Sick Leave Payment. Any employee, at his/her option may choose to receive payment for sick leave earned during the year which is unused at the end of the year. Any such payment must be for the total number of unused sick leave hours earned during the year, must be based on the hourly rate of pay of the employee multiplied by 50 percent, and all hours for which payment is received must be deducted from the employee’s accumulated leave balance. Sick leave used during a current year will be charged against the most recently earned sick leave. Hourly rate of pay is the hourly rate at the end of the contract year.
Sick Leave Payment. (a) The District shall for all Regular Full-time and Regular Part-time employees who have completed three (3) months continuous employment, subject to the conditions as set forth herein:
(i) Pay the employee 90% of full pay at the employee’s regular basic rate commencing with the first working day of disability due to hospitalization as an in-patient or as an out-patient for non-elective day surgery requiring spinal or general anaesthetic (upon request, the employee shall provide verification to the satisfaction of the District), up to a maximum of one hundred and eighty (180) calendar days.
(ii) For Regular Full-time employees in Outside Positions, pay the employee 90% of full pay at the employee's regular basic rate commencing with the thirteenth working hour of disability, up to a maximum one hundred and eighty (180) calendar days.
(iii) For Regular Full-time employees in Inside Positions, pay the employee 90% of full pay at the employee's regular basic rate commencing with the eleventh working hour of disability, up to a maximum one hundred and eighty (180) calendar days.
(iv) For Regular Part-time employees, pay the employee 90% of full pay at the employee's regular basic rate commencing with the tenth working hour of disability, up to a maximum one hundred and eighty (180) calendar days.
(v) Employees on sick leave payment of less than 100% as outlined above shall be permitted, upon request, to use banked time to supplement their pay to 100%.
(b) On January 1 of each year Regular employees actively at work, shall receive banked time as follows (employees on vacation/banked time absences are considered 'actively at work'):
(i) Regular Full-time employees who regularly work 8 hour days - 24 hours
(ii) Regular Full-time employees who regularly work 7 hour days - 21 hours
(iii) Regular Part-time employees - 18 hours
(iv) Employees who become Regular after January 1, or who return to 'actively at work' status, shall receive banked time as follows: - full allotment on becoming a Regular or active in the first quarter - two-thirds allotment on becoming a Regular or active in the second quarter - one third allotment on becoming a Regular or active in the third quarter
(c) When an absence due to a disability exceeds three (3) working days, the employee shall, if requested, furnish the District with proof to its satisfaction that the employee was and or is totally disabled and is prevented continuously from performing any and every duty of any occupation, and ...
Sick Leave Payment. Sick leave credits may only be used for illness (subject to 20.01) or in accordance with the Wellness Incentive Plan Letter of Agreement. In the event that an employee's absence exceeds their accumulated sick credits, the employee may borrow up to a maximum of ten (10) days against future earned sick leave provided that a qualified medical practitioner certifies that the employee is seriously ill, that the nature of the illness is specified, and that the employee's request for leave is submitted in writing. The borrowed leave entitlement shall be limited to the amount of benefits that the employee would otherwise be entitled to under the Employment Insurance Act. In the event that an employee's absence exceeds this amount, the employee will be placed on leave of absence without pay for the duration of the illness or twelve (12) months whichever occurs first. After twelve (12) months and within ninety (90) days thereof the employee may request his/her name to be placed on the Recall List. Where the leave is expected to exceed six (6) months, the Union will agree to an appointment as per Article 3.07 (Leave Replacement Employee).

Employees Retirement System shall be paid for unused sick leave under the following formula: Days Accumulated at Retirement x Rate Maximum Available Days 0-80 $0 $0 Days 81-110 $35.00 per day $1,050.00 Days 111-150 $40.00 per day $1,600.00 Days 151-180 $45.00 per day $1,350.00 Days 181-210 $45.00 per day $1,350.00 The total amount to be paid shall not exceed $5,350.00.
Sick Leave Payment. The following Sick Leave Payment Schedule will be applied for all bargaining unit employees. Years of service for this section shall be determined by the bargaining unit employee’s current hire date combining BSO time with any Contract City time, and any time in the DROP Plan (excluding any break in service). “

Employees shall not be required to use more than half of their accrued vacation time, however, or be required to draw down vacation time in such a way that it would interfere with vacation time already bid and scheduled. Employees who would otherwise qualify for short term disability while on FMLA/CFRA leave will not qualify for that disability until all of the employee’s sick leave is exhausted. Employees shall receive sick leave with pay up to the amount of sick leave accrued at the time of illness, provided the requirements of this are met. Employees shall accrue sick leave credits during the probationary period; however, they shall not be eligible for sick leave pay until ninety (90) calendar days after their date of hire.
a. An employee who is absent from work for reasons that qualify for use of sick leave under this Agreement, or state or federal law who has no accumulated sick leave to cover such absence must use accumulated vacation or personal holiday, before unpaid leave may be granted. The employee must advise the employee’s appropriate absence report recipient, as designated by eBART, of the category of paid leave that shall be charged for such absence. If the employee does not do so, the absence shall be charged by default against the employee’s accumulated vacation, holiday, and compensatory time off, in that order. Employees shall be eligible for paid sick leave as follows, without limitation on their rights under state and federal law:
1. Illness, including the appropriate use of required prescribed medication which would impair the employee’s work performance, injury, quarantine, or similar exposure to contagious disease;
2. Verifiable medical and/or dental appointments which cannot be scheduled outside the normal working hours, provided that a minimum of forty-eight (48) hours advance notice is given and provided subsequent confirmation that the appointment was kept is given if requested by Management;
3. Doctor’s visits associated with pregnancy, subject to the provisions in “2” above;
4. Hospitalization or serious illness/accident and resulting subsequent related scheduled doctor’s visits, subject to the provisions in “2” above;

Sick Leave Payment. 15.01 The Corporation's sick pay plan for regular employees was created by the Corporation to reduce the financial hardship that bona fide illness can create so far as inability to work and the consequent loss of normal wages are concerned.
15.02 To qualify for payment of sick pay, an employee must:
(a) have an established credit for sick pay;
(b) ensure that his/her illness is reported to management as soon as possible;
(c) be suffering from a bona fide illness which prevents his/her useful employment and is not compensable under the Worker’s Compensation Act;
(d) submit written verification of illness signed by a qualified doctor of medicine if requested or if absent for three (3) days or more;
(e) submit to medical examination by a doctor of medicine designated by management upon request;
(f) do everything possible to speed his/her recovery.
15.03 Payments under the Sick Leave Plan will be in accordance to its terms while the employee is disabled until the earlier of:
(a) the employee returns to work; or
(b) the employee retires, either at the normal retirement age or opts to retire early; or
(c) the employee exhausts his/her entitlements under the plan; or
(d) the employee qualifies for long term disability coverage; or
(e) the employee dies; or
(f) the employee resigns.
15.04 A short term disability is defined as a period of disability resulting from illness or injury as determined by a qualified doctor of medicine that prevents an employee from attending to his/her regular work and extends for a period of not more than eighteen (18) weeks or ninety (90) days of work. For a period greater than this, the employee will utilize coverage under his/her Long Term Disability Plan.
