LIFE OF AGREEMENT. 1. This AGREEMENT will come into effect on being signed by the latest contracting party commencing with January 1, 1995.
2. The lifetime of this AGREEMENT is in accordance with the lifetime of the US-AGREEMENT.
3. MAUSER has the right to cancel this AGREEMENT by written notice of cancellation and with immediate effect for any of the following, if XXXXXXX-XXXXXXX is in default of a material obligation resulting from this AGREEMENT, especially with the payment of the Royalties, or has violated material obligations under the AGREEMENT and has not remedied such violation within three months after receipt of a corresponding notice by MAUSER to do so, XXXXXXX-XXXXXXX undertakes measures which are a material breach of trust and/or breach of secrecy
4. XXXXXXX-XXXXXXX has the right to cancel this AGREEMENT by written notice of cancellation and with immediate effect, if MAUSER does not fulfill material obligations under this AGREEMENT within three months after having received a corresponding notice to do so.
5. In the event of any adjudication of bankruptcy, assignment for the benefit of creditors or levy of execution directly involving XXXXXXX-XXXXXXX or MAUSER, the other shall have the immediate right to terminate this AGREEMENT by giving written notice to the other party hereto.
6. In the event of a premature termination of this AGREEMENT by cancellation all rights of XXXXXXX-XXXXXXX arising from this AGREEMENT will cease by the latest two months after receipt of the notice of cancellation. The Royalties shall be payable until that date, when XXXXXXX-XXXXXXX loses all rights resulting from this AGREEMENT.
7. Upon the termination of this AGREEMENT all rights of the contracting parties from this AGREEMENT will cease, unless such termination is coincident with the termination of said US-Agreement, in which event the rights of the parties shall be as set forth in the US-Agreement.
LIFE OF AGREEMENT. Except as otherwise provided herein, this Agreement shall be effective January 1, 2022, and shall remain in full force and effect until the 31st day of December 2024.
LIFE OF AGREEMENT. This Agreement is in full force and effect from the effective date recited on page one and remains in effect for the life of the last-to-expire patent in Patent Rights, unless otherwise terminated by operation of law or by acts of the parties in accordance with the terms of this Agreement.
LIFE OF AGREEMENT. This Agreement shall operate from the beginning of the first pay period to commence on or after 1 May 2008 and shall remain in force until 30 May 2011.
LIFE OF AGREEMENT. 21.01 This Agreement shall be for the period from and including February 1, 2016, to and including January 31, 2020, and from year to year thereafter, subject to the right of either party to the Agreement, within four (4) months immediately preceding January 31, 2020, or a subsequent anniversary date thereafter to:
1. terminate this Agreement, in writing, effective January 31, 2020, or any subsequent anniversary thereof;
2. require the other party to this Agreement, in writing, to commence collective bargaining to conclude a revision or renewal of this Agreement.
21.02 Should either party give notice pursuant to (2) above, this Agreement shall thereafter continue in full force and effect and neither party shall make any change in the terms of the said Agreement, or increase or decrease the rate of pay of any Associate for whom collective bargaining is being conducted, or alter any other terms of condition of employment until:
1. The Union upon commencement of lawful strike in compliance with Section 81 of the Labour Code of British Columbia, or
2. The Employer upon commencement of lawful lockout in compliance with Section 82 of the Labour Code of British Columbia.
21.03 The operation of Section 50 (2)(3) of the Labour Code of British Columbia is hereby excluded. DATED THIS day of , . 1. Commission policies for the Victoria Store, other than those fixed for the duration of the Collective Agreement, will be applied in conformity with their general application throughout the Region. Commission Sales Associates and the Management at The Bay Victoria must abide by the guidelines established in the Commission Manual established by the Company for the Region as a whole. Changes to the Commission Policies shall be promptly communicated to the Associates.
LIFE OF AGREEMENT. 8.1 This Agreement shall become effective on the date which is executed by the Parties and shall terminate on the date the Option Holder exercises its purchase option and acquires all the shares or assets of the Company pursuant to the terms of this Agreement.
8.2 Notwithstanding the provisions set forth hereinbefore, the Option Holder may rescind this Agreement by informing the other parties in writing thirty (30) days in advance of its intent to rescind this Agreement.
LIFE OF AGREEMENT. This Operating Agreement will become effective when signed by all parties. This Operating Agreement will remain effective unless and until it is terminated by two or more parties, or it is superseded by another agreement. This Operating Agreement may be amended at any time upon written agreement between all parties. A party may terminate this Operating Agreement by providing 90 days written notice to the remaining parties.
LIFE OF AGREEMENT. This Agreement shall become effective July 1, 2014, and shall remain in effect for an initial period of thirty-six (36) months ending July 1, 2017 and thereafter shall continue in effect unless terminated by either party at the end of the initial period, or at any time thereafter by notice in writing to the other party sixty (60) days prior to the date thereafter on which termination shall become effective. LIFE OF AGREEMENT. Effective Date: This Agreement will remain in effect from January 1, 2022 through December 31, 2025. In recognition of the possibility that changes may be necessary for the mutual benefit of the parties during the life of the Agreement, either party may initiate discussion of modifications by written communication to the other. The party receiving such communication shall arrange to meet with the other party within thirty (30) days of receipt. Should agreement be reached with appropriate ratification, the modification shall be attached as a supplemental agreement to this Agreement.
LIFE OF AGREEMENT. 3.1 This Agreement begins when the parties have both signed this document, or on a later date specified in Item 5 of the Schedule. If there is no written and/or signed Agreement between the parties, the Agreement begins when the Driver first logs on to the Operator’s Taxi or, if the Driver does not log on, when the Driver starts his first Shift in the Operator’s Taxi.
3.2 This Agreement ends on the Completion Date specified in Item 5 of the Schedule, unless
(a) terminated earlier in accordance with clause 9; or NOTE:
(a) Clauses 4 to 10 are implied into this Agreement under section 162L of the TCMA and must not be amended or removed under any circumstances.
(b) Even if they are physically removed from this written Agreement, these conditions will still apply by operation of the law.
(c) It is an offence under section 162M of the TCMA for either the Driver or the Operator to breach any of clauses 4 to 10. If either party does breach one or more of these clauses, that party may be fined up to 120 penalty units for an individual or 600 penalty units for a body corporate.
