NON-DISCRIMINATION/AFFIRMATIVE ACTION. There shall be no discrimination in the application of provisions of this Agreement. In recognition of such, the parties are committed to ensure these provisions are applied equally to all employees without regard to race, color, religion, disability, gender, marital status, sexual orientation, age or national origin and in a manner consistent with the stated Affirmative Action Policy of the District. Finally, the parties agree no employee covered by this Agreement shall suffer discrimination because of membership and participation in the Association.

The intent of this Section is to continue efforts to provide equal employment opportunity for all persons and to establish methods for the resolution of equal employment problems. Further, the intent is designed to meet the spirit and letter of the Federal Civil Rights Laws, Executive Orders and Amendments, and the State of California Fair Employment Practices Act. No employee shall suffer discrimination because of his/her membership in the Union or participation in Union activities.

This Agreement is subject to the requirements of the U. S. Department of Transportation’s Regulations, 49 CFR part 23, as amended. NON-DISCRIMINATION/AFFIRMATIVE ACTION. 37.01 There shall be no discrimination in the application of the terms of this agreement on the basis of age, sex, race, color, marital status, sexual orientation religion, pregnancy national origin, ancestry, disability, cancer-related medical condition, or veterans status or any other basis prohibited by State or Federal Law.
