Maintenance of Health and Safety. Seller shall take reasonable safety precautions with respect to the operation, maintenance, repair and replacement of the Facility. If Xxxxxx becomes aware of any circumstances relating to the Facility that create an imminent risk of damage or injury to any Person or any Person’s property, Seller shall take prompt action to prevent such damage or injury and shall give Notice to Buyer’s emergency contact identified on Exhibit N of such condition. Such action may include, to the extent reasonably necessary, disconnecting and removing all or a portion of the Facility, or suspending the supply of Energy to Buyer.‌

Such Seller action may include disconnecting and removing all or a portion of the System or suspending the supply of Energy to Purchaser.

Maintenance of Health and Safety. The Board shall strive to ensure and maintain facilities that are free of hazards that might cause serious physical harm to employees and students. All bargaining unit members will report in writing to the building principal within two (2) days any hazardous conditions in the building that might cause serious physical harm to employees or students. Effective September 1, 2008, a Health and Safety Committee shall be established to implement best practice procedures for reporting and correcting health/safety issues. Implementation of the procedures shall occur no later than October 1, 2008.

Such action may include disconnecting and removing all or a portion of the System, or suspending the transfer of energy between the System and the Premises. Should Host become aware of any risk of damage or injury to any Person or any Person’s property, Host shall promptly notify Provider with respect thereto.
