statements Attend quarterly meetings as the Treasurer (if applicable) Day-to-day oversight of the District Staff In accordance with the provisions in this Agreement, the Municipalities agree to the following and shall: Allow the District Staff to enjoy such vacation, sick and personal days and other leave as they may be entitled to receive under the standard personnel practices of the Lead Municipality. No Municipality shall make any demand on the District Staff or take any action with respect to them that is in violation of their rights under standard personnel practices of the Lead Municipality or under any applicable legislation; Accept responsibility for any hearings resulting from the actions of the District Staff. Responsibility shall be held by the Town/City council or another appropriate authority in the Municipality in which the action originated. Any costs, such as legal fees, shall be paid by the Municipality in which the action took place. Complaints received concerning the action of the District Staff shall be resolved by the Town/City Manager/Administrator or Mayor in the Municipality in which the complaint originated, in consultation with the Lead Municipality as appropriate; Accept responsibility and bear any costs required from an increased demand due to an activity or an event that cannot be reasonably be accommodated under the current capabilities and staffing levels the District Staff. Lead Municipality. To the extent permitted by the Grant Program and its agreement with the Commonwealth of Massachusetts pursuant thereto, the Lead Municipality, by a vote of its Select Board, Chief Executive Officer and Board of Health, may withdraw from this Agreement upon the provision of at least three (3) months prior written notice to the remaining Municipalities and the Advisory Board, and a new Lead Municipality shall thereafter be designated by the Advisory Board, by a vote of the members of the remaining Municipalities. Prior to the effective date of its withdrawal, the Lead Municipality shall transfer all funds held pursuant to this Agreement to the new Lead Municipality as designated by the Advisory Board and pay any outstanding unpaid financial obligations under this Agreement within thirty (30) days thereafter.
