Materials and Samples a) The materials/products used on the works shall be one of the approved make/ brands out of list of manufacturers / brands /makes given in the tender documents or shop drawings submitted or as approved in the Detailed Engineering or shop drawings submitted after the award of Work. The contractor shall submit samples/ specimens out of approved makes of materials/ products to the Employer/ Employer’s Engineer for prior approval. In exceptional circumstances Employer/ Employer’s Engineer may allow alternate equivalent makes/brands of products/ materials at his sole discretion. The final choice of brand / make shall remain with the Employer/ Employer’s Engineer, whose decision in this matter shall be final and binding and nothing extra on this account shall be payable to the Contractor. In case single brand/ make are mentioned, other equivalent makes/ brands may be considered by the Employer/ Employer’s Engineer. In case of variance in CPWD/IS/BIS Specifications from approved products/makes specification, the specification of approved product/make shall prevail for which nothing shall be paid extra to the Contractor. In case no make or brand of any materials, articles, fittings and accessories etc. is specified, the same shall comply with the relevant Indian Standard Specifications and shall bear the IS/BIS mark. The Employer’s Engineer and the Employer shall have the discretion to check quality of materials and equipments to be incorporated in the work, at source of supply or site of work and even after incorporation in the work. They shall also have the discretion to check the workmanship of various items of work to be executed in this work. The contractor shall provide the necessary facilities and assistance for this purpose. b) The above provisions shall not absolve the contractor from the quality of final product and in getting the material and workmanship quality checked and approved from the Employer/ Employer’s Engineer. c) The contractor shall well in advance, produce samples of all materials, articles, fittings, accessories etc. that he proposes to use and get them approved in two sets duly signed and in writing by Employer. The materials articles etc. as approved shall be labelled as such and shall be signed by Employer and the Contractor's representative. Materials and Samples. The Contractor shall submit samples of goods and materials, and relevant information, in sufficient time for UNICEF and/or the Engineer to review the samples. Each sample shall be labelled as to origin and intended use in the Works. All materials used in the course of these Works shall be new, proper for their use and fit for their intended purpose. No goods or materials from the Site shall be re-used unless permitted by the Engineer. All other goods and materials intended for inclusion in the Works shall be stored on Site until issue of the Certificate of Substantial Completion in accordance with clause 6.1 or if required to correct Defects or complete outstanding Works during the Defects Liability Period, until issue of the Certificate of Final Completion in accordance with clause 6.4. All materials, equipment and products shall be stored and installed in accordance with the written recommendations of the manufacturer.

If any of the free materials should be lost, destroyed or damaged, the Supplier shall apply all monies received under such insurance policies in respect of such loss, destruction or damage in or towards the replacement or repair of the lost, destroyed or damaged free materials. 16.3 Ownership of and title to the free materials shall at all times and for all purposes vest solely in Network Rail. The Supplier shall ensure that all free materials are properly labelled as the property of Network Rail, and kept separate from any materials owned or in the possession of the Supplier or any materials supplied to it by persons other than Network Rail. In the event of the Contract allowing the Supplier to mix such materials with other materials, no goods or items incorporating such materials shall be vested in any third party without Network Rail’s prior written consent. 16.4 If any samples, patterns, gauges, jigs, tools, dies, drawings, templates, materials or other items are supplied to the Supplier by Network Rail for use in connection with the Contract, they will be sent to the Supplier carriage paid and, when requested by Network Rail, the Supplier shall return them carriage paid to the address notified by Network Rail. The Supplier shall be responsible for their safe custody and return and for any loss of or damage to them howsoever caused (excepting only fair wear and tear).
