MINIMUM BREAKS BETWEEN SHIFTS. 31.1 Unless otherwise agreed, Employees must receive a minimum break of eight (8) hours between shifts, or ten (10) hours between broken shifts, rostered on consecutive days. 31.2 Where the Employee has not been provided with the appropriate breaks between shifts and the Employee’s next rostered shift is due to commence, the Employee will be released either before the end of the current shift or the start of the following shift so they have the appropriate break without loss of pay.

MINIMUM BREAKS BETWEEN SHIFTS a. Unless otherwise agreed, Nurse / Midwife Caregivers must receive a minimum break of eight hours between shifts. b. Nurse / Midwife Caregivers must not work more than two quick shifts within a period of seven days. A quick shift is an evening shift which is followed by a morning shift. c. Where a Nurse / Midwife Caregiver has not been provided with the appropriate break between shifts and the Nurse / Midwife Caregiver's next rostered shift is due to commence: i. without loss of pay the Nurse / Midwife Caregiver will be released either before or after their shift so they have the appropriate break; or ii. if the Nurse / Midwife Caregiver agrees to work without the appropriate break, the Nurse / Midwife Caregiver will be paid until they are released from duty at overtime rates as set out in clause F9. iii. Once released from duty the Nurse / Midwife Caregiver will be entitled to be absent from work until they have had their appropriate break without loss of pay for the working time occurring during such an absence.

Where an employee, other than a casual employee, works so much overtime between the termination of their ordinary shift on any day and the commencement of their ordinary shift on the next day, such that they have not had at least 10 consecutive hours off duty between those times, the employee will be released after the completion of such overtime until they have had 10 consecutive hours off duty without loss of pay for rostered ordinary hours occurring during such absence. If on the instructions of Fresh Hope Care, the employee resumes or continues work without having had 10 consecutive hours off duty, the employee will be paid at the rate of double time as set out in Clause H until they are released from duty for such rest period and they will then be entitled to be absent until they have had 10 consecutive hours off duty without loss of pay for rostered ordinary hours occurring during such an absence.

The minimum break provisions will not apply where a part time Caregiver agrees to work additional hours with less than an eight hour break. c. A Caregiver required to work overtime following on the completion of their normal shift for more than two hours must be allowed twenty minutes for the partaking of a meal and a further twenty minutes after each subsequent four hours of overtime. All such time must be counted as time worked; provided that benefits of this subclause must not apply to permanent part time Caregivers, until the expiration of the normal shift for a majority of the full time Caregivers employed on that shift in the xxxx or section concerned. d. A Caregiver who works overtime at the end of their rostered shift should be released for at least 10 consecutive hours off duty without loss of pay for ordinary working time that occurs during this break e. If the Employer instructs the Caregiver to work without ten hours off duty following overtime, the Caregiver will be paid at the rate of double time until the Caregiver is released from duty for such a period.
MINIMUM BREAKS BETWEEN SHIFTS. In the interests of health and safety, Employees will be given a break of at least 10 hours between shifts. If, at the time an Employee finishes a shift, he or she is rostered to work their next shift within 10 hours, the Employee will be released from working that part of their next shift which falls within the 10 hour break without loss of pay

  • Minimum Break between Shifts (a) Where it is necessary to work extended overtime, it is agreed that no Employee shall resume or continue to work without having had ten consecutive hours off duty between the termination of the overtime and the commencement of the Employee’s ordinary work on the next day or shift. (b) In the event that an Employee agrees to a request from site management to resume or continue to work without having had ten consecutive hours off duty, the Employee shall be paid at double ordinary time rates until the Employee is released from duty for such period.

  • Time Off Between Shifts Failure to provide the minimum number of hours between the commencement of an employee's scheduled shift and the commencement of such employee's next scheduled shift shall result in payment of one and one-half (1½) times the employee's regular straight time hourly rate for only those hours which reduce the minimum hour period. Where the minimum period is reduced as a result of an approved change of shift(s) requested by the employee(s), such premium payment shall not apply. The minimum number of hours for purposes of this Article shall be determined locally and will be set out in the Local Provisions Appendix.

  • Rest Between Shifts Article 7.10 of the Agreement applies in its entirety, except that the length of the rest period shall be eight (8) hours rather than eleven (11) hours, and beginning September 1, 2020, shall be ten (10) hours, rather than twelve (12) hours.

  • Broken Shifts (a) An employee may agree to work broken shifts at any time; however an employee may be required to work broken shifts in the following circumstances: (i) in homecare; or (ii) in an emergency – including staff absence; or (iii) up to and including a 4 week continuous period for circumstances other than those covered by subclauses 14.4(a)(i) and (ii). (A) Where an employee has served a period of broken shifts in accordance with subclause (iii) the employee shall not be required to serve a further period on broken shifts until he or she has been off broken shifts for a period equivalent to the previous period on broken shifts. (b) A “broken shift” for the purposes of this sub-clause means a single shift worked by an employee that includes one or more breaks in excess of that provided for meal breaks, where the time between the commencement and termination of the broken shift shall not exceed 12 hours. (c) An employee must receive a minimum break of 10 hours between broken shifts rostered on successive days. (d) Where broken shifts are worked, employees shall receive the per shift allowance set out in Item 1 of Table 2 of Schedule B to this Agreement. (e) Payment for a broken shift shall be at ordinary pay with penalty rates and shift allowances in accordance with Clause 18 - Shift and Weekend Work, with shift allowances being determined by the commencing time of the broken shift. (f) All work performed beyond the maximum span of 12 hours for a broken shift will be paid at double ordinary pay.

  • Minimum Balance Xxxxxxxx agrees to maintain a minimum balance of funds in the Settlement Account as Processor may specify to Merchant in writing from time to time.

  • General Availability The commitment to availability specified in the letter of appointment shall be subject to mutually acceptable revision. Such revision will occur once per year, or, if mutually agreed between the Employer and the employee, on a more frequent basis. The Employer will issue a revised letter of appointment to reflect approved changes to employee’s general availability.
