Subscriber's Responsibilities. (a) Subscriber agrees to: (i) register on JetBrains Site for using Service. Subscriber shall provide JetBrains with a name for Subscriber’s identification, a valid email address, and other information required by the registration form on JetBrains Site to enable JetBrains to create Subscriber’s URL; (ii) obtain an Internet connection, any equipment necessary for the Internet connection, and any third-party software necessary for using Service, including, but not limited to, browser software that supports a data security protocol compatible with the protocol used by JetBrains, and; (iii) use Service in compliance with Documentation and within the limitations set out in Subscription Confirma- tion. If the Subscription parameters as outlined in Subscription Confirmation obtained by Subscriber do not meet Subscriber’s needs, Subscriber may adjust the parameters of Subscription as set forth in Section 4 and Section 6 of this Agreement. The new parameters of Subscription shall become effective immediately upon confirmation by JetBrains. (b) Subscriber shall not, and will make sure that Users do not: (i) modify, alter, tamper with, repair, or otherwise create derivative works of Service or associated Software (except to the extent Software or any or its parts are provided to Subscriber under a separate license that expressly permits the creation of derivative works); (ii) reverse-engineer, disassemble, or decompile Service or apply any other process or procedure to derive the source code of Service or associated Software; (iii) use Service in a way intended to avoid incurring fees or exceeding the limitations outlined in the Subscription Confirmation limits; (iv) use Service to store or transmit infringing, libelous, or otherwise unlawful or tortious material, or to store or transmit material in violation of third-party privacy or copyrights; (v) attempt to gain unauthorized access to Service or to Hosting System; or (vi) provide access to Service or right to use Service to a third party. (c) Subscriber shall be responsible for: (i) Users’ compliance with this Agreement. If Subscriber becomes aware of any violation of Subscriber’s obligations under this Agreement by a User, Subscriber shall immediately terminate such User’s rights to use Service; (ii) the legality of Subscriber’s Data and of the means by which Subscriber acquired Subscriber’s Data. As a condition to Fourth’s provision of any Services, Subscriber will provide all assistance, cooperation, information, equipment, and resources reasonably necessary for Fourth to perform such Services. Subscriber will prevent any unauthorized use of the Subscription Service or Documentation, and Subscriber will promptly notify Fourth if it learns of any unauthorized use. In such case, Subscriber will take all steps reasonably necessary to terminate the unauthorized use and will cooperate and assist with any actions taken by Fourth to prevent or terminate such unauthorized use.
Subscriber's Responsibilities. Subscriber shall be responsible for: (a) notifying Greenlots of any new Charging Stations to be registered on the Greenlots Charging Network as Networked Charging Stations (which shall include providing Greenlots with specifications and descriptions in relation to each such Charging Station); (b) operating and maintaining the Networked Charging Stations in a safe manner and in compliance with all applicable laws and contractual obligations; (c) providing Greenlots with advance written notice of the relocation or decommissioning of any Networked Charging Stations or of Networked Charging Stations which are non-operational or not intended to be replaced or repaired by Subscriber; and (d) all invoicing and customer payment matters
Subscriber's Responsibilities. Subscriber shall: a. be responsible for the creation of Subscriber’s Self Care Account upon activation of Service; b. be responsible for the set-up or configuration of his/her/its own equipment for access to Service using Device; c. comply with all notices or instructions given by P1 from time to time in respect of the use of Service; d. be solely responsible for obtaining, at his/her/its own cost, all licenses, permits, consents, approvals as may be required for using the Service; e. comply with the rules of all networks to which Subscriber has access through the Service; f. comply with and not contravene any and all applicable laws and regulations of Malaysia, whether relating to Service or otherwise including but not limited to the Communications and Multimedia Act 1998; g. be solely responsible for all information retrieved, stored and transmitted by Subscriber through the use of Service; h. obtain P1's prior approval before making any changes to the network configuration and interconnecting the private network to any public network; i. where necessary, be responsible for ensuring that Subscriber’s personal computer is equipped with the necessary network card; j. be responsible to promptly pay all amounts due to P1 in full without any deduction, set off or withholding in respect of the Service as reflected in the monthly bill irrespective of whether any of the amount is disputed by Subscriber. P1 will refund the disputed amount paid if the dispute is found to be valid after investigation by P1; x. xxxxx and adhere to all Terms; l. not entitled to transfer or assign its obligations and liabilities to any other party under any circumstances, without prior written approval of P1. The Subscriber shall ensure control of the user identification name, password and Account PIN for authorized usage of the Services and shall act in good faith and shall exercise all reasonable care and diligence in maintaining the confidentiality of the user identification name, password and Account PIN. Unless the contrary is proved, all communication and activities occurring under or referable to the Subscriber’s Companies Registry Account, user identification name, password and Account PIN shall be deemed to have been validly used or authorised by the Subscriber. The Subscriber shall be liable for all costs, fees and expenses arising from any communication and activity occurring or referable to the Subscriber’s Companies Registry Account, user identification name, password and Account PIN. 7.3 The Subscriber shall be liable for all transactions effected through the use of the Subscriber’s Companies Registry Account, user identification name, password or Account PIN, including liability for the fees, charges and levies as may be applicable to such transactions. The RGD shall be under no obligation whatsoever to investigate or verify the authority of persons using the Subscriber’s user identification name, password or Account PIN. 7.4 The Subscriber undertakes to notify the RGD immediately of any unauthorized use of the Subscriber’s Companies Registry Account, user identification name, password or Account PIN. 7.5 The Subscriber agrees that access to and usage of the Services is for approved purposes only.
