Payment for Additional Utilities and Services. (a) Upon request by Tenant in accordance with the procedures established by Landlord from time to time for furnishing HVAC service at times other than Business Hours on Business Days, Landlord shall furnish such service to Tenant and Tenant shall pay for such services on an hourly basis at the then prevailing rate established for the Building by Landlord. (b) If the temperature otherwise maintained in any portion of the Premises by the HVAC systems of the Building is affected as a result of (i) any lights, machines or equipment used by Tenant in the Premises, or (ii) the occupancy of the Premises by more than one person per 150 square feet of rentable area, then Landlord shall have the right to install any machinery or equipment reasonably necessary to restore the temperature, including modifications to the standard air-conditioning equipment. The cost of any such equipment and modifications, including the cost of installation and any additional cost of operation and maintenance of the same, shall be paid by Tenant to Landlord upon demand. (c) If Tenant's usage of electricity, water or any other utility service exceeds the use of such utility Landlord determines to be typical, normal and customary for the Building, Landlord may determine the amount of such excess use by any reasonable means (including the installation at Landlord's request but at Tenant's expense of a separate meter or other measuring device) and charge Tenant for the cost of such excess usage. In addition, Landlord may impose a reasonable charge for the use of any additional or unusual janitorial services required by Tenant because of any unusual Tenant Improvements or Alterations, the carelessness of Tenant or the nature of Tenant's business (including hours of operation).

Payment for Additional Utilities and Services. (a) If, at Tenant’s request, Landlord elects to furnish HVAC service to office space tenants of the Project at times other than Minimum HVAC Hours on business days, then, upon request by Tenant in accordance with the procedures established by Landlord from time to time for furnishing such HVAC service, Landlord shall furnish such service to Tenant and Tenant shall pay for such services on an hourly basis at the then prevailing rate established for the Building by Landlord. (b) If the temperature otherwise maintained in any portion of the Premises by the HVAC systems of the Building is affected as a result of (i) any lights, machines or equipment used by Tenant in the Premises, or (ii) the occupancy of the Premises by more than one person per 150 square feet of rentable area, then Landlord shall have the right to install any machinery or equipment reasonably necessary to restore the temperature, including modifications to the standard air-conditioning equipment. The cost of any such equipment and modifications, including the cost of installation and any additional cost of operation and maintenance of the same, shall be paid by Tenant to Landlord thirty (30) days after receipt of invoice sufficiently establishing such cost. (c) If Tenant’s usage of electricity, water or any other utility service exceeds the use of such utility Landlord determines to be typical, normal and customary for the office portion of the Project, Landlord may determine the amount of such excess use by any reasonable means (including the installation at Landlord’s request but at Tenant’s expense of a separate meter or other measuring device) and charge Tenant for the cost of such excess usage. In addition, Landlord may impose a reasonable charge for the use of any additional or unusual janitorial services required by Tenant because of any unusual Tenant Improvements or Alterations, the carelessness of Tenant or the nature of Tenant’s specific use or occupancy of the Premises (including hours of operation). In no event shall Tenant’s usage of electrical power exceed 100 amps. Without the prior written consent of Landlord, which consent Landlord shall not unreasonably withhold, Tenant shall not connect or use any apparatus or device in the Premises using current in excess of 110 volts.
Payment for Additional Utilities and Services. (a) Upon request by Tenant in accordance with the procedures established by Landlord from time to time for furnishing heating, ventilation and air conditioning service at times other than Business Hours on Business Days, Landlord shall furnish such service to Tenant and Tenant shall pay for such services on an hourly basis at the then prevailing rate established for the Building by Landlord. As of the date of this Lease, the prevailing rate for furnishing heating, ventilation and air-conditioning service at times other than Business Hours on Business Days is $250.00 per hour which rate may be changed from time to time in Landlord’s sole discretion. As of the date of this Lease, the (i) overtime engineering labor is $115.00 per hour, with a four hour minimum for call-backs, and (ii) overtime security is $40.00 per hour for times other than Business Hours on Business Days, all subject to change from time to time in Landlord’s sole discretion. Overtime security is required during Tenant move-in. (b) If the temperature otherwise maintained in any portion of the Premises by the HVAC systems of the Building is affected as a result of (i) any lights, machines or equipment used by Tenant in the Premises, or (ii) the occupancy of the Premises by more than one person per 200 square feet of rentable area, then Landlord shall have the right to install any machinery or equipment reasonably necessary to restore the temperature, including modifications to the standard air-conditioning equipment. The cost of any such equipment and modifications, including the cost of installation and any additional cost of operation and maintenance of the same, shall be paid by Tenant to Landlord upon demand. Landlord will allow Tenant to increase its space utilization to 100 square feet per person, provided that such increased density does not: (A) impose, create or result in any material additional demand or requirements or any material adverse effect on the HVAC, life safety, lighting or electrical systems of the Building or on any other Building System; (B) increase the insurance premiums on any insurance carried by Landlord, unless Tenant pays the entire amount of such increased cost; or (C) violate any applicable Law. Lessee shall pay for heat and air-conditioning furnished at Lessee's request during non-Business Hours on an hourly basis at one hundred percent (100%) of the actual cost charged by the utility for such services, including without limitation the cost of providing such services to the other parts of the Project which are heated or air-conditioned in common with the Premises. In the event Lessee's use of electricity, water or any other utility exceeds the Project Standard use of such utility, Lessor may determine the amount of such excess use by any reasonable means (including, but not limited to, the installation at Lessor's request but at Lessee's expense of a separate meter, submeter or other measuring device) and charge Lessee for the cost thereof. In addition, Lessor may impose a reasonable charge for the use of any additional or unusual janitorial services required by Lessee because of any above-Project Standard tenant improvements in the Premises, the carelessness of Lessee or the nature of Lessee's business (including hours of operation). C. All sums payable hereunder by Lessee for additional services or for excess utility usage shall be payable as Additional Rent within ten (10) days after notice from Lessor of the amounts due; except that Lessor may require Lessee to pay monthly for the estimated cost of Lessee's excess utility usage if such usage occurs on a regular basis, and such estimated amounts shall be payable in advance on the first day of each month.

