MANAGEMENT FUNCTION. 3.01 The Union acknowledges that it is the exclusive function of the Board to: (a) Maintain efficiency, order and discipline; (b) Hire, retire, discharge, direct, classify, establish new positions, transfer, promote, demote, lay-off and suspend or otherwise discipline employees provided that a claim by an employee with seniority that the employee has been the subject of a discriminatory promotion, demotion or transfer, or a claim that the employee has been discharged or disciplined without reasonable cause may be made the subject of a grievance and dealt with as hereinafter provided; and (c) Operate and manage its educational facilities in all respects in accordance with its commitments and responsibilities including the determination of the methods, procedures, machinery and equipment to be used, schedules of work and all other matters concerning the operation of the Board’s facilities not otherwise specifically dealt elsewhere in this Agreement. 3.02 The above function shall be exercised in a manner consistent with the other provisions of this Agreement. 3.03 The Board has the right to make and implement reasonable rules and regulations. Any changes in such rules and regulations made by the Board shall not be in conflict nor inconsistent with the provisions of this Agreement.

MANAGEMENT FUNCTION. 3.01 VON Simcoe County shall assign work, duties and responsibilities in accordance with the Regulated Health Professions Act and the guidelines established by the College of Nurses of Ontario. 3.02 VON Simcoe County retains the rights of Management except as amended by this Agreement. Without limiting the generality of the foregoing, VON Simcoe County retains the sole right to: (a) Direct the nurses, assign work, hire, discharge, classify, promote, demote, transfer, lay-off, suspend and otherwise discipline a nurse for cause. A claim that a nurse has been improperly classified or has been demoted, discharged, suspended or otherwise disciplined, without just cause, may be the subject of a grievance. (b) Determine the methods, schedules, procedures, program, locations, equipment, means of transportation while on duty, areas in which the nurses work, number of nurses and staff requirements. 3.03 The above rights shall not be exercised in a manner inconsistent with the provisions of the Collective Agreement.
MANAGEMENT FUNCTION. 34.01 It is agreed that the Company shall have all the usual and normal rights and functions of management, including: (i) All rights to manage the business of the Company including the right to plan, direct and control the Company’s operations and to direct the working force; (ii) The right to maintain and improve the efficiency of the operation; (iii) The right to hire; (iv) The right to discipline, demote, suspend or discharge Employees for just and sufficient cause, and to promote, transfer or lay off Employees; provided that none of the foregoing powers, rights, or functions shall be exercised by the Company so as to be in contravention or violation of any specific provision or provisions as set forth in this Agreement.
MANAGEMENT FUNCTION. ‌ 27.01 The Union recognizes that the Management of the Plant and direction of the working forces are fixed exclusively in the Employer, and without restricting the generality of the foregoing, the Union acknowledges that it is the exclusive function of the employer to: a) Maintain order and efficiency, b) Hire, retire, discharge, direct, classify, transfer, lay-off, recall and suspend or otherwise discipline employees, provided that if an employee has been discharged or disciplined without just cause, a grievance may be filed and dealt with in accordance with the Grievance Procedure. c) Make and enforce and alter from time to time rules and regulations to be observed by the employees. d) Determine the nature and kind of business conducted by the Employer, the kinds and locations of equipment and materials to be used, the control of materials and parts, the methods and techniques of work, the schedules of work, number of personnel to be employed, the extension, limitation, curtailment or cessation of operations, and to determine all other functions are prerogatives hereinbefore vested in and exercised by the Employer which shall remain solely with the Employer except as specifically limited by the express provisions of this Agreement. 27.02 The Employer agrees that any exercising of these rights and powers in conflict with any provisions of this Agreement may be subject to the provisions of the Grievance Procedure.

MANAGEMENT FUNCTION. 2.1 The management of the plant and the direction of the working forces, including the right to direct, plan and control plant operations, and to schedule working hours and the right to hire, promote, demote, transfer, suspend, discharge, release or lay off employees, or the right to introduce new and improved methods or facilities, and to manage the plant in the traditional manner, is vested exclusively in the Company. The exercise by the Company of any of the foregoing rights shall not alter any of the specific provisions of this Agreement, including the right of the employee to grieve as hereinafter provided.

MANAGEMENT FUNCTION. 2.01 The Union acknowledges that it is the exclusive function of the Company to manage the enterprise in which it is engaged. 2.02 Without in any way restricting the generality of the foregoing, the Union further acknowledges that, subject to the terms of this Agreement, it is the exclusive function of the Company to: a) maintain order, discipline and efficiency; b) hire, retire at age 65 or older, lay-off and recall, classify, direct, transfer, promote, demote or otherwise discipline or discharge employees provided that a claim by an employee who has completed the probationary period, that he/she has been disciplined or discharged without just cause or otherwise dealt with contrary to the provisions of this Agreement, may be made the subject of a grievance in the manner and to the extent as provided herein; c) to maintain and enforce reasonable rules and regulations to be observed by employees.
