The Employer shall have the right to test (using scientifically acceptable methods) any employee or group of employees for whom the Employer has reasonable cause to believe that drug or intoxicant use is effecting work performance and safety. Failure to pass any of the above tests shall be deemed sufficient reason to disqualify said person from employment.
MANAGEMENT PREROGATIVE. The management and direction of the Hospital and the 28 employees, including but not limited to the right to hire, layoff, promote, demote, 29 transfer, discharge, or discipline for cause, to subcontract work, to make and enforce 30 work rules, regulations and personnel policies and procedures, to require reasonable 31 overtime, to maintain discipline of the employees and efficiency of the Hospital, to 32 determine job duties, job assignments and working schedules, and to determine the 33 services to be provided, the kind and location of facilities, the methods and procedures 34 to be followed, and the staffing and equipment required, are vested exclusively in the 1 Hospital, provided the Hospital shall not exercise these rights in violation of the 2 provisions of this Agreement. The parties recognize that the above statement of 3 management prerogatives is for illustrative purposes only and should not be construed 4 as restrictive or interpreted so as to exclude those prerogatives not mentioned which 5 are inherent to the management function.

MANAGEMENT PREROGATIVE. A. Any and all rights and prerogatives of the Employer in the operation and management of its business and the direction of its employees, including the making of work rules in connection therewith, shall be and remain vested in the Employer, except as modified by this Agreement. The Employer will notify the Union of changes in work rules prior to implementation. The Union has the right to challenge any unreasonable changes in work rules. B. MANAGEMENT PREROGATIVE. Any of the rights, functions, authority or power which the Employer had prior to the signing of this Agreement are retained by the Employer, except as any of those rights, functions, authorities or powers are specifically modified by express written agreement with the Union as to such particular subject as set forth herein. The Employer retains all of such customary and usual functions as an authority of the establishment and of the working force in accordance with the foregoing. No rules, customs, past practices or agreements other than those expressly set forth in writing by the parties, shall limit or restrict the Employer's right to determine staffing requirements or assignments or modify its operation in any way.
