DURATION OF THE COLLECTIVE AGREEMENT. This Agreement shall be in force effective from April 01, 2010 until March 31, 2014. DURATION OF THE COLLECTIVE AGREEMENT. 38.01 This Agreement shall be in force effective from April 01, 2014 until March 31, 2019. Either party to this Agreement may at any time within four (4) months immediately preceding the expiry of the Agreement, by written notice, require the other party to commence collective bargaining. Failing agreement by March 31, 2019 this agreement will continue in force until:
(A) commencement of a strike by the Union or a lockout by the University, as defined in the Labour Code of British Columbia, or
(B) a new agreement is reached.
DURATION OF THE COLLECTIVE AGREEMENT. 26.01 This Collective Agreement shall become effective on the 1st day of April 2009 and shall remain in effect until 31st day of March 2014 and shall be renewed automatically from year to year thereafter, unless either party gives notice of amendment to the other party within ninety (90) days prior to the anniversary date in any year. In the event that either party serves notice to the other party of its desire to amend this Collective Agreement, then this Collective Agreement shall continue in effect until such time as a new Collective Agreement has been reached, or until the conciliation procedures, as required by legislation have been completed.
DURATION OF THE COLLECTIVE AGREEMENT.
21.1 The Collective Agreement shall remain in effect from January 1, 2015 to December 31, 2017 or until modified by mutual agreement betw een the parties or as decided by interest arbitration pursuant to Article 21.3. Either Party may give w xxxxxx notice of not more than one hundred and xx xxxx (120) days and not less than thirty (30) days prior to December 31, 2017 of its intention to modify the Collective Agreement. Where no such notice is given, the Collective Agreement shall renew itself from year to year. In any such subsequent year, notice of the intent to modify the Collective Agreement may be given not more than one hundred and xx xxxx (120) days and not less than thirty (30) days prior to its anniversary. Within thirty (30) days of notice being given (or such longer time as may be agreed), the Parties shall meet, bargain in good faith and make every reasonable effort to reach agreement respecting proposed modifications. The timelines regarding notice to bargain and the start of the collective bargaining process contained in this Clause may be amended by mutual agreement of the Parties.
21.2 If follow ing notification of the intention to modify the Collective Agreement, the Parties have failed to reach a satisfactory agreement, the terms of the new agreement w ill be settled via interest arbitration. Either Party may require that the matters still in disagreement be submitted to interest arbitration and shall give notice in w riting to the other party detailing the points remaining in dispute. The Board of Arbitration shall consist of three (3) members to be appointed w ithin thirty (30) days of the request for arbitration and shall consist of one (1) member appointed by the Employer and one (1) member appointed by the Union, w ho, w ithin seven (7) days of their appointment shall select the third member w ho shall act as the Chairperson of the Board. On consent, the Parties may elect to have the matter heard by a single arbitrator.
21.3 The Parties to this Collective Agreement agree that should any provision(s) of this Collective Agreement be determined to be in conflict or inconsistent w ith any Federal Labour Code, that the Parties w ill in w riting amend such provisions to the extent that compliance is obtained. All other provisions w ould remain in full force as set out, for the duration of this Collective Agreement.
DURATION OF THE COLLECTIVE AGREEMENT. 32.01 This Agreement shall be effective from March 1, 2008 and shall continue in effect up to and including the 28th day of February, 2011, and shall continue automatically thereafter for annual periods of one year each, unless either party notifies the other in writing within a period of three (3) months immediately prior to the expiration date that it desires to amend the Agreement. DURATION OF THE COLLECTIVE AGREEMENT. 27.01 Once this Collective Agreement has been signed by the Parties’ authorized representatives and filed in accordance with the Labour Code, it shall remain in force from September 1, 2017 until August 31, 2020. It shall come into force on September 1, 2017 and shall not have any retroactive effect unless explicitly agreed. The working conditions set out in this Collective Agreement shall apply until the signing of a new collective agreement, except during a legal strike or legal lockout.
DURATION OF THE COLLECTIVE AGREEMENT. 40.01 The collective agreement enters into and remains in effect from the signing of the collective agreement until May 31, 2021. It has no retroactive effect except where expressly provided.
40.02 Notwithstanding clause 40.01, the collective agreement remains in effect until the signing of a new collective agreement.
40.03 The University makes the collective agreement available to the employees on its website and Intranet site. The University remits thirty (30) hard copies of the collective agreement to the Union for its exclusive use.
DURATION OF THE COLLECTIVE AGREEMENT. This Collective Agreement shall be effective as of the date of ratification until the 15th day of May, and thereafter from year to year, unless at least sixty (60) and not more than one hundred and twenty (120) days prior to the expiry date, written notice is given by either party that the Collective Agreement is to be amended.
