Transfer of Function. Where the Employer has agreed to a transfer of function, it will be the responsibility of the Employer to provide in-service programs/training to all nurses required to perform the function. Employees required to attend such programs will be paid at the applicable rate of pay.
Transfer of Function. Transfer of function means the transfer of the performance of a continuing function from one competitive area and its addition to one or more other competitive areas, except when the function is virtually identical to functions already being performed in the other competitive areas affected; or the movement of the competitive area in which the function is performed to another commuting area.
Transfer of Function. (TOF): The transfer of the performance of a continuing function from one competitive area and its addition to one or more other competitive areas, except when the function involved is virtually identical to functions already being performed in the other competitive area(s) affected; or the movement of the competitive areas in which the function is performed to another commuting area.
Transfer of Function. A. The District agrees that in the event a District function is transferred to another governmental agency, the District will in good faith effort discuss with the transferring agency to place the terminated employees with the recipient agency and obtain benefits equal to those afforded him/her by the District.
Transfer of Function. A. A transfer of function is the transfer of the performance of a continuing function from one competitive area and its addition to one or more other competitive areas, except when the function involved is virtually identical to functions already being performed in the other competitive area(s) effected; or, the movement of the competitive area in which the function is performed to another commuting area. In a transfer of function, the operation of the function must cease in one competitive area and must be carried on in an identifiable form in another competitive area where it was not being performed at the time of the transfer.
B. In the event the Agency finds it necessary to exercise its authority to conduct a transfer of function, NTEU will be provided advance notice and the opportunity to bargain in accordance with the procedures contained in Article 26: Bargaining.
Transfer of Function. When a transfer of function occurs, the Department will first solicit qualified volunteers for transfer from among those employees in positions that have been identified for transfer. If there are not enough qualified volunteers from among these affected employees, the Department will solicit qualified volunteers from the competitive area. If the total number of employees who volunteer for transfer exceeds the total number of employees required to perform the function in the competitive area that is gaining the function, preference will be given to the volunteers with the highest retention standing. In the event there are not enough volunteers for the transfer, the employee with the lowest retention standing will be selected. Whenever possible, affected employees who do not volunteer to be transferred shall be reassigned to vacant positions within the competitive area for which the employee is qualified and which the Department has determined to fill.
Transfer of Function. When a transfer of function results in a reduction-in-force, RIF procedures, as outlined in applicable regulations and this Agreement, shall be used.
Transfer of Function. 1. A transfer of function will be in accordance with 5 U.S.C 3503. Transfer of function regulations apply only when, after transfer, the gaining competitive area uses Federal employees to perform the function. A Transfer of Function takes place when a function ceases in one competitive area, and moves to one or more other competitive areas that do not perform the function at the time of transfer.
2. Management may solicit volunteers to transfer, however, an employee has no right to transfer with the function unless the alternative in the competitive area losing the function is separation or demotion by reduction in force.
3. An agency may always direct an employee's reassignment to another position (regardless of location) in lieu of transfer of function rights. The vacant position may be in the same or in a different classification series, line of work, and/or geographic location.
4. The parties agree to follow the OPM Workforce Restructuring, Transfer of Function procedures written in compliance with 5 U.S.C. 3503 for identification procedures and methods and volunteer criteria and procedures and to process a Transfer of Function.
5. Management will notify the AFGE Local #0446 President of a decision to Transfer of Function at least five (5) days before employees are notified. At that time, Management will advise the Union of the reason for the transfer of function and the number of employees affected.
6. The affected employees will be given a specific notice of the Transfer of Function at least thirty (30) days before the effective date.
7. Commuting area and competitive level will be as described in Article 32.
Transfer of Function. A. In accordance with 5 CFR 351.301, a transfer of function (TOF) means the work of one or more employees is moved from one competitive area to another as a transfer of function regardless of whether or not the movement is made under authority of a statute, Executive order, reorganization plan, or other authority. In a transfer of function the function must cease in the losing competitive area and continue in an identical form in the gaining competitive area (i.e., in the gaining competitive area, the function continues to be carried out by competing employees rather than by noncompeting employees).
B. When the Agency determines that a TOF is necessary, the Agency will inform the Union, in writing, as far in advance as practicable, giving the reason for the action, the approximate numbers, types, and geographic location of the positions to be affected, and the approximate date of the action. At that time, the Union may initiate bargaining in accordance with Article 39, Negotiations.
C. The Agency will identify which positions will transfer in accordance with applicable laws and regulations.
D. Employees whose positions have been designated as transferring with the function will be notified in writing. The notice will state that the employee is being offered an opportunity to transfer with his or her position to a new competitive area. The notice will further state:
1. The name and location of the new competitive area;
2. The complete address/location of the new work site;
3. The applicable salary, including locality pay, of the employee's position at the new work site;
4. A statement that the employee is free to decide whether to accept the offer of the opportunity for transfer with his or her position;
5. A statement that should the employee accept the transfer with his or her position, the Agency will pay moving expenses and pay for house hunting trips in accordance with statute and government-wide regulation;
6. A statement that if the employee chooses not to accept the transfer with his or her position, the employee may be separated from his or her current position by adverse action procedures;
7. The deadline for responding to the offer of transfer; provided that this date will be no less than fourteen (14) days from the date of the notice. An employee may request an extension not to exceed a total of thirty (30) days.

Transfer of Function. Transfer of function will be carried out in accordance with the requirements of law and governing regulations.
