LESSEE'S WORK Sample Clauses

LESSEE'S WORK. 50.1 Approval of Lessee's Plans, Specifications and Contractor. Within 45 days following execution of the Lease, Lessee shall cause to be prepared and delivered to Lessor (1) preliminary space plan drawings and (2) preliminary specifications for the improvements, fixtures and equipment to be installed into the Premises. Within two business days following Lessor's receipt of the preliminary plans and specifications, Lessor shall provide to Lessee approval of such preliminary plans and specifications unless Lessor has a reasonable and material objection thereto. Within 45 days following Lessor's approval of the preliminary plans and specifications, Lessee shall cause to be prepared and delivered to Lessor (1) working plans which are sufficiently detailed in order to apply for and obtain a building permit for the interior improvements to the Premises which shall be based upon the preliminary plans previously approved by Lessor and (2) final specifications for the improvements, fixtures and equipment to be installed into the Premises which shall be based upon the preliminary specifications previously approved by Lessor. Within two business days following Lessor's receipt of the working plans and specifications, Lessor shall approve such plans and specifications unless Lessor has a reasonable and material objection thereto. Following Lessor's approval of the working plans and specifications, Lessee shall submit the working plans and specifications to the Building Inspection Department of the City of San Diego for the purpose of obtaining a building permit for the construction of the work described in the working plans and specifications (hereinafter "Lessee's Work"). If, during the course of construction of Lessee's Work, Lessee determines that it is necessary or desirable to make a material change to the working plans and specifications, then such proposed change shall be first submitted to Lessor for Lessor's review and approval, which shall not be unreasonably withheld or delayed. Prior to commencement of Lessee's Work, Lessee shall submit to Lessor the name, telephone number, license number and contact representative for the general contractor whom Lessee intends to use to accomplish Lessee's Work. Within two business days following Lessor's receipt of such information concerning the proposed general contractor, Lessor shall approve Lessee's selection of the general contractor unless Lessor has a reasonable and material objection thereto. LESSEE'S WORK. 21.1 The Lessee acknowledges that it will not be granted access to the leased premises until such time as the agreement of lease has been signed and the deposit, stamp duty, lease fee, pro-rata rental if applicable, and the first month’s rental has been paid to the Lessor. 21.2 The Lessee shall be responsible for constructing the interior of the leased premises at its sole cost and expense. 21.3 The Lessee undertakes to commence with the actual and physical fit out of the leased premises within 72 (seventy two) hours after being granted access to the leased premises. 21.4 The Lessee shall comply with all statutory requirements including but not limited to the Occupational Health and Safety Act as amended during the fit out of the leased premises and while occupying the leased premises. The Lessee shall at its own cost procure a Certificate of Electrical Compliance and an Occupation Certificate within 7 (seven) days after completion of the construction of the interior of the leased premises.
LESSEE'S WORK. Lessee, at its own cost and subject to all of the terms of this Lease (other than the obligation to pay the Net Rent and other charges hereunder prior to the commencement of the Term), may perform work in the Building concurrently with Lessor's work, to fit the Building for Lessee's occupancy, provided Lessee's work does not interfere with Lessor's work; Lessee's work may be performed through Lessor's contractor or, if no labor discord would be caused thereby, through Lessee's own contractor. Lessee shall not allow any liens or encumbrances of any kind to lie attached to or placed upon the Premises as a result of Lessee's work and in the event such liens or encumbrances are discovered, Lessee agrees to promptly satisfy and remove same, Lessee hereby agrees to hold Lessor harmless from and against any liens caused by Lessee, and Lessee shall reimburse Lessor upon demand for any costs and expenses incurred in connection with any such lien, including without limitation attorneys' fees. Any action by Lessee to take full or partial occupancy to fit the Building for Lessee's occupancy pursuant to this Paragraph 53 shall not advance the Commencement Date from what would otherwise apply pursuant to this lease.
LESSEE'S WORK. If Lessee desires any Alterations and/or Utility Installations to the Premises ("LESSEE'S WORK" herein), Lessee shall comply with all of the terms and provisions of this Lease including but not limited to PARAGRAPH 6 of this Lease. Lessee shall construct all of such Lessee's Work at Lessee's sole cost and expense, except as hereinafter provided. Lessor hereby agrees to provide Lessee with an Allowance in the total amount of One Hundred Thousand Three Hundred Dollars ($100,300), subject to PARAGRAPH 52.7, so that Lessee shall perform the following as part of Lessee's Work: 53.1.1 Install new men's and women's restrooms in Buildings A, B and C in compliance with all Applicable Requirements. The restroom fixtures and configuration shall be subject to the mutual approval of Lessor and Lessee; and, 53.1.2 Slurry coat, re-stripe and repair the parking lot area; and, 53.1.3 Install skylights in the front two (2) buildings; and, 53.1.4 Install windows where there are roll-up doors in the C Building as shown on the Window Plan which is attached hereto as EXHIBIT "C". The Window Plan shall also contain the size and specifications for such windows. The amount of the Allowance is based on amounts contained in EXHIBIT "D". The Parties recognize that said figure is based on estimates which have not been bid out to subcontractors. The only way to determine the exact amount of any particular item is to have it bid out to subcontractors. The successful subcontractor would then sign a contract becoming contractually bound to honor the price for the particular work in question. The Lessee has an immediate need for the Premises because Lessee's existing office lease expires soon. The Parties are using said estimates, rather than figures which have been bid to subcontractors, in order to get this Lease signed in time for work to be done so Lessee may move into the Premises on or about the time its existing office lease expires. Lessee acknowledges that Lessee has had said estimates reviewed by Lessee and by its design professionals, including but not limited to architect, space planner, engineers, and contractors. Lessor shall not be liable to Lessee and the amount of the Allowance shall not be increased if said estimates are not accurate, except as hereinafter provided."
LESSEE'S WORK. The Lessee shall complete, at its own cost and expense, the Premises in accordance with the specifications as set out in Schedule "C" attached hereto, in a good and workmanlike manner.