Payment for Additional Utilities and Services. Section 11.2(e) of the Lease is hereby amended by adding the following sentence at the end thereof: “The specific janitorial services being provided by Landlord in connection with the Lease are attached hereto and incorporated herein by this reference as Exhibit G.” Exhibit E attached hereto shall serve hereinafter as Exhibit G to the Lease.

Payment for Additional Utilities and Services. (a) If the temperature otherwise maintained in any portion of the Premises by the HVAC systems of the Building is affected as a result of (i) any lights, machines or equipment used by Tenant in the premises other than reasonable and customary numbers and types of general office equipment customarily used in the conduct of general office activities, or (ii) the occupancy of the Premises by more than one person per 150 square feet of rentable area, then Landlord shall have the right, in consultation with Tenant, to install any machinery or equipment reasonably necessary to restore the temperature, including modifications to the standard air-conditioning equipment. The reasonable cost of any such equipment and modifications, including the reasonable cost of installation and any additional cost of operation and maintenance of the same, shall be paid by Tenant to Landlord within thirty (30) days after Landlord’s written request therefore. (b) As part of the Tenant Improvements, Tenant shall separately meter or submeter the consumption of all utilities to the Premises and Tenant hereby agrees to pay, in the case of those utilities which are separately metered, all utilities charges, as and when due and payable, to the utility provider and in the case of those utilities which are separately submetered, to pay to Landlord, when invoiced by Landlord, all changes associated with such submetered utilities.
Payment for Additional Utilities and Services. (a) Tenant shall pay directly to the utility company for all electricity and gas used on or from the Premises, which utilities are separately metered, and any maintenance charges from the utility company. In addition, Tenant shall pay for all heat, water, telephone, and any other utilities and services used on or from the Premises, together with any taxes, penalties, and surcharges or the like pertaining thereto and any maintenance charges therefor. (b) If the temperature otherwise maintained in any portion of the Premises by the HVAC systems of the Building is affected so as to have a material adverse impact on the Building and/or any system therein, as a result of (i) any lights, machines or equipment used by Tenant in the Premises, or (ii) the occupancy density of the Premises then Tenant shall install any machinery or equipment reasonably necessary to restore the temperature, including modifications to the standard air-conditioning equipment. The cost of any such equipment and modifications, including the cost of installation and any additional cost of operation and maintenance of the same, shall be paid by Tenant.
Payment for Additional Utilities and Services. Tenant shall not, without the prior consent of Landlord, connect to any dedicated electrical circuit in the Premises electrical apparatus or equipment of any type having in the aggregate electrical power requirements in excess of two amps per outlet. Notwithstanding Landlord's consent to such excess loading of circuits, Tenant shall pay the cost of any additional or above-standard capacity electrical circuits necessitated by such excess loading circuits and the installation thereof.
