Scheduling Provisions for 10 Hour Tours. The following scheduling provisions shall apply to all nurses working extended 10-hour tours: (a) A regular ten (10) hour tour shall be 9.375 consecutive hours in any twenty-four hour period, exclusive of a total of thirty-seven and one half (37.5) minutes of unpaid mealtime. (b) Nurses shall be entitled, subject to the exigencies of patient care, to paid relief periods during the tour of a total of thirty-seven and one half (37.5) minutes. (c) The Employer will provide at least every second (2nd) weekend off. If a nurse is required to work a second consecutive and subsequent weekend, she will receive premium payment as defined in the Central Agreement for all hours worked on that weekend for hours between 2300 hours Friday to 2300 hours Sunday and subsequent weekends, until a weekend is scheduled off, save and except where: i) Such weekend has been worked by a nurse to satisfy specific days off requested by such nurse; or ii) Such nurse has requested weekend work only; or iii) Such weekend is worked as a result of an exchange of shifts with another nurse. 9.375 hour tours, she shall be paid in accordance with Article 14.03 for all hours worked on the fifth (5th) and subsequent 9.375 hour tours until time off is scheduled.

Should an nurse work more than four (4) consecutive 9.375 hour tours, she shall be paid in accordance with Article 14.03 for all hours worked on the fifth (5th) and subsequent 9.375 hour tours until time off is scheduled. (e) Overtime is Subject to Article 14. For nurses working ten (10) hour tours, overtime shall be paid at the rate of time and one half (1½) the nurse's regular straight time hourly rate for all work performed in excess of 9.375 paid hours in a twenty-four (24) hour period.

Eighty (80%) of the nurses (full and part-time) that vote by secret ballot must be in favour of the ten (10) hour schedule. iii) The following scheduling provisions shall apply to all nurses working extended 10 hour tours: (1) A ten (10) hour tour will be paid 9.375 hours. Nurses will be scheduled four (4) shifts in a week for 37.5 hours of paid time. (2) Nurses shall be entitled, subject to exigencies of patient care, to unpaid meal periods of 37.5 minutes and 37.5 minutes of paid break time. iv) The Hospital or the Union may discontinue the ten (10) hour schedule in a Unit with the provision of ninety (90) days written notice to the other party. Upon receipt of such notice a meeting shall be held between the parties within fifteen (15) days, to discuss the discontinuation of the schedule. It is understood and agreed that such discontinuation shall not be unreasonable or arbitrary.
Scheduling Provisions for 10 Hour Tours i) The ten (10) hour tour schedule may be introduced when a written request has been provided by nurses to the Hospital and copied to the Bargaining Unit President, signed by fifty percent (50%) of the nurses on that Unit. ii) Where the Hospital wants to introduce a ten (10) hour tour schedule, the Hospital will notify the Bargaining Unit President in writing. The Hospital will provide reasons for implementation, which will not be arbitrary, unreasonable or in bad faith. The parties will meet to discuss the reasons for implementation if requested by the Union. iii) The ten (10) hour master schedule will be finalized prior to any vote being taken on the ten (10) hour tour. Eighty percent (80%) of the nurses (full and part-time combined) that vote by secret ballot must be in favour of the ten (10) hour master schedule introduced by either party. The Union and Hospital will jointly arrange the vote, which will be conducted using an anonymous electronic survey. Staff will be permitted to vote for a twenty-four (24) hour period, unless the period is extended by mutual agreement of the Hospital and the Union. The electronic survey will be at no cost to the Union. iv) The following scheduling provisions shall apply to all nurses working extended 10 hour tours: (1) A ten (10) hour tour will be paid 9.375 hours. Nurses will be scheduled four (4) shifts in a week for 37.5 hours of paid time. (2) Nurses shall be entitled, subject to exigencies of patient care, to unpaid meal periods of 37.5 minutes and 37.5 minutes of paid break time. v) The Hospital or the Union may discontinue the ten (10) hour schedule in a Unit with the provision of ninety (90) days written notice to the other party. Upon receipt of such notice a meeting shall be held between the parties within fifteen (15) days, to discuss the discontinuation of the schedule.