LESSEE'S WORKSubject to delays caused by Lessor or for reasons beyond Lessee's control (excluding the inability of Lessee to make any monetary payment), Lessee shall promptly commence and pursue in good faith to completion any Lessee's Work identified in EXHIBIT E attached hereto. Subject to reimbursement for a portion of the costs of Lessee's Work pursuant to EXHIBIT E, all of the costs and expenses incurred by Lessee in performing Lessee's Work shall be paid by Lessee. Lessee's Work shall be performed in accordance with the provisions of EXHIBIT E below. Lessee's Work shall be completed and the Premises ready for occupancy no later than one hundred eighty (180) days after the Occupancy Date. Base Rent shall commence being due and payable on a monthly basis on the Base Rent Commencement Date regardless whether the Lessee's Work has been completed by that time.

Lessor shall contribute up to a maximum of One Hundred and Twenty-Five Thousand Dollars ($125,000) towards said work, to be disbursed to the Lessee upon presentation of relevant receipts; any expense incurred over and above One Hundred and Twenty-Five Thousand Dollars ($125,000) shall be assumed solely by the Lessee.
LESSEE'S WORKLessee shall have no right, authority or power to bind Lessor, or any interest of Lessor in the St. Xxxxxxx Xxxxxx, for any claim for labor or material or for any other charge or expense incurred in connection with any construction work done by Xxxxxx within the St. Xxxxxxx Xxxxxx or any change, alteration or addition thereto, or replacement or substitution therefor, nor to render the Lessor's interest in the St. Xxxxxxx Xxxxxx liable to any lien or right of lien for any labor or material or any other charge or expense incurred in connection therewith, and Lessee shall in no way be considered as the agent of Lessor in the construction or operation of the Improvements or any replacement or substitution therefor. All persons performing work, labor or supplying materials at the St. Xxxxxxx Xxxxxx on behalf of Lessee shall look solely to Xxxxxx and not to that of Lessor for sums owed.
