Seniority Bumping Rights. 42 Whenever a classified employee’s position is terminated or an employee is laid off, that employee shall 43 have the right to “bump” an employee with less seniority within the employee’s current classification 44 when ability and performance are substantially equal to those of the junior employee even if that 45 employee has more hours. The bumping process shall occur within ten (10) working days from the 46 notice of termination or being laid off.

Seniority Bumping Rights. Employees identified for layoff who have seniority (bumping) rights to their current or previously held classifications within the representation unit must declare their intention to exercise these rights in writing and submit to the Human Resources Department within seven (7) working days after written notification of layoff, otherwise bumping rights will automatically terminate. Bumping may occur within the representation unit, only to the least senior incumbent of the current or a previously held classification. To bump, the employee must be fully qualified, trained, and perform all work in the position. For purposes of this section of the Agreement, the term "working days" shall mean Mondays through Fridays, exclusive of holidays. Should this result in bumping a current employee; the displaced employee will have bumping rights as set forth in this section.
Seniority Bumping Rights. No employee shall have the right to replace another employee in any classification by virtue of District seniority alone, except that, in the event of the permanent lack of work in any classification, those employees concerned in that classification shall be assigned to the next lower classification for which they have District seniority. Displaced employees in those lower categories shall have the same rights of reassignment as referred to in this Section. It is understood that an employee may not bump an employee in a higher job category.

  • Seniority Rights An employee who returns to employment at the time of or prior to the expiration of military leave shall be given such status in employment as would have been enjoyed if employment had been continuous from the time of entrance into the Armed Forces.
