OVERTIME Continued. 4.02 In case of absenteeism of an Employee, said Employee shall be entitled to overtime rates only after the forty (40) hours in any one (1) week, unless they can establish to the satisfaction of the Employer the merits of their absenteeism. If there is a holiday or a reduction in regular work hours in any one (1) week, the number of hours involved shall be deducted from the forty (40) hours for the purpose of the present paragraph.

OVERTIME Continued. 4.02 When emergency calls are made the Employee shall be paid at the overtime rates from the time they leaves home until they return thereto. The minimum payment for such work shall equal no less than four (4) hours time at the regular rates, whichever is the greatest.

OVERTIME Continued. 17.05 All other regular employees covered by this Agreement may elect to take time off in lieu of payment for overtime worked, to a maximum of ten (10) working days. No payment shall be made for overtime hours worked by an employee who elects to take time off in lieu of overtime worked, but such overtime will be accumulated at the appropriate overtime rate. The accumulated overtime hours shall be taken as time off with pay as mutually agreed between the employee and the appropriate Manager or his/her designate. No accumulation of overtime hours shall be carried beyond six (6) months. If, because of work load or scheduling requirements, the Department is unable to permit an employee to take sufficient time off to equal the accumulated overtime hours, payment for any accumulation of overtime hours remaining to an employee’s credit past the six (6) months will be paid as soon as possible and will be at the rate of pay in effect during which the hours were worked. Any hours used for time off will be considered to have been taken off in the same sequence as worked (i.e. “first-in, first-out” basis).
