Study Limitations and Delimitations. This retrospective observational study has a number of potential limitations and delimitations that should be considered. An important delimitation of the study is that the study cohort includes only persons who were widowed. There is no comparison group of persons who were not widowed. The reason for this delimitation is that the primary objective of the study is to evaluate the context of the predeceased spouse’s death on the subsequent survival of the bereaved spouse. Specifically, the study seeks to evaluate the importance of the predeceased spouse’s place of death, hospice use, and end-of-life health trajectory pattern. These variables can only be assessed for decedents. A consequence of this delimitation is that this study cannot compare the survival of married and widowed persons to evaluate the main effect of bereavement itself on survival. The study may also be subject to some degree of selection bias due to the nature of the PACE population from which the study cohort was drawn. The PACE sample is limited only to elderly Pennsylvania residents, so the results of this study may not be generalizable to younger persons or to those living in other geographic regions. The PACE population is also not representative of the general U.S. elderly population, because, due to PACE’s income eligibility requirements, PACE cardholders have lower incomes and are older on average than the general non-Medicaid elderly population enrolled in Medicare. A large body of research has demonstrated that individuals with poorer socioeconomic resources over their life course are more likely to have poorer health (142). In addition, individuals who choose to enroll in PACE may be more likely to have high medication needs and thus may be sicker or more frail than persons who are income-eligible but who choose not to enroll in the program, reflecting adverse selection into the program. A related limitation is that the study sample includes only persons who were enrolled in the Medicare Fee-for-Service program, and excludes individuals if either they or their spouse were enrolled in a Medicare Advantage managed care plan during the pre-index baseline period. Prior research has demonstrated a historical pattern of favorable risk selection of healthier Medicare beneficiaries into Medicare Advantage plans (143). Except for the foregoing exceptions, a responsible party’s (“Responsible Party’s”) aggregate liability to the other party (“Aggrieved Party”) for damages from any and all claims or causes whatsoever, and regardless of the form of any such action(s), that arise from or relate to this Agreement (collectively, “Claims”), whether in contract, tort, indemnification, or negligence, shall be limited solely to the amount of the Aggrieved Party’s actual and direct damages, not to exceed the amount of fees paid by you (excluding hard costs for licenses, hardware, etc.) to Verticomm for the specific Service upon which the applicable claim(s) is/are based during the three (3) month period immediately prior to the date on which the cause of action accrued. The foregoing limitations shall not apply to the extent that the Claims are caused by a Responsible Party’s willful or intentional misconduct, or gross negligence.   • Warranty Limitations This Contractual Warranty does not warrant uninterrupted or error-free operation of the Product or cover normal wear and tear of the Product or costs related to the removal, installation, or troubleshooting of the customer's electrical systems. The warranty claims that relate to defects caused by any of the following factors are not covered by the Contractual Warranty: • Improper Use or Non-compliance with installation, commissioning, operation or maintenance instructions (i.e. not according to the operation & installation manual) • Unauthorized modifications, changes or attempted repairs, • Vandalism, destruction through external influence and/or persons/animals • Use in an unsuitable environment, including any environment or location that causes excessive wear and tear or dirt or dust or debris buildup within the system or that is difficult or unsafe for Xantrex LLC representatives to access • Insufficient ventilation • Installation in a corrosive environment • Failure to observe applicable safety standards & regulations • Damages during transportation or storage • Force majeure, examples include, but not limited to: fire, flood, earthquakes, storm damage, overvoltage & lightning strikes • Exposure to fire, water, snow, moisture, or liquid ingress (except for any such exposure to environmental conditions that your Product was specifically designed to withstand as indicated in the applicable specifications for your Product) • Used as a component part of a product expressly warranted by another manufacturer • If the original identification (trade-mark, serial number) markings have been defaced, altered, or removed • Consumable components of any type are not covered, including but not limited to fans, fuses and filters etc. • Cosmetic shortcoming which do not impair the use of the product for the intended purpose i.e. supply of energy Warranty claims also exclude: • Damages arising due to the fact that the use of the product for the intended purpose is no longer possible or only possible with restrictions as a result of amendments to the statutory provisions applicable to the operation of the product made after the delivery of the product • Compensation for damages related to loss of power production or business operation or any expenses incurred by customer towards repair & replacement of the product (including but not limited to labor, transportation, temporary power) • Cost arising from changes to existing PV systems or building installations or vehicle or marine vessel installation and like • Additional costs and expenses (i.e. shipping costs, travel, accommodation, meals, etc.) arising due to remote locations of the indicated geographies, including but not limited to islands and overseas territories

  • Use Limitations Subscriber shall display the CPI Marks in connection with Subscriber Charging Stations as required in this Agreement during the term of Subscriber’s Cloud Plan. From time to time, CPI may provide updated CPI Mark usage guidelines on the ChargePoint Application or elsewhere in the Documentation, and Subscriber shall thereafter comply with such updated guidelines. For any use of the CPI Mark not authorized by such guidelines, or if no such guidelines are provided, then for each initial use of the CPI Mark, Subscriber must obtain CPI’s prior written consent, which shall not be unreasonably withheld or delayed, and after such consent is obtained, Subscriber may use the CPI Mark in the approved manner. All use by Subscriber of CPI's Marks (including any goodwill associated therewith) will inure to the benefit of CPI.

  • Limitation on Use COLLEGE and SCHOOL DISTRICT shall use each student education record that he or she may receive pursuant to this CCAP Agreement solely for a purpose(s) consistent with his or her authority to access that information pursuant to Federal and State law, as may be as applicable. (34 C.F.R. § 99.31, 34 C.F.R. § 99.34, and Education Code § 49076.)
