Notice of Termination by Employees. The notice of termination required to be given by an employee will be the same as that required for the company, save and except that there will be no additional notice based on the age of the employee concerned. If an employee fails to give notice the company will have the right to withhold monies due to the employee with a maximum amount equal to the ordinary time rate of pay for the period of notice.

(c) Unless otherwise agreed between the Company and an employee where a weekly employee has given or been given notice as aforesaid he or she shall continue in employment until the date of expiration of such notice. An employee having been given notice as aforesaid who absents himself or herself without reasonable cause (proof whereof shall lie upon him or her) from work during such period shall be deemed to have abandoned his/her employment and shall not be entitled to payment for work done within such period of notice.

36.4.3 Where an employee has given or been given notice as aforesaid or payment made in lieu of the prescribed notice, unless otherwise agreed between the employer and the employee, the employee shall continue in employment until the date of expiration of such notice. An employee having been given notice as aforesaid who absents them self from work during such period without reasonable cause (with the onus of proof being on the employee) shall be deemed to have abandoned their employment and shall not be entitled to payment for work done within such period of notice.

Notice of Termination by Employees. (a) The notice of termination required to be given by a full-time and part-time Employee shall be 4 weeks, unless it is in their probation period in which case the notice will be 1 week (probation is the first 6 months of employment).
(b) If the Employee fails to give the required period of notice, GenesisCare may, to the extent permitted by law, withhold from any wages due to the Employee on termination, an amount not exceeding the amount the Employee would have been paid in respect of a period of notice required by this clause 44, less any period of notice actually given by the Employee.
Notice of Termination by Employees. 45.5.1 The notice of termination required to be given by an Employee is the same as that required by the Employer, save and except that there is no requirement on an Employee to give additional notice based on their age.
45.5.2 Where the Award confers a right on the Employer to withhold wages or entitlements for notice not provided by an Employee, this Clause shall apply. If an Employee fails to give the required notice, the Employee agrees that the Management has the right to withhold or deduct from any monies owed to the Employee:
(a) an amount equal to the notice period not given, and
(b) does not reduce any entitlement to paid leave as defined by the NES or the minimum Standards in the Act.
Notice of Termination by Employees. An employee shall be required to give one week’s notice or forfeit a week’s wages for the termination of employment.
