Pro Shop. Operator may operate a pro shop on the Golf Course Property. Sales at the shop may include, but are not limited to, merchandise, golf equipment, cart rentals, and equipment rentals.
Pro Shop. JSJ shall provide, maintain and operate at all times the Golf Courses are open and at such other times as JSJ deems appropriate, a pro shop at each Facility for the sale or lease of golf clubs and pull carts, and the sale of golf shoes, apparel, and golf accessories in an inventory amount which is reasonable and customary at public golf courses. JSJ shall have the right to retain the revenue generated from the pro shop.
Pro Shop. Tenant will provide a construction cost allowance of one million dollars ($1,000,000) (the “Construction Allowance”) for construction of a Pro Shop of approximately 2,200 rentable square feet, administrative space of approximately 1,000 rentable square feet , and storage space of 700 rentable square feet (collectively, the “Pro Shop Space”), which shall be constructed by Tenant for Landlord’s use in the hotel portion of the Improvements in accordance with Plans and Specifications approved by Landlord and pursuant to the Pro Shop Space Lease described below. If the actual and reasonable cost of the Pro Shop Space is greater than the Construction Allowance, Landlord will pay any amounts that exceed the Construction Allowance upon execution and commencement of the Pro Shop Space Lease (as defined below), or such excess shall be included in the rent for the Pro Shop Space. Notwithstanding the foregoing, in no event shall the cost of construction of the Pro Shop Space exceed an amount that is 10% greater than the Construction Allowance without prior agreement of the parties. Tenant will lease the Pro Shop Space to Landlord pursuant to a separate written lease agreement, wherein Tenant will be the landlord and Landlord will be the tenant (the “Pro Shop Space Lease”), and the rent structure in the Pro Shop Space Lease will include the requirement that Landlord pay rent on up to a 25% load factor for common spaces (in addition to the usable portion of the Pro Shop Space) (i.e., common area space such as elevators, corridors, and walkways). The rent structure for the Pro Shop Space Lease will be minimum base rent (“Base Rent”) plus triple net reimbursement for Tenant’s operating expenses allocable to retail space in the hotel on a pro-rata basis, based on the ratio of the Pro Shop Space leased to Landlord, over the total Building space in the Building in which the Pro Shop Space Lease is located. The term of the Pro Shop Space Lease will be for a minimum ten (10) year term and rent for the Pro Shop Space Lease will commence no later than three (3) months after substantial completion of the Pro Shop Space, or its occupancy, whichever comes first.. Pro Shop. A Manager will continue the present practice re: bargaining unit work, (i.e. up to nine (9) hours, Monday to Friday). Scheduling of the Manager will not reduce the number of hours of bargaining unit employees during the winter season (i.e. 1st day after Labour Day until the beginning of the May long weekend).
Pro Shop. Operation of pro shop, including such activities as ordering and stocking merchandise such as golf apparel, golf clubs, balls, tees and other equipment attractive to golfers, displaying, pricing and selling merchandise, cleaning and repairing of golf clubs and other golf equipment and providing other services customarily available at a golf pro shop.
Pro Shop. As an independent contractor, Xxxxxx shall compensate the City $5,696.73 annually for use of space and certain fixtures in order to operate a Pro Shop at Pokegama Golf Course, including sale of golf merchandise, club rental, storage, cleaning and repair, and golf instructional lessons. City and Cahill may mutually agree that revenues from Pro Shop sales and services shall be collected through City's cash register. City shall then reimburse Xxxxxx for cash proceeds received by City from Pro Shop sales, provided that City shall not be obligated to reimburse Cahill for checks which are not honored and paid or charge sales, including credit card charges, for which City does not receive cash payment. Income received by Xxxxxx from operation of the Pro Shop is not income from City employment. City shall not be obligated to withhold federal or state income taxes, FICA, PERA, or any other payroll withholdings from said income. Xxxxxx shall hold harmless, indemnify and defend City against any and all claims, damages, losses or judgments against City arising out of merchandise sold or services provided by Xxxxxx through the Pro Shop. Xxxxxx shall obtain and keep in force a policy of comprehensive general liability insurance, which policy shall name City as an additional insured, with limits of liability not less than City's maximum limits of liability as set forth in Minn. Pro Shop. There is a 5 1/2 inch step at the public entrance to the pro shop making it inaccessible to persons using a wheelchair. Provide access to the pro shop via the use of a ramp or platform lift in compliance with the Standards.
