Superintendent’s Discretion Clause Samples
The Superintendent’s Discretion clause grants the superintendent the authority to make decisions or judgments on certain matters within a contract, typically relating to construction or project management. In practice, this means the superintendent can interpret specifications, approve variations, or resolve disputes about the quality or timing of work, often after considering relevant information from both parties. The core function of this clause is to provide a clear decision-making mechanism for issues that arise during a project, helping to avoid delays and disputes by centralizing authority in a designated individual.
Superintendent’s Discretion. The granting of a child-rearing leave is not subject to the discretion of the Superintendent or his/her designee (i.e. it will be granted automatically) given:
i. the leave commences in September or directly after other adoption/birth-related leaves; and
ii. the employee returns to work the following September (in the case of a Paraprofessional whose regular work year does not coincide with the school year, provisions of Article 4.7.A apply); and
iii. the paraprofessional has three (3) years of service; and
iv. the leave is for the employee’s entire position (i.e. not part-time); and
v. submission deadlines are met. All other child-rearing requests may be granted at the reasonable discretion of the Superintendent or his/her designee.
Superintendent’s Discretion. Nothing agreed to herein precludes the Superintendent from granting additional days off, with or without pay, for circumstances not specifically covered or for circumstances specifically covered herein.
Superintendent’s Discretion. The granting of a child-rearing leave is not subject to the discretion of the Superintendent or his/her designee (i.e. it will be granted automatically) given:

iv. the leave is for the employee’s entire position (i.e. not part-time); and
v. submission deadlines are met. All other child-rearing requests may be granted at the reasonable discretion or the Superintendent or his/her designee.
Superintendent’s Discretion. Following consultation with the Alliance on a case by case basis, the Superintendent, at his/her sole discretion, may grant a teacher’s written request for short-term leave of absence without pay for emergency situations or for unforeseen situations of an extraordinary nature where the paid leave provisions set forth under this Article have been exhausted or where there is no leave provision set forth under this Article. The granting of said leave shall not establish a precedent for the approval or denial of similar requests in the future.
Superintendent’s Discretion. Nothing agreed to heretofore concerning absences precludes the Superintendent from granting additional paid or unpaid time off for circumstances covered or not specifically covered in this Agreement. All such requests for time off shall be brought to his/her attention through routine channels as speedily as possible. The Superintendent shall make a determination in the case of such requests for absence with regard to the number of days permitted, salary, etc. The granting or denial of additional days off with or without pay is at the sole discretion of the Superintendent and is not grievable under Article IX of this Agreement.
Superintendent’s Discretion. In the event more than four (4) employees request such leave, sabbatical leave may be granted based upon the Superintendent’s discretion to determine the value of the leave request to the organization. When the value to the organization is determined to be equal, then the decision to grant the leave shall be based on total length of service.
Superintendent’s Discretion. The parties understand an employee serving in their position for less than three (3) years may be discharged at the Superintendent’s discretion.
Superintendent’s Discretion. 19 The Superintendent shall have the right to provide leave for persons not covered by the provisions of 20 Sections 11.6 and 11.7, as well as add to the number of days allowed for such leaves. It is intended that 21 this provision will be used in unusual or extraordinary circumstances, at the sole discretion of the 22 Superintendent.
