Startup and Commissioning. When the Buyer provides the Seller notice countersigned by the Seller that the Mechanical Completion of a Unit has been achieved in the form attached hereto as Exhibit B (a “Mechanical Completion Certificate”), the Seller shall Startup and Commission such Unit in accordance with Appendix A on or before the dates established by the Performance Schedule set forth in Attachment 4. If the Seller does not countersign or object to any such Mechanical Completion Certificate within *** days after receipt, such Mechanical Completion Certificate shall be deemed confirmed and agreed to by the Seller on the date that such Mechanical Completion Certificate was originally delivered to the Seller. The Buyer shall achieve Mechanical Completion of the Units at the following rate: (a) *** as a minimum number of Units per week and (b) *** as a maximum number of Units per week; provided, however, that the Buyer may modify either of such rates in accordance with Article 13. If, after Seller’s mobilization for a Project at the Site, the Buyer delays the Mechanical Completion of *** Units for a cumulative total of *** hours or more for any reason other than an excusable event pursuant to Article 22 or suspension pursuant to Article 20, then (a) the Seller shall use commercially reasonable efforts to minimize the impact of such delay on the costs and delays it incurs as a result of such delay, (b) the performance of the Seller’s obligations shall be equitably extended for a period of time based upon the time lost as a result of such delay and the impact on the Seller’s performance of the Work, and (c) the Buyer shall pay the Seller within thirty (30) days after receipt of an invoice from the Seller a reasonable price increase for additional labor incurred by the Seller solely as a result of such delay in excess of the labor the Seller would otherwise have incurred based on the published rates for Technical Advisory Services in effect at the time of such delay.

Startup and Commissioning. The SCADA system requires testing with each item listed below following installation. This scope of services includes startup and commissioning for each RTU.
Startup and Commissioning. SANDAG and the Parties agree that work covered by this CBA on Covered Projects includes all onsite physical craft work that is part of startup and commissioning, including, but not limited to, system flushes and testing, loop checks, rework and modifications, and functional and operational testing up to and including the final running test. It is understood that SANDAG’s personnel and/or its representatives, together with the manufacturer’s and/or vendor’s representatives, and/or project operating personnel may supervise and direct the startup, commissioning, rework, and modification activity, and that the onsite physical craft work is typically performed as part of a joint effort with these representatives and personnel. A manufacturer or its representatives may perform industry standard startup and commissioning work to satisfy its guarantee or warranty on a piece of equipment, and such work will be exempt from the Community Benefits Agreement to the extent the work is excluded by Section 3.2(e) and/or Section 3.2(f).
Startup and Commissioning. 8.1 Review Startup and Testing Plan Consultant will review and comment on detailed testing and startup plans prepared by the Contractor. Consultant will meet with contractor to review and discuss the draft startup and testing plans. For fee estimating purposes, we have anticipated one full time startup and testing specialist for up to 4 weeks during startup and commissioning. An instrumentation specialist will attend factory tests and oversee field verification testing of plant-wide SCADA systems.
Startup and Commissioning. Engineer shall assist Owner in startup of the Project and observe startup activities.

The CONTRACTOR and the respective Construction Subcontractor shall provide the services of the Commissioning Agent as described in 6NYCRR § 638.8 Commissioning, as amended by the OWNER in the DASNY Commissioning Guidelines. If the Work to be commissioned was not performed by a Construction Subcontractor, the CONTRACTOR shall provide the services of the Commissioning Agent. - The CONTRACTOR shall coordinate with its Construction Subcontractors, the provider(s) of professional engineering and architectural services for the Installation Order and the Commissioning Professional to achieve the successful commissioning of the Project systems in accordance with applicable law and regulations and the OWNER’s and Client’s requirements. .

It is understood that the Water Authority’s personnel and/or its representatives, together with the Contractor’s, manufacturer’s and/or vendor’s representatives, and/or project operating personnel may supervise and direct the startup, commissioning, rework, and modification activity, and that the onsite physical craft work is typically performed as part of a joint effort with these representatives and personnel. Contractor, manufacturer or vendor representatives may perform industry standard startup and commissioning work to satisfy its guarantee or warranty on a piece of equipment, and such work will be exempt from the PLA to the extent the work is excluded by Section 3.2(e) and/or Section 3.2(f).
