Transfer of Function. Where the Employer has agreed to a transfer of function, it will be the responsibility of the Employer to provide in-service programs/training to all nurses required to perform the function. Employees required to attend such programs will be paid at the applicable rate of pay.

Transfer of Function. A. A transfer of function is the transfer of the performance of a continuing function from one competitive area and its addition to one or more other competitive areas, except when the function involved is virtually identical to functions already being performed in the other competitive area(s) effected; or, the movement of the competitive area in which the function is performed to another commuting area. In a transfer of function, the operation of the function must cease in one competitive area and must be carried on in an identifiable form in another competitive area where it was not being performed at the time of the transfer.

The District agrees that in the event a District function is transferred to another governmental agency, the District will in good faith effort discuss with the transferring agency to place the terminated employees with the recipient agency and obtain benefits equal to those afforded him/her by the District.

If there are not enough qualified volunteers from among these affected employees, the Department will solicit qualified volunteers from the competitive area. Whenever possible, affected employees who do not volunteer to be transferred shall be reassigned to vacant positions within the competitive area for which the employee is qualified and which the Department has determined to fill.

In accordance with 5 CFR 351.301, a transfer of function (TOF) means the work of one or more employees is moved from one competitive area to another as a transfer of function regardless of whether or not the movement is made under authority of a statute, Executive order, reorganization plan, or other authority.
