Sunday and Holiday. An Employee designated by letter or by list for standby duty shall be available during his period of Xxxxxxx at a known telephone number pager and/or radio and shall be available to return for duty as quickly as possible if called. In designating Employees for Standby, the Employer will endeavour to provide for the equitable distribution of standby duties among readily available qualified Employees who are normally required, in the regular duties, to perform that work. No Standby payment shall be granted if an Employee is unable to report for duty when required, An Employee on Standby who is required to for work shall be paid, in addition to the standby pay, the appropriate overtime rate for all hours worked. Except in the case of an emergency, standby schedules shall be posted seven (7) days in advance of the starting date of the new shift schedule. Except in the case of an emergency, no disciplinary action will be taken against an Employee who is not available for Standby Duty, provided that he gives the Employer adequate advance notice of his unavailability and can provide reasonable grounds for being unavailable or finds a substitute. ARTICLE TERM POSITIONS No term position shall have a stated term of more than years. If the Employer should wish a term position to extend beyond years, the position must become a permanent position, which must be offered to the incumbent of the term position. Where a term position becomes a permanent position and the incumbent in the term position is appointed to the permanent position, his seniority shall date from the initial date of hire in the position. The benefit package for term positions specified in Appendix is subject to the provided by a third party. ARTICLE STATEMENT OF DUTIES When an Employee is first hired or when an Employee is reassigned to another position in the Bargaining Unit, the Employer shall, before the Employee is assigned to that position, provide the Employee with a current and accurate written statement of duties of the position to which he is assigned. Upon written request, an Employee shall be given a complete and current statement of duties and responsibilities of his position.

  • HOLIDAYS AND HOLIDAY PAY 165. 1. A holiday is calculated based on an eight hour day.   • Holiday Falling on Saturday or Sunday For an employee whose normal workweek is from Monday to Friday and when any of the above-noted holidays falls on a Saturday and is not proclaimed as being observed on another day, the following Monday will be deemed to be the holiday. When a holiday falls on a Sunday and it is not proclaimed as being observed on another day, the following Monday (or Tuesday, where the preceding section already applies), will be deemed to be the holiday for the purpose of this agreement.

  • Saturday Sunday and designated paid holidays shall not be counted in determining the time within which any action is to be taken or completed under the grievance procedure.

  • Legal Holiday If the date on which any payment is due shall not be a Business Day, then (notwithstanding any other provision of the Notes or this Indenture) payment need not be made on such date but may be made on the next succeeding Business Day with the same force and effect as if made on the date on which nominally due, and no interest shall accrue for the period from and after any such nominal date.

  • OVERTIME AND HOLIDAY PAY 5.3.1 All hours worked by an employee in excess of eight (8) hours per shift and in excess of forty (40) straight time hours per week shall be paid for at the rate of one and one-half times the straight time rate. All hours worked by an employee in excess of ten (10) hours per shift and all hours worked on Sunday shall be paid at the rate of double the straight time rate. 5.3.2 Additional holidays recognized in the Construction Industry in each geographical area will be observed on all work covered by this Appendix.

  • Holidays on Saturday or Sunday When a holiday falls on a Saturday, the preceding workday not a holiday shall be deemed to be that holiday. When a holiday falls on Sunday, the following workday not a holiday shall be deemed to be that holiday.
