Design Development Stage. 9.3.1 Based on the approved Schematic Design documents and any adjustments to the Program of Requirements, BIM Execution Plan or Amount Available for the Construction Contract authorized by the Owner, the Contractor shall prepare Design Development documents derived from the model(s) in accordance with Owner’s written requirements to further define and finalize the size and character of the Project in accordance with the BIM Execution Plan and “Facility Design Guidelines” and prepare a detailed Estimated Construction Costs and submit them to the Owner for approval. The Design Development Documents shall fix and describe the size and character of the entire Project, including site work, architectural, structural, mechanical and electrical systems, materials and such other elements as may be appropriate. The detailed Estimated Construction Costs shall confirm adherence to the Amount Available for the Construction Contract.
Design Development Stage. 5.1. Upon engagement, the Performance Assurance Contractor, hereby referred to as “PAC”, shall review and submit comments as it relates to the Performance Assurance Program, the Design Professionals’ Design Intent and Basis of Design, prior to 60% Design Development.
5.2. The PAC shall review and submit comments to the Design Team (DT) at 95% Design Development.
5.3. The PAC shall review and submit comments to the DT at 100% Issue For Bid (IFB)/Issue For Construction (IFC).
5.4. The PAC shall review and submit comments on the Sequence of Operations (SOO) with the Control Engineer.
5.5. The PAC shall submit PAC Specifications and Performance Assurance requirements to the Design Professional (DP) for inclusion into the Project Documents.
5.6. The PAC shall create, maintain, and update a Design Issues Log on design issues related to Performance Assurance. An NMPSFA approved Issues Log Template can be found on the NMPSFA Website (xxxxx://xxx.xxxxxx.xxx). If the PAC desires to use their own template, it must meet or exceed the intent of the NMPSFA Approved Template and be approved by NMPSFA prior to use.
5.7. The PAC shall create an equipment list to be witnessed, verified, and documented through the Performance Assurance Program for the project. An NMPSFA approved Equipment List Template can be found on the NMPSFA Website (xxxxx://xxx/xxxxxx.xxx). If the PAC desires to use their own template, it must meet or exceed the intent of the NMPSFA Approved Template and be approved by NMPSFA prior to use.
5.8. The PAC shall develop their Performance Assurance Plan to be maintained and updated through the Project.
5.9. The PAC shall develop a Performance Assurance Milestone Schedule.
5.10. The PAC shall develop Pre-Functional Checklists (PFC). NMPSFA approved PFC Templates can be found on the NMPSFA Website (xxxxx://xxx.xxxxxx.xxx). If the PAC desires to use their own template, it must meet or exceed the intent of the NMPSFA Approved Template and be approved by NMPSFA prior to use.
5.11. The PAC shall review and comment on the Test, Adjust, and Balance (TAB) testing requirements with the GC and TAB Contractor.
5.12. The PAC shall review and comment on Equipment Submittals as they pertain to the PAC’s Performance Assurance activities.
Design Development Stage. 5.2.4.1 Based on the approved Schematic Design documents and any adjustments to the Facility Program or Construction Cost Limitation or Project Schedule authorized by the Owner, the Design/Build Contractor shall prepare Design Development documents and shall review and update the Estimated Construction Cost and submit them to the Owner for approval. The Design Development documents shall fix and describe the size and character of the entire Project, including site work, architectural, structural, mechanical and electrical systems, materials and such other elements as may be appropriate. The Estimated Construction Cost shall confirm adherence to the Construction Cost Limitation. The Design/Build Contractor shall advise the Owner of any adjustments to the project scope necessary to align the Estimated Construction Cost with the Construction Cost Limitation and shall revise the Design Development documents, without charge to the Owner, as may be required to comply with the Construction Cost Limitation. The Owner may, solely at Owner’s discretion and in writing, increase or decrease the Construction Cost Limitation to align with the Design/Build Contractor’s Estimated Construction Cost.

