Salary Protection. A regular employee who fills a regular vacancy or displaces a regular employee at a lower classification shall receive salary protection in accordance with Article 27.7.
Salary Protection. No teacher currently on staff shall incur a reduction in basic salary only because of the implementation of this Agreement.
Salary Protection. No teacher shall suffer a reduction in basic salary as a result of the implementation of this contract.
Salary Protection. Grading Changes
5.4.1 Where the appropriate base salary of a principal (as specified in clause 5.2.2) changes as a result of a drop in grade of the position and the principal’s existing base salary exceeds the rate for the new grade; and the change in grade is contained in the September Staffing Notice, and is not countered by an increase generated in the 1 March roll, the principal’s salary above the rate for the new grade will be protected for a period of 24 months from the beginning of the school year that follows the September Staffing Notice. After the 24 month period of salary protection, the principal shall be paid no more than the rate for the new grade. Salary protection under this clause shall lapse if the principal accepts an alternative position.
5.4.2 Where a grading reduction determined by the September provisional roll, is countered by a grading increase generated by the 1 March roll, the U grade of the principal reverts to the previous higher U grade and the associated salary protection ceases.
5.4.3 Where the grade of a position increases, and this increase is contained in the September Staffing Notice, the principal will move to the new rate at the beginning of the new school year.
5.4.4 For the avoidance of doubt, the base rate for the purposes of salary protection in clause 5.4.1 includes the base salary according to U grade weighting (roll size), but does not include the salary generated by the supplementary formula in clause 5.2.3 (FTTE size).
(i) In the event of a change in the school’s decile rating the change in salary will be effective from the beginning of the school year following the announcement of the decile change;
(ii) Where the change to the decile would reduce the salary of the principal, the existing decile funding component of the salary, as covered in clause 5.2.4 will be protected for a period of 24 months from the beginning of the school year following the announcement of the decile change.
Salary Protection. The District will pay the premium for the Group Salary Protection Plan, Plan D Plus provided by The Standard Insurance Company.
Salary Protection. 4.7.1 During any period of salary protection the teacher is entitled to any salary increases or increments due. Upon expiry of the protection period the teacher’s salary is reduced to the maximum salary payable according to the new grade of the position. When a teacher whose salary has been reduced subsequently obtains a new position salary is assessed as if no reduction had taken place.
Salary Protection. (i) An employee whose position was grandparented upon implementation of job evaluation / pay equity shall maintain their existing rate of pay and shall receive all general wage increases for the duration of the current Collective Agreement while such employee remains in their current position.
(ii) An employee, whose position has been re-evaluated downward as a result of an evaluation initiated after the date of ratification of this Agreement to a pay grade below that pay grade presently received by the employee, shall be “blue-circled”.
(iii) For the purposes of this Article, “blue-circled” means that the employee shall continue to receive fifty percent (50%) of the negotiated wage increases applicable to the employee’s re-evaluated position until the wage rate of the employee’s position equals or exceeds the wage rate being received by the employee.
Salary Protection. No employee shall incur a salary reduction because of the establishment of a new or by substantially modifying an existing classification pursuant to Section 3 of this Article.
Salary Protection. Surplus employees and laid-off persons appointed to a lower-level position under this clause shall be remunerated as per the following provisions:
(a) The employee’s rate of pay shall be unaffected and, for all intents and purposes, maintained at the rate of pay of the employee's substantive position. The employee shall obtain incremental increases until his salary has reached the maximum rate of the substantive position’s pay scale.
(b) Reclassification of the position to a lower level shall take effect once the position becomes vacant.
Salary Protection. 1. No teacher presently on contract with the school district shall incur a reduction in basic salary because of the implementation of this Agreement.
