Space Allocation. BellSouth shall assign Neutral Tandem Collocation Space that utilizes existing infrastructure (e.g., heating, ventilation, air conditioning (HVAC), lighting and available power), if such space is available for collocation. Otherwise, BellSouth shall attempt to accommodate Neutral Tandem’s requested space preferences, if any, including the provision of contiguous space for any subsequent request for collocation. In allocating Collocation Space, BellSouth shall not materially increase Neutral Tandem’s cost or materially delay Neutral Tandem’s occupation and use of the Collocation Space, assign Collocation Space that will impair the quality of service or otherwise limit the service Neutral Tandem wishes to offer, reduce unreasonably the total space available for physical collocation or preclude reasonable physical collocation within the BellSouth Premises. Space shall not be available for collocation if it is: (a) physically occupied by non-obsolete equipment; (b) assigned to another collocated telecommunications carrier; (c) used to provide physical access to occupied space; (d) used to enable technicians to work on equipment located within occupied space; (e) properly reserved for future use, either by BellSouth or another collocated telecommunications carrier; or (f) essential for the administration and proper functioning of the BellSouth Premises. BellSouth may segregate Collocation Space and require separate entrances for collocated telecommunications carriers to access their Collocation Space, pursuant to FCC Rules.
Space Allocation. (a) Slot and deadweight allocation on each southbound and northbound sailing shall be shared between the Parties in proportion to the aggregate agreed capacity that each Party provides within each cycle of thirteen seven consecutive sailings. The foregoing principle may be waived by the Parties agreeing to do so in writing.
(b) One cycle will be defined as 13 7 consecutive weekly fortnightly sailings and the slots provided within any given cycle will determine a Party’s slot entitlement within that cycle, unless otherwise specifically agreed.
(c) The average weight per slot will be assessed at: - 12 tons per TEU Southbound (from Europe via USEC to FPI/ANZ) - 14 tons per TEU Northbound (from ANZ via USEC to Europe) The Parties will agree the slot capacity of each vessel upon the basis of the above average deadweight per TEU.
(d) Any Party may agree to sell any portion of its allocation to another Party at a pre-agreed slot rate. Any sale of slots to a non-Party is not permitted without the written consent of the other Party. Notwithstanding the preceding sentence, any Party may make space available to any affiliated or wholly owned subsidiaries and shall not require the consent of the other Party to do so.
(e) In the event that the deadweight capacity of a ship is reduced as a result of draft limitations at ports or canals as well as temporary reductions in draft caused by unforeseen events, then the allocation of deadweight to each 3rd Revised Page No. 6 Party loading on that voyage leg shall be reduced proportionately to the overall reduction in deadweight. Any change in allocation made pursuant this Article 5.3(e) will be effected at a port, or phased over a range of ports, as agreed by the Parties.
(f) Reefer plugs on each sailing shall be allocated among the Parties in accordance with the principle set forth in Article 5.3(a). A reefer plug premium will be established for excess reefer plug usage used on the other Party’s vessels. For avoidance of doubt the Vessel Providing Party will not pay the other Party a reefer premium for excess plugs utilized on its own vessels.
Space Allocation. Ingram shall store the Managed Inventory at the Facility or Facilities. Ingram reserves the right to store the Managed Inventory at other Ingram facilities or at a third party warehouse location, provided that it advises Vendor of where the Managed Inventory is located and that it bears all costs associated with relocating the Managed Inventory to the other Ingram facilities. Ingram shall allocate the number of bin locations per day stated in Schedule A for storage of the Products at each Facility. In the event that the Managed Inventory levels exceed the number of allocated bin locations at a Facility, Ingram reserves the right to charge Vendor for the additional bin locations actually used each day at the rate stated in Schedule A. Vendor may request that Managed Inventory be located at additional Ingram facilities; provided that Ingram may accept or reject any such request in its sole discretion. Vendor shall bear all costs associated with relocating Managed Inventory to additional or alternative facilities.
Space Allocation. Unless otherwise agreed by the Parties, space on each of the vessels deployed in the Service (up to the agreed declared capacity of each vessel) shall be allocated between the Parties in proportion to the total agreed declared capacity of the vessels contributed by each Party to the Service, as outlined above. The Parties may from time to time review and, subject to mutual agreement, change the agreed declared capacity of the vessels.