Design Development Stage. 2.3.1 During the Design Development Stage, the AOR shall:
2.3.1.1 resolve all issues related to compliance with Applicable Law; and
2.3.1.2 provide recommendations on value engineering, constructability, logistics, site use and improvements, availability and suitability of materials, equipment, labor and systems, long-lead items, safety and security plans, quality control, time requirements for construction, and factors related to the cost of the Project including costs of alternative designs or materials, preliminary budgets and possible economies.
Design Development Stage. 5.2.4.1 Based on the approved Schematic Design documents and any adjustments to the Program or Construction Cost Limitation authorized by the Owner, the Design/Build Contractor shall prepare Design Development documents and a detailed construction cost estimate and submit them to the Owner for approval. The Design Development Documents shall fix and describe the size and character of the entire Project, including site work, architectural, structural, mechanical and electrical systems, materials and such other elements as may be appropriate. The detailed construction cost estimate shall confirm adherence to the Construction Cost Limitation

Design Development Stage. 4.1.1 Unless the Contracting Authority directs otherwise in writing, the Design Development Stage will begin upon completion of the activities described under Section 3.5.
Design Development Stage. 5.2.3.1 Based on the approved pre-design documents and any adjustments to the Program or Construction Cost Limitation authorized by the Owner, the Design/Build Contractor shall develop sufficient alternative approaches to design and construction of the Project and review them with the Owner. The Design/Build Contractor shall prepare Design Development documents and a detailed construction cost estimate, GMP submittal, and submit them to the Owner for approval. The Design Development Documents shall fix and describe the size and character of the entire Project, including site work, architectural, structural, mechanical and electrical systems, materials and such other elements as may be appropriate. The detailed construction cost estimate and GMP shall confirm adherence to the Construction Cost Limitation.
5.2.3.2 The Design/Build Contractor shall furnish and deliver to the Owner the number of complete printed sets of Design Development documents as required.
5.2.3.3 The Design/Build Contractor shall prepare presentation materials as described in Owner’s Design Guidelines at completion of Design Development and, if requested, present them at a Board of Regents meeting.
5.2.3.4 Before proceeding into the Construction Document Stage, the Design/Build Contractor shall obtain Owner’s written approval of the Design Development documents and the mutually established Construction Cost Limitation.
Design Development Stage. 5.2.4.1 The Design Development documents shall further define, finalize, and describe the size and character of the entire Project, including site work, architectural, structural, mechanical and electrical systems, materials and such other elements as may be appropriate.
5.2.4.2 The Design/Build Contractor shall prepare the Design Development Documents and such construction cost estimates in accordance with Subparagraph 5.1.3 and in alignment with the procurement and bid/proposal package strategies required under Subparagraph 5.1.5 above and this Subparagraph 5.2.4 (collectively referred to as the “Preliminary Design Development Approval Package”) and submit them to the ODSR for its initial review. Based on the Schematic Design Documents reviewed by the Owner (and approved for proceeding to the Design Development Stage) and any adjustments to the Owner’s Design Requirements, the Project CPM Schedule, or CCL authorized by the Owner, the Design/Build Contractor shall develop sufficient alternative approaches to design and construction of the Project and review them with the ODSR.
5.2.4.2.1 The Design/Build Contractor shall direct the preparation of such detailed construction cost estimates and reconciliations as required by Subparagraph 5.1.3 above to confirm compliance with the CCL and shall furnish such cost estimates within the time required in Subparagraph 5.1.3.
5.2.4.2.2 The Design/Build Contractor shall consult with the ODSR and recommend any value engineering adjustments that may be necessary to align the cost estimate and the project budget with the established CCL. The Design/Build Contractor shall revise the Design Development Documents as may be required to incorporate value engineering recommendations accepted by the ODSR.
5.2.4.2.3 The Design/Build Contractor shall make such revisions in the Design Development Documents as required herein and submit such revised Design Development Documents and the required cost estimates (collectively referred to as the “Design Development Submittal” package) to the ODSR first for review and then to the ODR for final approval for submission to the Board and the approval to proceed to the Construction Documents Stage.
