Responsibilities of the Artist. The Artist will perform their obligation and provide the services in full conformity with all requirements as outlined in this Contract and the Scale Agreement.
Responsibilities of the Artist. (a) The Artist will present the Performance during the Event on the Date/s and Time/s, and at the Venue, specified in items 2 and 3 of Schedule 1.
(b) The Artist must not do anything or enter into any contract or understanding which might be reasonably likely to cause the Artist not to be available as required under this Agreement.
(c) The Artist must at all times carry out its obligations under the Agreement to the best of its skill and ability, in a professional manner and the Artist will observe the lawful directions of the Venue made from time to time regarding working hours, rules or other matters.
(d) The Artist will be available to perform such technical checks as specified in item 7 of Schedule 1.
(e) The Artist will, at all times, be under the direction of the Venue or its representatives.
(f) The Artist will conduct the Performance in such a manner so as not to breach any law and will not cause the Venue to breach any of the conditions of the permits or consents that the Venue or the Artist have obtained.
(g) The Artist warrants that the Performance will not breach any third party intellectual property right, including copyright.
(h) The Artist agrees that the Venue may record and/or film, or arrange for the recording and/or filming of, the Performance, and that as between the Artist and the Venue, the Artist is the owner of the copyright in any such sound recording or film of the Performance, although the Venue may use any such sound recording or film of the Performance with the prior written consent of the Artist, such consent not to be unreasonably withheld.
(i) The Artist consents to any treatment of its copyright works embodied in any such sound recording or film, and any treatment of the Performance that is consistent with reasonable industry practice.
Responsibilities of the Artist. 4.1 The ARTIST agrees that an essential element of this Agreement is the skill and creativity of the ARTIST. The ARTIST shall not assign the creative or artistic portions of the WORK to another party for the production of the WORK without the written consent of the CITY. Failure to conform to this provision may be cause for termination of this Agreement, at the sole option of the CITY.
4.2 The ARTIST shall be responsible for providing services described in Exhibit A including, but not limited to, the quality and timely completion of the services. The ARTIST shall be responsible for designing the WORK so that it can be constructed without exceeding the approved overall budget for the project. The ARTIST shall, without additional compensation, correct or revise any errors, omissions, or other deficiencies in his/her WORK.
4.3 In the event the services of the ARTIST are integrated into, combined, or otherwise coordinated with services by third parties not within the control of the ARTIST, the ARTIST shall not be responsible for such third party services. If any part of the ARTIST'S WORK depends for proper execution or results of tasks performed by the CITY, or a third party responsible to the CITY, the ARTIST shall, prior to proceeding with his or her WORK, promptly report to the CITY any apparent discrepancies or other defects in such other work which renders it unsuitable for proper execution and results by the ARTIST. The ARTIST shall not be responsible for any liability or failure to fulfill his/her obligations because of such discrepancies or defects. Failure of the ARTIST to report a discrepancy or defect shall constitute an acceptance of the CITY'S or third party's performance as fit and proper. Any costs caused by defective performance or ill-timed tasks shall be borne by the party responsible therefore. Nothing in this section shall limit the responsibility of the ARTIST to take all reasonable steps to coordinate his/her performance with the tasks and/or performance of the CITY or of a third party on the WORK.
4.4 If the ARTIST is involved in the execution, fabrication, transportation, inspection and/or installation of an artwork, the following provisions shall apply:
a. The ARTIST shall, if and when working on CITY property, supervise such clean-up as may be reasonably requested by the CITY. After completing the WORK, the ARTIST shall remove his/her equipment, excess materials, etc., promptly and as requested by the CITY.

The Artist agrees to be adequately prepared to rehearse and perform, to be prompt and punctual for rehearsals, costume calls and fittings, and to attend all rehearsals, meetings, coachings and special classes and other such official calls which are scheduled as official work time as required; to appear at the theatre as called; to pay strict regard to stage make-up and stage dress as determined by the Engager; to perform the Artist’s services as reasonably directed and to conform to the score to the best of the Artist’s ability; to conform to professional standards of conduct and behaviour. Under the instruction of the Stage Manager, the Artist agrees to maintain the original intent of the Stage Director throughout the run of the show; to properly care for the Artist’s wigs/costumes and props; to use, when required by the Engager, safe electronic equipment and to respect the physical property of the production and the Engager.

It is understood that it is the responsibility of the Artist to maintain membership in good standing in Canadian Actors' Equity Association and to furnish evidence to the when requested. The Artist agrees to abide all contractual obligations stated in the Artist's engagement contract and all riders attached thereto. The Artist agrees to be prompt and punctual at rehearsals, and to attend all rehearsals as required; to appear at the no later than the half hour call; and to conform to the score to the best of the Artist's ability; and to respect the physical property of the

The Work shall be fabricated and installed by the Artist in conformity with the Model and Marquette and the Proposal as presented to the City, subject to minor changes as necessary to the materials or the production process as determined by Artist. City understands that it may not be possible to create the Work precisely as depicted in the Marquette.
B. If during the fabrication process, Artist makes significant changes in size, imagery, color, or other approved elements of the Work, Artist shall notify City in writing and shall receive City's written approval prior to proceeding with changes. A significant change is any change in the scope, design, size, material, texture or location on the Site of the Work, which affects installation, scheduling, Site preparation or maintenance of the Work or the concept of the Work as represented in the Marquette.
C. The Artist shall be responsible for arranging, supervising and paying all costs associated with transporting the Work to the Site.
D. Final completion shall be deemed upon an issuance of a Notice of Completion by City at its sole discretion. The City will take steps to consider final approval promptly upon notice that the Work is installed and ready for inspection.
E. Artist shall execute and deliver to City any instruments that City may reasonably require to confirm ownership of the Work, or to enable City to dispose of any rights therein.
F. Following completion of the installation of the Work, the Artist agrees to sign and submit, on request, photographs of the Work to City certifying the Work's authenticity.
G. If installation of the Work is delayed by an event under the control of City, and the Artist is fully prepared to begin installation of the Work, then City shall pay the cost to transport and store the Work should additional fees for rental and transport be required.
H. Each individual Artist acknowledges and agrees to be jointly and severally responsible and liable for every term, condition, and obligation under this Agreement.

The Artist agrees to be prompt and punctual at rehearsals, and to attend all rehearsals as required; to appear at the Designated Venue as required by the NAC; to come prepared for the purpose for which the Artist is engaged; to respect the physical property of the Designated Venue; and to perform to the best of the Artist’s professional ability the services for which the Artist has been contracted.

18.6.2.1 Report any defects in the company vehicle immediately to the Manager and not drive the vehicle until it is restored to a lawful and roadworthy condition.
18.6.2.2 Disclose to the Manager any circumstances affecting the Artist’s ability lawfully to drive the company vehicle.