In allocating Collocation Space, BellSouth shall not materially increase ALCALL's cost or materially delay ALCALL's occupation and use of the Collocation Space, assign Collocation Space that will impair the quality of service or otherwise limit the service ALCALL wishes to offer, reduce unreasonably the total space available for physical collocation or preclude unreasonable physical collocation within the “BellSouth Premises”. Space shall not be available for Version 3Q03: 11/12/2003 collocation if it is: (a) physically occupied by non-obsolete equipment; (b) assigned to another collocated telecommunications carrier; (c) used to provide physical access to occupied space; (d) used to enable technicians to work on equipment located within occupied space; (e) properly reserved for future use, either by BellSouth or another collocated telecommunications carrier; or (f) essential for the administration and proper functioning of the “BellSouth Premises”. BellSouth may segregate Collocation Space and require separate entrances for collocated telecommunications carriers to access their Collocation Space, pursuant to FCC Rules.

In allocating Collocation Space, BellSouth shall not materially increase DSLi's cost or materially delay DSLi's occupation and use of the Collocation Space, shall not assign Collocation Space that will impair the quality of service or otherwise limit the service the DSLi wishes to offer, and shall not reduce unreasonably the total space available for physical collocation or preclude unreasonably physical collocation within the Premises. Space shall not be available for collocation if it is: (a) physically occupied by non-obsolete equipment; (b) assigned to another collocator; (c) used to provide physical access to occupied space; (d) used to enable technicians to work on equipment located within occupied space; (e) properly reserved for future use, either by BellSouth or by another carrier; or (f) essential for Version 3Q01: 10/22/01 the administration and proper functioning of BellSouth's Premises. BellSouth may segregate collocation space and require separate entrances in accordance with FCC rules.
Space Allocation. The City shall have the right to allocate the available spaces per facility for daily/hourly and monthly parking. Current patrons, when applicable, shall not be excluded from use except for failure to pay rental fees in a timely manner or as directed by the City Manager. The Manager will allocate parking spaces in accordance with this contract and as adjusted by the City Manager in writing.
Space Allocation a Completed Space Allocation Workbook as outlined in the current Department of Education School Construction Project Workbook. This work shall be based on the Owner-provided update and refinement of its Mission Statement, enrollment projections, and Education Specifications.
Space Allocation. The ACC offers 813,000 square feet of exhibition space; 130,000 square feet of meeting rooms, including a 38,000 square foot ballroom; 200,000 square feet of lobby and pre- function space, 100,000 square feet of exterior function space, and the 8,000 seat Arena.
Space Allocation. The LDAA shall be granted space in the Xxxxx X. Xxxxxxx Room. This space has been identified by LCPS, in accordance with LCPS Policy 6310, as “unneeded,” to use for operations related to the purposes outlined in this MOU. In addition to housing the LDAA from 7:30 AM to 5:00 PM Monday through Friday, excluding LCPS holidays (“Business Hours”), the Xxxxx X. Xxxxxxx Room will be used to display publicly accessible historical exhibits, both during public viewing hours and at other times when individuals are in the Building for LCPS business. At these times, LCPS visitors may view the exhibits in the historic portion of the Building identified in Exhibit B. To facilitate this, the Xxxxx X. Xxxxxxx Room will remain unlocked and open during Business Hours. The Operational Schedule for the building’s exhibits and organizational meetings may be revised as needed and changes may be requested by the LCPS-related Historical Organizations at any time. Any changes to the Operational Schedule must be approved by LCPS prior to implementation. The initial Operational Schedule covering November 2022 through December 2023 is attached as Exhibit A to this MOU. The calendar will be developed on an annual calendar year basis moving forward. LDAA operational activities must not conflict, interfere, or disrupt any utilization of LCPS or PRCS during normal business operations hours for each organization, as outlined herein. The LDAA shall not discriminate against attendees at events held as prohibited by laws or Constitution of the United States of America or the Commonwealth of Virginia. Any rights granted under this MOU to the LDAA may not be transferred to another organization without the written consent of LCPS. Meetings held in the dedicated space discussed in this MOU must include the organization to which the space is dedicated.
