Salary Protection Status. (a) The term “attainable maximum rate of pay” means the maximum salary rate in the case of all levels.

Salary Protection Status a) An employee whose position is reclassified downward and who has yet to be offered a reassignment to a position rated the same as, or higher than, their current position, shall receive negotiated salary increases on the same basis as if they had not been reclassified. An employee whose position is reclassified downward and who has refused reassignment to a permanent position rated the same as, or higher than, their position and for which the employee has the requisite skills and abilities, shall continue to receive the same rate of pay. The employee shall not receive negotiated salary increases. An employee who is demoted shall receive the lesser of their current rate of pay and the rate in the new position. Clause does not apply to an employee who obtains a position through the posting procedure which is rated lower than their current position. Such an employee shall receive the lesser of the rate for the new position and their current rate of pay. The Authority may appoint an employee to a position outside the bargaining unit on an acting basis for a period of up to one (I)year, during which time the employee may be returned by the Airport Authority to their former position at the rate of pay to which they would have otherwise been entitled within the bargaining unit. The acting appointment may be extended beyond one (1) year to accommodate a temporary vacancy. For the purposes of this Agreement, a position is higher rated than another if its maximum rate is higher, and the position is rated the same as another if its maximum rate is the same. Where a pay increment and a pay revision are effected on the same date, the pay increment shall be applied first. When an employee is required by the Airport Authority to substantially perform the duties of a higher rate classification level in an acting capacity and performs those duties for at least one (I)shift or day (including designated holidays), the employee shall be paid acting pay calculated from the date on which the employee commenced to act, in accordance with clause In the event of termination of employment for reasons other than death or lay-off or disability, the Airport Authority shall recover from any monies owed the employee an amount equivalent to unearned vacation taken by the employee. Salary Protection Status. The Employer shall continue its past practice of applying the Treasury Board policy on salary protection. For reference purposes, a copy of current Treasury Board regulations respecting pay on reclassification or conversion are attached as Appendix D-1.

Employees whose job rate was found to exceed the applicable scale of rates for their classification on June will be entitled to the economic increases in this agreement. Where an employee’s duties and responsibilities are reclassified to a level with a lower maximum rate of pay than the level at which he or she is being paid, the following shall apply: Downward reclassification notwithstanding, an encumbered position shall be deemed to have retained for all purposes the former level. This may be cited as salary protection status and, subject to section of this guideline and for a one year period following notification shall apply until the position is vacated or the maximum of the reclassified level, as revised from time to time, becomes greater than that applicable, as revised time to time, to the former classification level.
