RELATIONSHIP WITH AWARDS. This agreement shall be read in conjunction with the award listed in clause 3. To the extent of any inconsistency between the award and this agreement, this agreement shall prevail. Where there is no inconsistency the award listed in clause 3 shall apply.

RELATIONSHIP WITH AWARDS. This Agreement regulates in total the terms and conditions of employment of employees covered by this Agreement. The parties to this Agreement intend it to be a comprehensive workplace agreement to replace all prior certified agreements, awards and Notional Agreements Preserving a State Award which may otherwise apply to the employees covered by this Agreement. Furthermore, this Agreement is intended to consolidate existing applicable awards and certified agreements into a single comprehensive document. Accordingly, this Agreement operates to the exclusion of all protected award conditions, any preserved award term and any protected notional condition, which may relate to Protected Matters. In this Clause, Protected Matters refers to provisions relating to any of the following matters: (a) rest breaks; (b) incentive based payments and bonuses; (c) annual leave loading; (d) observance of days declared by or under the law of any State or Territory to be observed generally within the applicable State or Territory, or a region of that State or Territory, as public holidays, and entitlements to payment in respect of those days; (e) days to be substituted for, or a procedure for substituting, days referred to above. (f) monetary allowances for: (i) expenses incurred in the course of employment; or (ii) responsibilities or skills that are not taken into account in relation to pay for employees; or (iii) disabilities associated with the performance of particular tasks or work in particular conditions or locations; (g) loadings for working overtime or for shift work (h) penalty rates; and (i) any terms that are incidental to, or are machinery provisions in respect of, matters listed above.
RELATIONSHIP WITH AWARDS a) The award that underpins this Agreement is the General Retail Industry Award 2020 (the Award).
RELATIONSHIP WITH AWARDS. This Agreement shall be read in conjunction with the following Awards: a. General Construction and Maintenance, Civil and Mechanical Engineering, &C. (State) Award; b. Clerical and Administrative Employees (State) Consolidated Award (Splinters 027 & 4214); and c. Metal, Engineering and Associated Industries (State) Award. Wherever there is inconsistency between this Agreement and the relevant Award, this Agreement shall prevail to the extent of the inconsistency.
RELATIONSHIP WITH AWARDS. 1. Subject to this clause, the provisions of the Metal Trades General Award are the provisions of this Agreement. 2. An express provision of this Agreement operates to the exclusion of the corresponding provision of the award. 3. Where there is an inconsistency between a provision of this Agreement and the award the provision of this Agreement prevails. 4. This Agreement operates to the exclusion of the Sheetmetal Workers Award to the extent it would otherwise apply.
RELATIONSHIP WITH AWARDS. This agreement shall be read in conjunction with the Grocery Products Manufacturing (State) Award, provided that this agreement will prevail over this award to the extent of any inconsistency.
RELATIONSHIP WITH AWARDS. Protected Award conditions as provided in the Wine Industry – AWU – Award and any other successor award or any other industrial instrument that may be otherwise applicable are hereby expressly excluded.

RELATIONSHIP WITH AWARDS. 4.1 This Agreement will apply to the exclusion of any and all modern awards that may cover or apply to the Employer and Employees; and replaces any previous enterprise agreements that may have applied.
RELATIONSHIP WITH AWARDS. This agreement shall be read and interpreted wholly in conjunction with the Clerical & Administrative Employees (State) Award, provided that where there is any inconsistency between this agreement and the Clerical & Administrative Employees (State) Award, this agreement shall take precedence to the extent of the inconsistency.
RELATIONSHIP WITH AWARDS. 1.7.1 This Agreement operates to the exclusion of all former state awards and federal awards that would otherwise apply to you, including but not limited to the Award listed below and any award that may succeed any of them: 1.7.2 During the operation of this Agreement you agree that: 1.7.3 Protected Allowable Award Matters are any provision of any applicable former state award or federal award concerning: (a) rest breaks; (b) incentive-based payments and bonuses; (c) annual leave loadings; (d) observance of days declared by or under a law of a State or Territory to be observed generally within that State or Territory, or a region of that State or Territory, as public holidays by employees who work in that State, Territory or region, and entitlements of employees to payment in respect of those days; (e) days to be substituted for, or a procedure for substituting, days referred to in paragraph (d); (f) monetary allowances for: (i) expenses incurred in the course of employment; or (ii) responsibilities or skills that are not taken into account in rates of pay for employees; or (iii) disabilities associated with the performance of particular tasks or work in particular conditions or locations. (g) loadings for working overtime or for shift work; (h) penalty rates; (i) outworker conditions; and, (j) any other matter specified in the Workplace Relations Regulations (Commonwealth) as varied from time to time. 1.7.4 To avoid doubt, this Agreement expressly excludes all Protected Allowable Award Matters.
